RESOLUTION
RE: APPROVE VACATION OF CONDITIONAL USE PERMIT#70 -WINDSOR ASSEMBLY
OF GOD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated September 23, 1981, the Board did approve
Conditional Use Permit#70 for a parsonage and sanctuary for Windsor Assembly of God on
the following described real estate, to-wit:
Part of the SW1/4 of Section 17, Township 6 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Windsor Assembly of God, do Otis,
Goan and Stewart, LLC, 1812 56th Avenue, Greeley, Colorado 80634, to vacate said
Conditional Use Permit#70, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Conditional Use Permit#70 be, and hereby is, vacated.

SUBJECT: Request for Vacation of CUP-70
Windsor Assembly of God Church
The Department of Planning Services is in receipt of a letter dated August 12, 2002, from Fred
Otis, attorney with the law firm of Otis, Coan and Stewart, and legal representatives for the
Windsor Assembly of God Church.
Mr. Otis, on behalf of his client requests a vacation of CUP-70, granted by the Board of County
Commissioners on September 23, 1981 for a church building and related structures, such that
the church is able to proceed with annexation to the Town of Windsor.
The Department of Planning Services is in support of this request.

RE: Windsor Assembly of God /Annexation to Town of Windsor, Colorado
CUP-70
Commissioners:
I represent Windsor Assembly of God with regard to an annexation to the Town of Windsor of
approximately 5 acres at the intersection of WCR 15 and Colorado State Highway 392. The
legal description is attached as Exhibit A.
As a part of the annexation the Town of Windsor has required that CUP-70 granted by the Weld
County Commissioners September 23, 1981, for a church building and related facilities be
vacated. Please consider this letter to be a request for a vacation of CUP-70.
