RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT#930 -
DUANE AND FRANCES WILSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 30, 1991, the Board did approve Use by
Special Review Permit #930 for an Agricultural Service Establishment (organic materials
composting and processing facility) in the A (Agricultural) Zone District for Duane and Frances
Wilson on the following described real estate, to-wit:
Part of the E1/2 NW1/4 of Section 35, Township 7
North, Range 66 West of the 6th P.M., Weld
County, Colorado
WHEREAS, in accordance with Sections 23-2-200.G and 23-2-260.D, the Board has
received a request from Duane and Frances Wilson, 16350 Weld County Road 76, Eaton,
Colorado 80615, for the partial vacation said Use by Special Review Permit #930, as well as a
revised map illustrating the vacated portion of the property and the existing permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said partial vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Use by Special Review Permit#930 be, and hereby is, partially
vacated as indicated on the revised map.

SUBJECT: AMUSR-930
Duane and Frances Wilson have requested to amend out a portion of their existing Use by Special
Review permit in accordance with Section 23-2-200.G of the Weld County Code. Section 23-2-
200.G states " Any decrease in the land mass occupied by a Use by Special Review shall qualify
the landowner to be able to request a partial vacation of the Use by Special Review from the Board
of County Commissioners".
Use By Special Review Permit 930 is for an Agricultural Service Establishment (organic materials
composting and processing facility) in the (A) Agricultural Zone District.
The property is located in the NW4 of Section 35, Township 7 North, Range 66 West of the 6th
P.M., Weld County, Colorado, east of and adjacent to Weld County Road 33 and south of and
adjacent to Weld County Road 76. The permit area will be 21 +/- acres after the amendment.
It is the opinion that the applicant is in compliance with the application requirements of Section 23-
2-200.G as follows:
1. Section 23-2-200.G.1 -- The subject property under consideration for a partial
vacation of the Use by Special Review has received permission to release the
property from the permit from applicable County and State agencies. This criteria
is not applicable in this situation.
2. Section 23-2-200.G.2 — This process does not create separate parcels. This
amendment was a condition of approval for Recorded Exemption 3252. The
applicants have indicated in the application materials that they understand that
AMUSR-930 will be a portion of Lot C of RE-3252 and will not create a separate
parcel.
3. Section 23-2-200.G.3 -- To obtain a partial vacation of the Use by Special Review
permit, the applicant shall:
a. Submit a letter to the Department of Planning Services requesting the partial
vacation. The applicant has requested the partial vacation in conjunction
with Recorded Exemption 3252 which was approved by Planning Staff on
January 25, 2001.
b. Submit a revised map to the Department of Planning Services illustrating the
vacated portion of the property and the existing permit. The applicant has
submitted a revised map that has been approved by Department of Planning
Services staff.

4. Section 23-2-200.G.4-- Upon determination of compliance with the original Use by
Special Review permit and all applicable applications, this Chapter and Chapter 29
of this Code by the Department of Planning Services, the applicant shall be granted
a partial vacation of the Use by Special Review permit. The Weld County
Department of Planning Services has determined the applicant is in compliance with
the original Use by Special Review permits (Use by Special Review 930).
5. Section 23-2-200.G.5 -- Once approved, the applicant must submit a plat
conforming to Section 23-2-260 D of this Code. This plat shall illustrate the vacated
portions of the property/operation. The plat shall contain two(2) vicinity maps. The
first shall illustrate the use boundary prior to the partial vacation. The second shall
illustrate the use boundary after the partial vacation. Upon approval by the Weld
County Board of County Commissioners the applicant will be required to submit a
plat to the Weld County Department of Planning Services for recording and pay the
appropriate fees.

To Whom It May Concern:
The following is a formal request for a partial vacation of existing Use By Special
Review No. 930 by submitting a Corrected USR Plat. The USR is located in the
Northwest Quarter of Section 35, Township 7 North, Range 66 West of the 6111 P.M.,
Weld County, Colorado.
On April 9, 2001, a meeting was held between Julie Chester (Lead Planner), Chuck
Wilson (President of Al Organics), and Steve Stencel (Intermill Land Surveying). We
were seeking direction regarding options for updating and/or correcting the existing USR
and splitting the parcel for Estate Planning purposes. Julie Chester advised us to submit
a corrected plat for the USR along with a brief summary of the reason for the corrected
map. We then inquired about the RE and SE process. She then indicated that we were
eligible for a 3-Lot Recorded Exemption in Conjunction with a Subdivision Exemption.
There are two sets of habitable improvements on the property making it eligible for the
SE process. However, through the research of the Planning Department, it was
discovered that the smaller house is not accountable as per the Weld County Assessor's
Office. In light of this additional information, we are formally withdrawing the
Subdivision Exemption application and are requesting a refund of the application fee.
We are still proposing to split the improvements from the balance of the farm by way of a
3-Lot Recorded Exemption (please see updated RE submittal).
The acreage, use and number of employees will not change as indicated in the original
Use By Special Review. The owner would like to reconfigure the boundary of said
existing USR to facilitate the Recorded Exemption process as submitted herewith. The 3-
Lot recorded exemption is for Estate Planning purposes. Further detail is explained
within the submittal material for said 3-Lot RE. By utilizing the partial vacation process,
we feel we are bringing the map and USR current by showing the location of the new
office/shop as well as existing structures, parking, storage and landscaping.
