Our comments and questions are as follows: COMMENTS: WCR 16.75 is designated on the Transportation Plan Map as a local gravel subdivision road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of- way line. WCR 16.75 is located within Dream Acres, which is a platted subdivision. Weld County maintains this section of road for approximately .4 mile. Weld County Roads 11, 16, and 18 have all been annexed by the Town of Frederick surrounding this location. QUESTIONS: In the application, the applicant supplied photographs in all directions but north. The helicopter pad is located south of a machinery shed. Is the machinery shed going to be utilized to store the helicopter? Is the helicopter pad going to be upgraded and improved with asphalt or concrete to accommodate a landing pad or the approach to a storage or machinery shed facility? Is there a future hangar to accommodate storage being proposed? How is the applicant dealing with fueling and maintenance of the helicopter? The pictures supplied were that of the area in which the FAA has approved the heliport and the approach and departure area. The machine shed/shop was drawn in on the plat map as to indicate its position. The machine shed/shop is for our limn business and personal use. 2. In the Weld County Zoning Ordinance book under Definitions 10.1, Airstrip: It states that if the land is"adapted for the landing and taking off of aircraft",this indicates that some form of action must be done to develop the land. We haven't planned to do anymore than mow the area in the summertime,but if in the future we decide to pour a concrete pad, it will be in accordance with the FAA Advisory Circular-Heliport Design. 3. The application is for a Private Use Heliport(airstrip), as defined in the Weld County Zoning Ordinance section 31.4.6. No future hangar to accommodate storage is being proposed. 4. Our helicopter company owns a DOT approved fuel truck. For any off-airport fueling, during flight operations,the fuel truck is utilized. We have no objections to the proposal. However, it is important to note that we are not assigning a noise standard to the operation of the helicopter. We believe the designation of a standard would be difficult, if not impossible to enforce, as noise from the aircraft probably could not be mitigated. Also, the Colorado Revised Statutes (25-12-103(4)) specifically exempts noise from aircraft. We recommend that the following requirements be incorporated into any approval as"development standards": 1. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended (this standard is not meant to apply to the routine operation of the helicopter as the noise from the operation of the aircraft is exempt from regulation per 25-12-103(4) C.R.S., as amended) 6. The Frederick Planning Commission is aware the FAA requirements will govern the flight pattern for this facility. The main concern with these requirements from the FAA is will they limit development with height restrictions,larger area for setbacks,or setbacks due to noise from this facility because of the flight pattern. If the FAA requirements arc going to limit development in the area surrounding this facility,the Town of Frederick Planning Commission does have an abjection to Ms.Rhoads being granted a Use by Special Review permit for a helicopter landing facility. If there is any questions or concerns please feel free to contact the Frederick Town Hall at (303) 833- 2388. Please keep us informed on the issuance of a permit to this facility.
