Weld County Public Works has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II,
Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
The Colorado Department of Transportation (CDOT)has jurisdiction over all accesses to the State
Highways. Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit. This
is a shared access point with properties in the rear. The applicant is indicating a 30-foot access
easement.
The average daily traffic count for State Highway 52 at this location reflects 12,400 vehicles. This
count was taken in 1995.
WCR 1 (Baseline Road) has a count of 2281 vehicles. This count was taken December 29, 1999.
REQUIREMENTS:
Access Lane: In accordance with Section 24-7-50 J of the Weld County Code, Chapter 24,Article
VII, the flag lot configuration will be avoided where possible. The minimum width of a flag lot is 30
feet. The applicant is indicating that there is a 30-foot easement in place to accommodate access
to adjoining properties in the rear. This meets the requirement for this section.
Off-street Parking:The off-street parking spaces and the main office parking, including the access
drives, shall be surfaced with gravel, asphalt, concrete, or equivalent, and shall be graded to
prevent drainage problems. No staging or parking will be allowed on the access road. Utilize on-
site parking only.

COLORADO CASE: USR-1338 NAME: Molly A. Elliott
Environmental Health Services has reviewed this proposal for a farm equipment sales, repair, and
installation facility, grain and feed sales. We have no objections to the proposal, however, the existing
residence is greater than 200 feet from the proposed shop and the applicant shall insure that the facility have
adequate, convenient, sanitary toilet and sewage disposal system according to the Weld county Code 30-2-
180F and 30-2-10 respectively we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. In event the maintenance shop is equipped with a floor drain, the applicant must apply for an
Underground Injection Control (UIC) Class V Injection Well permit through the Environmental
Protection Agency (EPA), or provide evidence that the applicant is not subject to the EPA Class V
requirements.
2. The Environmental Health Services Division was unable to locate a septic permit for the septic
system serving the residence. The septic system shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and a technical review
describing the systems ability to handle the proposed hydraulic load. The review shall be submitted
to the Environmental Health Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or constructed the system
shall be brought into compliance with current Regulations.
3. The applicant shall provide evidence to the Weld County Department of Public Health and
Environment, and the Department of Planning Services, that the well has been appropriately
permitted/registered with the Colorado Department of Natural Resources and can be used for both
commercial and residential use.
We recommend that the following requirements be incorporated into the permit as "development standards":
1. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that
will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a
condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure stora e
site shall have a water-tight surface which does not permit seepage or percolation of manure
pollutants into the ground.
2. An individual sewage disposal system is required for the proposed shop and shall be installed installed m

according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be
designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage
Disposal Regulations.
3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those
wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites
and Facilities Act, 30-20-100.5, C.R.S., as amended.
5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
6. Fugitive dust shall be controlled on this site.
7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone
as delineated in 25-12-103 C.R.S., as amended.
8. Adequate handwashing and toilet facilities shall be provided for employees and the public.
9. The applicant shall maintain compliance with the Confined Animal Feeding Operation Regulations
(5 CCR 1002-19).
10. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a
safe manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules and Regulations
thereof.
11. The facility shall provide an adequate water supply for drinking and sanitary purposes.

Dear Mr. Anderson:
I have reviewed the submitted material pertaining to the Site Specific Development Plan and
Special Review Permit for an Agricultural Service Establishment at 379 Highway 52 in Weld
County (Case Name: Molly A. Elliott, Case Number: USR-1338). The Fire District does not
object to the Site Development Plan and Special Use Permit provided the requirements of the
District can be met. All applicable codes as they pertain to water supply, fire hydrant locations,
fire department access, and applicable fire code requirements as they pertain to building
construction must be met. Based on my review, I have the following comments:
• Buildings shall be constructed in accordance with the provisions of the Uniform Fire Code, as
ratified by the Weld County Commissioners, and all other codes and ordinances, as enforced
by Weld County.
• Water supply for fire protection is required for this use. In accordance with Section 903.2 of
the Uniform Fire Code, an approved water supply capable of supplying the required fire flow
for fire protection shall be provided to all premises upon which facilities, buildings or portions
of buildings are hereafter constructed or moved into or within the jurisdiction. A minimum fire
flow of 1,500 gallons of water per minute (g.p.m.), measured at a residual pressure of 20
pounds per square inch (p.s.i.), is required for a 2,500 square foot building of type V-N rated
construction. A minimum of 2,000 g.p.m. is required for a 5,000 square foot building of type
V-N construction. When one hydrant is required,the hydrant must be located so that the most
remote portion of the building is within 450 feet of a hydrant, as measured along the fire
apparatus access road and around the exterior of the building. When more than one hydrant is
required, as is the case with a fire flow requirement of 2,000 g.p.m., all hydrants used to meet
the required water supply shall be within 600 feet of a building as measured along the fire
apparatus access road and around the exterior of the building; and, at least one fire hydrant
shall be located such that it is within 450 feet of all portions of the building. Changing the
construction type of a building can reduce the required fire flow, however in no case shall the
flow be reduced to less than 1,500 g.p.m. provided by one hydrant.

• Fire apparatus access must be provided so that fire apparatus may reach within 150 feet of all
portions of a building. Access roads must be a minimum of 20 feet in width and provided with
approved provisions for the turning around of fire apparatus if any road is in excess of 150
feet in length. Fire apparatus access roads must be designed and maintained to support the
imposed loads of fire apparatus (60,000 pounds), must have a surface that provides all-
weather driving capabilities and be free from obstructions which includes locked gates unless
otherwise approved.
• Building construction plans for any new buildings or the remodeling of any existing buildings
must be submitted to the Fire District, by the applicant, before any building permit may be
issued. The plan set must include a final site plan showing the gross square footage of the
building, building construction type,the occupancy classification; and, a utility plan showing
fire hydrant locations,water main sizes, and available fire flow.
The Fire District reserves the right to make further comments as the project proceeds. Nothing in
this review is intended to authorize or approve of any aspect of this project that does not comply
with all applicable codes and standards. We appreciate being involved in the planning process,
