RE: APPROVAL OF PURCHASE OF SERVICE CONTRACT FOR THERAPEUTIC
FOSTER CARE BETWEEN THE WELD COUNTY DEPARTMENT OF SOCIAL
SERVICES AND SHAROL DARLING AND AUTHORIZATION FOR CHAIRMAN
TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado Statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , a purchase of service contract for therapeutic
foster care between the Weld County Department of Social
Services and Sharol Darling has been presented to the Board of
County Commissioners for approval, and
WHEREAS , the term of the contract shall be from July 1 ,
1982 , to June 30 , 1983 , and the rate of the contract shall not
exceed $463 . 00 per month, and
WHEREAS , the Board of County Commissioners has studied
said contract and deems it advisable to approve the same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the purchase of service contract for
therapeutic foster care between the Weld County Department of
Social Services and Sharol Darling be, and hereby is approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be,
and hereby is, authorized to sign same.
The above and foregoing resolution was, on motion duly
made and seconded, adopted by the following vote on the 16th
day of August, A.D. , 1982 .

THIS CONTRACT, made this 1St day of JULY , 19 82 , between
the WELD County Department of Social Services hereinafter referred to as
"Count> a-d Sharol Darling, 3828 Wh. 8th St , Greeley, en 2,0AM
hereinafter referred to as Provider.
1. This Contract shall be effective from 7-1-82 to 6-30-83 but shall
automatically terminate with the removal of the child, or the expiration date
of the Foster Care facility certificate/license whichever is earlier. This
contract is in lieu of and supersedes all prior purchase contracts between
the parties hereto relating to the services herein described.
2. Tne County agrees to purchase and Provider agrees to provide therapeutic foster
care services as described below to the child/children

3. Tne Provider holds a current valid state license and is in compliance with the

Section I. Provider shall:
1. Complete initial training course (25 hours) and continue in the on-going
study group facilitated by the caseworker and other agency personnel. -
2. Cooperate with a team of professionals in -providing therapeutic focter care .
3. Provide transportation to and participate in therapy with the ch`_id/chi:ar_ n
as needed .
4 . Utilize therapeutic skills in controlling childs%childrens behavior.
5. Support the caseworkers treatment. and educational goals for the child '
children and cooperate with mandated visitation schedule of the County
Department and/or the Court.
6. Cooperate in providing other services as necessary to meet the spec is_ ,._ _ __

This includes food, clothing, shelter, personal sup-'s—s, education

E. Therapeutic foster care services as listed above under Section I,
Items 1 through 6. (Pro-rated if less than a full months care. )

2. Determine client eligibility for s_rv:c^_s burchased under this contract.
3. Assess and collect fees in accordance v::., the rules ant regulations of
the Colorado State Department of Social Services.
Pay Provider within 30 days of receipt of provider billing statement for
satisfactorily completed purchased services included in the billing s ete=en_ .

Section III. Tne Provi - shall: .
1. Not charge any fees to clients for services provided under this contract
nor assign the obligations under this contract or enter into any sub-
contracts without the express written approval of the Director of the
County Department of Social Services or his appointed designee.
2. Comply with the requirements of the Civil Rights Act of 1964.
3. Safeguard the confidentiality of information regarding the child/children
and his parents in accordance with rules of the Colorado State Department
of Social Services.
4. Indemnify County, Colorado State Department of Social Services and the State
of Colorado against any liability and loss against all claims and actions
based upon or arising out of damage or injury, including death, to persons or
property caused or received in connection with the performance of this
Contract.
5. Keep such records as are necessary for review, inspection, or audit by Federal,
State Department, County, or other authorized personnel for a period of
five (5) years.
6. Adhere to applicable Federal, State, and local laws that have been or may
hereafter be established.
Section TV. General Provisions:
1. The parties to this contract intend that the Provider stand in a relationship
of independent contractor to the County. No agent, employee or servant of
contractor shall be deemed an employee, agent or servant of the County.
Provider will be solely and entirely responsible for its acts and the acts
of its agents, employees, and servants during the performance of this Contract.
2. Payment pursuant to this Contract is in County, State of Colorado, or Federal
funds, whether in whole or in part, and is subject to and contingent upon
the continuing availability of County, State of Colorado, or Federal funds
- - for the purpose thereof.
3. Either party may terminate this Contract by giving thirty (30) days prior
written notice. The County Department reserves the right to terminate this
- Contract without prior notice in the event of an emergency affecting either
the child or the Provider, but the parties shall not be released from the
duty to perform their obligations up to the date of termination.
4. In the event this Contract is terminated, final payment to the Provider may
be withheld at the descretion of the County until final audit. Incorrent
payments to the Provider due to omission, error, fraud, or defalcation
shall be recovered from the Provider by deduction from subsequent payments
under this Contract or by the County as a debt to the County.

Purchase of Service Contracts for Therapeutic Foster Care

Dear Tom:
Request your review and submittal of the attached contracts to the County Board
for their approval . These contracts are related to Senate Bill 26, Placement
Alternatives for Children, and are similar to previous contracts for the thera-
peutic home project. The County Board of Commissioners have previously approved
the Senate Bill 26 plan on an annual basis, so these contracts are in accord with
the plan.
