WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the e affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, rn Colorado held a public hearing on the 21st day of May, 1980 at the hour of 2 : 00 o 'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of considering the adoption of a new numbering system for the Weld County Building Code and adoption of amendments to the same, and WHEREAS, said numbering system and amendments to the Weld County Building Code are as per the attached memorandum, which is incorporated herein by reference, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the pro- posed numbering system and the amendments to the Weld County Building Code and having been fully informed, deems it advisable to adopt said numbering system and amendments as per the attached memorandum. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado that the numbering system and amendments to the Weld County Building Code, which are attached hereto, be, and hereby are, adopted. The Planning staff presented the Planning Commission's favorable recommendations and alternatives. No one in attendance at the hearing was opposed to the recommendations. After discussion, Commissioner Kirby made a motion to adopt Alternative #1 to read as follows: Alternative #1 (On page 15 - new paragraph to be added) 30.2.1.12 Building or structures in the "A" Agricultural zoned property used for the sole purposes of providing shelter for agricultural implements, farm products, livestock, or poultry. This exemption shall not apply in platted subdivisions or unincorporated towns filed and recorded in the Weld County Clerk and Recorder's Office. Commissioner Martin seconded the motion and it carried by the following vote: All Commissioners voted yea except Commissioner Steinmark and Chairman Carlson, who voted nay. The Planning Commission recommended that Section 30.8.5.3 of the Weld County Building Code by amended to read as follows: "The Director of Building Inspection may assess a reinspection fee of fifteen Dollars for each inspection or reinspection when such portion of work for which inspection is called is not complete or when corrections called for are not ready. ' Commissioner Steinmark made a motion to approve the Planning Commission's recommendation to Section 30.8.5.3. An unidentified gentleman in the audiance requested a copy of said amendments but did not comment on them. Mr. Anson stated that the changes are mainly to clear up inconsistency' s in the Building Code. Commissioner Carlson made a motion to approve the amendments to the Building Code as recommended and adopt the new numbering system. Commissioner Dunbar seconded the motion and it carried unanimously. The special inspector shall be a qualified person who shall demonstrate his competence, to the satis- faction of the Director of Building Inspec- tion, for inspection of the particular type of construction or operation requiring special inspection. All discrepancies shall be brought to the immediate attention of the contractor for correction ; then if uncorrected, to the_proper design authority and to the Director of Building Inspection. 30. 9. 1 . 2. 3 . 3 The special inspector shall submit a final signed report stating whether the work requiring special inspection was , to the best of his knowledge , in conformance with the approved plans and specifications and the applicable workmanship provisions of this Building Code. 30. 9. 1. 2.4 Waiver of Special Inspection. The Director of Building Inspection may waive the requirement for the employment of a special inspector if he finds that the construction is of minor nature . 30. 9. 1 . 2 . 5 Periodic Special Inspection. Some inspections may be made on a periodic basis and satisfy the requirements of continuous inspection, provided this periodic scheduled inspection is performed as outlined in the project plans and specifications and approved by the Director of Building Inspection. 30. 9. 1 . 2. 6 Approved Fabricators . Special inspections required by this section and elsewhere in this Building Code, shall not be required where the work is done on the premises of a fabricator registered and approved by the Director of Building Inspection to perform such work without special inspection. The certificate of registration shall be subject to revocation by the Director of Building Inspection if it is found that any work done pursuant to the approval is in violation of this Building Code. The approved fabricator shall submit a Certificate of Compliance that the work was performed in accordance with the Page 10 of 13 BOOK 904 REPEAL approved plans and specifications to the Director of Building Inspection and to the engineer or architect of record. The approved fabricator ' s qualifications shall be contingent on compliance with the following : 30 . 9 . 1 . 2 . 6 . 1 That the fabricator has developed and sub- mitted a detailed fabrication procedural manual reflecting key quality control pro- cedures which will provide a basis for inspection control of workmanship and the fabricator plant. 30. 9 . 1 . 2 . 6. 2 Verification of the fabricator ' s quality control capabilities , plant and personnel as outlined in the fabrication procedural manual shall be by an approved inspection or quality control agency. 30. 9 . 1 . 2 . 6 . 3 Periodic plant inspections shall be conducted by an approved inspection or quality control agency to monitor the effectiveness of the quality control program. 30 . 9 . 1 . 2. 6 .4 It shall be the responsibility of the inspection or quality control agency to notify the approving authority in writing of any change to the procedural manual . Any fabricator approval may be revoked for just cause. Re-approval of the fabricator shall be con- tingent on compliance with quality control procedures during the past year . Section 30 . 9 . 1 . 3 . 2 of the Weld County Building Code is amended to read: "30 . 9 . 1 . 3 . 2 Certificate Issued. Section 30. 11 of the Weld County Building Code is amended to read: "30 . 11 Expiration of PeLunit . Every permit issued by the Director of Building Inspection under the provisions of this Building Code shall expire by limitation and become null and void if the building or work authorized by such permit does not commence within 120 180 days from the date of such permit , or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 120 180 days . Before such work can be recommenced, a new permit shall be first obtained to do so , and the fee therefore shall be one-half the amount required for a new permit for such work provided no changes have been made or will be made in the original plans and specifi- cations for such work; and provided further that such suspension or abandonment has not exeeded one (1) year . " Section 30 . 15 of the Weld County Building Code is amended to read : "30 . 15 Liability . Any suit brought against the Director of Building Inspection or an employee because of such act or omission perfotwed by him in the enforce- ment of any provisions of this Building Code shall be defended by the Weld County Attorney until final deteiwination of the proceedings AS PROVIDED BY SECTION 5-3(4) OF THE WELD COUNTY HOME RULE CHARTER AND SECTION 24-10- 110 , CRS 1973 . THIS CODE SHALL NOT BE CONSTRUED TO RELIEVE FROM OR LESSEN THE RESPONSIBILITY OF ANY PERSON OWNING , OPERATING OR CONTROLLING ANY BUILDING OR STRUCTURE FOR ANY DAMAGES TO PERSONS OR PROPERTY CAUSED BY DEFECTS , NOR SHALL THE CODE ENFORCEMENT AGENCY OR ITS PARENT JURISDICTION BE HELD AS .
