HomeMy WebLinkAbout20022598.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING MOBILE HOME PERMIT, ZPMH #2307 - RICHARD CARLSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a hearing before the Board was held on the 26th day of August, 2002, for the purpose of hearing the application of Richard Carlson, P.O. Box 597, Hudson, Colorado 80642, for a mobile home for temporary use during the construction of a residence on the following described real estate, to-wit: Lot A of Recorded Exemption #3228; being part of the W1/2 NE1/4 and the W1/2 SE1/4 of Section 15, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing, the Board deemed it advisable to continue said matter to September 23, 2002, to allow the Department of Planning Services additional time to review the revised proposal of the applicant. WHEREAS, at said hearing on September 23, 2002, the Department of Planning Services staff stated Richard Carlson has requested the application for Mobile Home Permit, ZPMH #2307 be withdrawn, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to accept said request to withdraw said application. Box 597, Hudson, CO 80642 REQUEST: This is a request for a Mobile Home to be used for the Temporary Use During the Construction of a Residence. LEGAL DESCRIPTION: Lot A of RE-3228, being part of the W2 NE4 and the W2 SE4 of Section 15, T1 N, R65W of the 6th P.M., Weld County, Colorado LOCATION: South of and adjacent to WCR 10;west of and adjacent to WCR 45. PARCEL NUMBER: PARCEL SIZE: 10 acres ZONE DISTRICT: A (Agricultural) WATER SOURCE: Individual well SEWER SOURCE: Septic system The Department of Planning Services' staff has reviewed this request and recommends that this request be approved for the following reasons: 1. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-4-150 of the Weld County Code, as follows: a. The applicant must have a valid building permit for the construction of a permanent dwelling unit on the same lot. The applicant has applied for a building permit for the permanent structure(BCS-020163). b. The applicant must demonstrate that adequate water and sewage disposal facilities are available. The applicant has applied for a septic permit (SP-0200149), and the water source is a private well (239782). 2002-2598 The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 and 2 stated above. 4. A recorded deed for Lot A shall be submitted prior to issuing the permit for the mobile home. 5. Construction of the permanent dwelling unit shall commence within ninety(90)days of issuance of the temporary permit for the mobile home and shall be diligently pursued. 6. The temporary permit for occupancy of the mobile home shall be issued for a period of six (6) months. The permit may be renewed by the Department of Planning Services for two(2)additional six-month periods upon a determination by staff that construction of the permanent dwelling unit is being pursued with diligence. 7. Mobile homes permitted as a temporary use during construction of a permanent dwelling shall be removed within thirty (30) days after the permanent dwelling has been occupied. A Temporary Occupancy will be issued during this 30 days. 8. The property is in violation of Chapter 23 of the Weld County Code (Violation # 0000194). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer and submit a copy of the closure letter indicating compliance with Chapter 23 of the Weld County Code. 9. All derelict vehicles located on the property must be operational with current license plates, be screened from all adjacent properties and public rights of way,or be removed from the property.All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights-of-way. 10. Derelict manufactured (mobile) home: a manufactured (mobile) home that is partially or totally damaged by fire, earthquake,wind, or other natural causes, or is in a state of general dilapidation, deterioration, or decay resulting from improper lack of maintenance,vandalism, or infestation with vermin or rodents. Any such derelict manufactured (mobile) home shall be returned to and maintained in the condition as originally established on site and as inspected by the Weld County Building Inspection Department, or it shall be removed from the site. 11. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 12. Any future structures or uses on site must obtain the appropriate zoning and building permits. 13. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.)regulations. 14. Weld County Road 10 is designated on the Weld County Transportation Plan Map as a local gravel road, which requires 60-feet of right-of-way at full build out. There is presently 60-feet of right-of- way. This road is maintained by Weld County. 15. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant to Section 15-1-10 of the Weld County Code. 16. To date I have received no information. I still need the surrounding property owner information with the required 70%signatures(also included for your convenience). If you choose not to obtain these signatures, I will need to schedule a hearing before the Board of County Commissioner's. I do need this to proceed with the application as the camper trailer located on site is in violation. If it is determined that the application meets the approval criteria of Chapter 23, Article IV, Division 3, of the Weld County Code, you will be notified that the zoning permit is approved. If the staff determines that the application does not meet the approval criteria, you will be notified and asked to appear before the Board of County Commissioners at a public hearing. You will be informed of the hearing date at least a week prior to the hearing. The Board of County Commissioners will then consider your application and make a final decision on the zoning permit for the mobile home. He is due in county cort on Aug 30 for non-compliance on the above mentikoned violation ;and hs is still in violation of that order as of Aug 19. Your hearing is Aug 26 for the granting of the trailer permit and I cannot see how you could possibly grant this request prior to the outcome of the Aug 30 court date. I truly believe this request is nothing but another Carlson ploy that will allow him to have that trailer on the property for a lot longer than the 180 day permit. Mr. Carlson has been talking about building a home on that property for several years. Around six to ten years ago he even brought in several blue mattress appearing things that he said he was going to use for insulation. This past year he put a "fifth wheel" on the property. Its use seemed to be a place where he and his "buddies" could meet to drink and do whatever else they do. They did dig a few holes, parked an old dump truck and some other equipment on the property and left a pile of "trash" (cinder blocks and other useless building materials). Mr. Carlson has a 6,000 to 8,000 square foot home (depends on what day you visit with him.) just a few feet South of where he wants to put his "temporary" trailer. He has an old trailer by his home now. Why does he want or need to move a temporary "construction" trailer nearer us. What is his idea of temporary? The blue "mattress pads" have been there nearly a decade. His "fifth wheel" was parked there for several months this year and very little construction progress was made. They did manage to nearly cause a grass fire when their burning barrel fell over in a high wind and caught the grass and weeds on fire. We were just getting ready to call the fire department as the flames were getting very close to the fifth wheel when they realized that they had a major fire and put it out. Mr. Carlson has plenty of storage spaces and "construction materials" around his home. We do not see a reason for him to install another construction trailer on the West side of his property, also. As a matter of fact, we would appreciate it if he would move the "construction" equipment nearer his home. He is making the property look more like a dump than country or farming property. We appreciate your assistance in keeping this area from looking like a junkyard by denying Mr. Carlson's request for one of his "temporary trailers". Evidently our letter was shared with Mr. Carlson; we have no problem with that as long as all of the other letters written about this were shared. Evidently Mr. Carlson does have a problem with it. The week of August 26, Mr. Carlson and one of his friends went into the place where my wife works and showed the letter we had written to my wife's boss. Her boss read the letter and responded by saying my wife hadn't said anything about it to her. She asked my wife about the letter and, of course, my wife explained all of the problems Mr. Carlson has caused since purchasing the property close to us as well as the reason for the letter she had been shown. On Saturday, August 31, someone using one of Mr. Carlson's vehicles, this one a black pickup, kept driving up and down road 10 and Carlson's driveway, stopping and staring at me. Later that night, around 9:00, he stopped on Carlson's drive and started calling me every name imaginable. This went on for several minutes. I would have liked to run the 200 feet between us and confront him, but felt it was best to continue to ignore him. Neighbors called to make sure we were ok and encouraged us to call the Weld County Sheriff's Office but, once again, we felt it would just cause more hard feelings, so we didn't. Since then we have found glass liquor bottles in our driveway. Evidently Mr. Carlson is upset because we told you what we had already told him over the telephone and in writing.
