Re; Inclusion of' Property into the Town of
Mead's Urban Growth Boundary

The Board of County Commissioners of Weld County recently received a request from the Town
of Mead to amend the boundaries of Mead's Urban Growth Area("UGA"). The UGA was
established through an agreement signed by Weld County and the Town in 2000. The agreement
has been codified in the Weld County Code. A copy of the agreement as set forth in the Code is
enclosed, As you can see, Section 19-8-80 of the Code allows the UGA to be amended by the
passage of a resolution by Mead,concurred in by the County, when the change is an addition of
property which: (1)was in common ownership and contained within a common legal description
with property previously included in the LIGA; or (2)directly adjacent to and contiguous with
property previously contained within the UGA and capable of being served by municipal
services,including water or sewer, within a reasonable period of time.

has requested to be included in the UGA. Although the subject property's parcel number is not
listed,the subject property is surrounded by two properties which the Town has requested to be
included.
If the Board of County Commissioners consents to the amendment, the subject property will be
included in the UGA. Such inclusion in the UGA will not be an annexation of the subject
e--. property to the Town of Mead,nor will it require such annexation in the future.

This firm represents Kerr-McGee Rocky Mountain Corporation ("KMRMC"),
formerly HS Resources, Inc., and Kerr-McGee Gathering LLC ("KMG"), formerly HS
Gathering, L.L.C. Both KMRMC and KMG own oil and gas leasehold and pipeline interests in
the above captioned lands (the "Property"). KMRMC and KMG personnel have been contacted

Dear Chris Gathman,
In the spring of 2001 the District completed its North trunk line extension. The North
line runs south from CSH 66 along both the east and west sides of 1-25 to WCR 28, then
east to WCR 9.5 and south to the St. Vrain River. The line runs along the north side of
the river to WCR 13 where it crosses under the river. From WCR 13 the line follows the
river on the south side to the treatment plant.
The properties which may potentially be serviced by District from this new line extension
lie within the following area: Sections 22, 23, 24, 25, 26, 27, 35 and 36 , T 3N, R 68W,
and Sections 19, 30, and 31, T3N, R 67W, located in Weld County, Colorado. The line
has a maximum capacity of nearly 10 million gallons per day.
The line is in service at this time and most of the capacity of the line is available.
In March of 2002 the District will put its new treatment plant into service. The treatment
plant has a capacity of 3 million gallons per day. About 80% of the new plant's capacity is
available.

approval for the Del Cameno Business Park, PUD.
Dear Chris Gathrnan,
As per our last conversation in September 2001 we are formally requesting the above
project be placed upon the next available date to be presented to the Board of County
Commissioners of Weld County.
The enclosed documents meet the requested information as per staffs findings and Weld
County Planning Commissions request. Additionally the exhibit immediately following
this cover letter shows the five lots that will be restricted in size of future development and
occupancy. The following note will be added to the Final Plat in support for the waiver
from building structures to existing wells for 150' setback as follows:
• This indicates the specific lots that are restricted form "AE" or"I" types of occupancy
for assembly, educational and industrial facilities as defined by the 1997 Uniform Fire
Code. Therefore, the occupancy shall be limited within the buildings to not more than
40 individuals for the lots indicated on this plat. Setbacks from the existing well to the
building structures shall be a minimum of 150 feet.
This note will be added to the final plat as directed by the Mountain View Fire Protection
District and in support of the request for setback waiver as stated above. We appreciated
and wish to thank staff for this consideration and look forward to your favorable action as
requested.

This letter is in response to your request for an updated water service commitment for up to 20
commercial / industrial lots, in the proposed subdivision described as follows:
PORTIONS OF SEC.35, T3N, R68W-- WELD COUNTY, CO
Del Camino-North Ridge Business Park
.-. The District provides water service within its service area as defined by the District. The
provision of water service by extension of existing water lines of the District to the above property
and the installation of taps for lots is clone under the terms of the Rules and Regulations of the District
established by the Board of the District from time to time. You may obtain a copy of the Rules and
Regulations from the District. This letter outlines the provisions of the Rules and Regulations,
however this letter does not change any provisions of the Rules and Regulations. The Board of the
District may alter and amend the Rules and Regulations at any time, and the provisions of this letter
are subject to alteration and amendment based on changes in the Rules and Regulations of the District.
We currently have a 24" diameter water line located along the I-25 Frontage Road at WCR 38
with additional capacity available. We can commit to provide service to the above property, subject to
the limitations in this letter, for one standard 5/8" X 3/4" water tap per lot; and the following
additional limitations on the provision of water service are:
1. In August of 1993 the Little Thompson Board implemented a "system impact" fee of
$1050 per lot for all lots to be added to the system. This is due upon completion of the
main line extension agreement.
2. All improvements to District facilities required to provide service will be the financial
responsibility of the developer in accordance with the District Rules and Regulations.
All improvements must conform to District Specifications.

