RE: AUTHORIZATION FOR EXPANDED USE PRIOR TO ISSUANCE OF A SPE-
CIAL USE PERMIT AMENDMENT TO WELD COUNTY DISPOSAL, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on the 31st day of October, A.D. , 1979 , the Weld
County Board of County Commissioners granted an amendment to
Special Use Permit 319 :79 : 24 for an oil field fluids recycling
and disposal site on a tract of land described as follows:
That part of the Northwest one-quarter
Northwest one-quarter Section 12 , Town-
ship 1 North, Range 66 West of the 6th
Principal Meridian, Weld County, Colo-
rado, described as: Beginning at the
Northwest corner said Northwest one-
quarter Northwest one-quarter; thence
South 89°55 ' 41" East on an assumed
bearing along the North line said North-
west one-quarter Northwest one-quarter
a distance of 1259 . 89 feet to a point
50 . 00 feet West of the Northeast corner
of said Northwest one-quarter Northwest
one-quarter; thence South 00°21 ' 56"
West parallel with the East line said
Northwest one-quarter Northwest one-
quarter a distance of 1333 . 30 feet to
a point on the South line said North-
west one-quarter Northwest one-quarter;
thence North 89°57 ' 04" West along the
South line said Northwest one-quarter
Northwest one-quarter a distance of
1263. 39 feet to the Southwest corner
said Northwest one-quarter Northwest
one-quarter; thence North 00°30 ' 56" East
along the West line said Northwest one-
quarter Northwest one-quarter a distance
of 1333. 83 feet to the point of beginning.
Contains 38 . 624 acres more or less .
WHEREAS, it is recognized that it is necessary for Weld
County Disposal, Inc. to proceed with certain improvements
prior to a Board decision as to whether or not these improve-
ments can be authorized through the amendment of a Special
Use Permit, and
WHEREAS, Weld County Disposal, Inc. has agreed to indemnify
and hold harmless Weld County against any accidents or damage

that may occur -from the operation of the improvements prior to
approval, and
WHEREAS, Weld County Disposal , Inc. has agreed to waive
any arguments that it may have with respect to Weld County
being estopped in any manner from denying amendments to the
Weld County Disposal , Inc. ' s Special Use Permit, which amend-
ments would permit construction of said improvements.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that it hereby authorizes
such improvements being constructed prior to the issuance of a
Special Use Permit amendment, subject however, to the following
conditions :
A. That Weld County Disposal , Inc. is to obtain all
necessary and pertinent building permits and
inspections for modifications , enlargements,
or new construction associated with the expanded
use authorized herein.
B. Weld County Disposal , Inc. is to proceed in a
timely fashion to submit proper Special Use
permit application forms .
C. That such construction be in accordance with
Chen and Associates Subsoil Investigation
Report of August 29 , 1979 .
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 22nd day of
October, A.D. , 1980.

Dear Sir:
This letter is in response to your letter of September 29, 1980, regarding
continued operations of our facility pending the approval ofi the Special
Use -Permit.
We of course understand that. we are making the improvements at our own
risk and intend to hold the county harmless against any accident or damage
that might occur through our operation. We also agree to waive any argument
of estoppel if our improvements are not approved.
I hope this letter is sufficient to permit our continued operations.