3. Little Thompson Water District requires the transfer,of one share of Colorado Big
Thompson water for each lot in the commitment and then to pay for the rest of the tap
fee as the water lines are put in service. The developer then has the taps to sell with the
lots at the price that he sets.
4. If a fire hydrant is required for the subdivision there is a $2,000 fire hydrant fee that
needs to be paid prior to installation of the fire hydrant. You will be responsible for
any improvements needed to meet the required fire flows in your subdivision.
5. You will be required to provide the needed water lines in the proposed subdivision.
6. The design, installation and total cost of the project will be the responsibility of the
developer.
7. In order to provide service to the proposed business park you will be required to install
a 16 inch diameter water line connecting the existing 18 inch diameter water line
located WCR 9 'h and WCR 28 to your subdivision. The 16-inch diameter water line
will need to loop North along the I-25 frontage road to the new 24-inch diameter water
line under I-25 on the Rademacher property. The construction of this connection to the
18 inch diameter line will also require the installation of a master meter / pressure
reduction vault. The 24-inch diameter water line is subject to a rebate.
8. You will also be required to participate financially in a project to provide additional
service capacity from WCR 38 South to WCR 28. The exact cost and location of the
line will depend on the timing of your project and the extent of water lines installed in
the area at the time you want to begin.
This commitment letter will expire two years from the date of this letter if the taps have not
been purchased, paid for and installed by that date of expiration. The current fee for the domestic 5/8"
X 3/4" tap is $14,000.00. YOU ARE HEREBY ADVISED THAT THE RULES, REGULATIONS
AND TARIFFS OF THE DISTRICT ARE SUBJECT TO CHANGE WITHOUT NOTICE;
AND THIS LETTER IS ISSUED WITH THE SPECIFIC LIMITATION THAT THE
DISTRICT MAY CHANGE THE RULES, REGULATIONS AND TARIFFS APPLICABLE
TO THE ABOVE PROPERTY AT ANY TIME WITHOUT NOTICE TO YOU OR ANY

paving of streets,and the construction of curbs and gutters.The Customer shall reimburse the Diatrin for any expensedue to subsequent
changes by the easterner.
11. Water service shall be provided to Customers located within the property it the District's applicable rata,and upon terms and
conditions now in effect or at thy rates and under the terms and conditions as may behereafter be adopted by she Dinner and upon the rules
and regulations as now established or as may herother beeaablisbed by the District No water service may be obtainedexcept upon property
included within the boundaries of the District Customer agrees that nn other person shall be permitted to use water provided by the tape
herein described,
12. In the event that construction of the water mains is not completed by the Customer or the Cue towel contractor an ar before2 yarn
from the date of this Agreement,there this Agreement shall become null and void.in such event,the District may set off against thedepoA e

The Weld County Public Works Department has reviewed this zone change request. Comments
made during this phase of the subdivision process may not be all-inclusive, as other concerns or
issues may arise during the remaining application process.
COMMENTS:
The Weld County Public Works Department and Planning Department staff have met with the
applicant, Don Leffler, on 20-May-2002, regarding Z-548 California Homes PUD (Zone Change).
The following conditions were agreed upon by staff and the applicant for this application process.
Please note them for your case record.
RECOMMENDATION:
We recommend approval of this Change of Zone application.The following Conditions of Approval
shall be fulfilled by the applicant prior to final plat acceptance.
Conditions of Approval:
1. The development will be constructed in three (3) phases. A phasing plan and agreement will
be required prior to final plat acceptance.
2. The entry access to the development shall have a one-hundred (100) foot perpendicular road
segment to WCR 28, also tangent to the internal road curvature, and be identified on the final
plat.
3. The minimum rights-of-way for North Ridge road shall be dedicated on the final plat.
