RE: ACTION OF THE BOARD CONCERNING VIOLATION OF THE WELD COUNTY
CODE - JOSE AND ROSA FRANCO
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Jose and Rosa Franco, VI #9900121, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of March, 2002, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Jose and Rosa Franco were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Jose and Rosa Franco to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties.
BE IT FURTHER RESOLVED by the Board that the Weld County Attorney be, and
hereby is, directed to verify that those who are living on the property are in compliance with the
rules and regulations of the Weld County Code.

Currently, there is a violation of Chapter 23, Article III (3) , Division 1, of
Sections 23-3-20, 23-3-20.B, 23-3-30, 23-3-30 .I, 23-3-50 and 23-3-50 .D and
Chapter 29, Article III (3) of Section 29-3-10 of the Weld County Code.

To bring the property into compliance the property owner shall remove, restore
or completely screen the "Noncommercial Junkyard" from all adjacent properties
and all public rights-of-way. The number of animal units shall be reduced to
coincide with the number allowed through the Bulk Requirements . A building
permit shall be obtained for the addition recently added. Lastly, only 1 (one)
LIVING UNIT is allowed to occupy the residence.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties.

YARD. MOST OF THEM HAD CURRENT LICENSE PLATES ON
TITEM. I KNOCKED ON THE DOOR AND COULD HEAR THAT
PEOPLE WERE IN THE RESIDENCE, HOWEVER, NO ONE WOULD
ANSWER THE DOOR. COMMISSIONER GEILES KEEPS GETTING

a visual inspection with Joe Mendez, the following
items were noted: several vehicles, wood, trash,
tires, metal and miscellaneous debris. No pictures
taken at this time. We stopped and spoke to a man who
lived there and he showed us that all of the vehicles
did indeed have current license plates. We spoke to
him about the complaint of having multiple people
living there. He said that they were all related
(family) and asked if we had an issue with that. We
told him that he needed to clean the trash, wood,
metal, iron and miscellaneous debris. He said that he
would get it done right away.

items were noted: most of the trash, iron, wood,
metal and miscellaneous debris had been removed or at
least was not visible. The number of vehicle still
concerns me. I am worried about the number of people
living in the house.

items were noted: the property still appears in
fairly good condition, still a tremendous amount of
vehicle for that small of a house and lot. There were
approximately 8+ vehicles. The wood, metal, iron,
trash and miscellaneous debris appears to be starting
to return. Will keep an eye on this property.

a visual inspection of the property, the following
items were noted: wood, iron, metal, buckets, trash,
barrels, automobile parts, possible derelict vehicles
and miscellaneous debris has returned. Additionally,
I have concerns regarding the number of animal units
located on the property. Lastly, it still appears
that a large number of individuals are living in the
house. We also received a complaint regarding an
addition towards the back of the house without a
building permit.

Dear Mr. & Mrs. Franco:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting with
the Board of County Commissioners on March 12, 2002, at 10:00 a.m., to consider the violations occurring on
the property. The above mentioned property is in violation of the following Section(s) of the Weld County
Code:
Chapter 23,Article Ill, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-20.8 "One(1)SINGLE-FAMILY DWELLING UNIT and AUXILIARY QUARTERS on a parcel of land
created under the provisions of Chapter 24,Article VIII of this Code."
Section 23-3-30 "Accessory uses."
Section 23-3-30.1 "Noncommercial junkyard."
Section 23-3-50 "Bulk requirements."
Section 23-3-50.O "Maximum number of Animal Units permitted per acre:four(4)per acre or portion thereof."
Chapter 29,Article 111(3) "Building Permits"
Section 29-3-10 "No building or structure regulated by this Building Code shall be erected,constructed,enlarged,
altered,repaired,moved,improved,removed,converted or demolished unless a separate building permit for each
building or structure has been first obtained from the Building Inspection Department. (Before any demolition
permits are issued,approval must be given by the Department of Public Health and Environment)"
To bring the property into compliance the following option(s) are available:
The"Noncommercial junkyard"consisting of derelict vehicles, wood,scrap metal and miscellaneous debris shall
be removed or screened from adjacent properties and public-rights-of way. It was also noted the number of animal
units has exceeded the number allowed in the Agricultural Zone District. Please provide a list of animals so that
we can help you with an acceptable amount to be maintained. Additionally, it has been noted that possible
construction(an addition) has occurred without the required building permits. Lastly, it has been noted that it is
possible that more than one LIVING UNIT is occupying the residence. Please provide a list of Occupants and the
relationship to the property owner.
This meeting will take place in the County Commissioners'Hearing Room, First Floor, Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance
to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties the business day before
or as soon as possible to the above mentioned Violation Hearing date.

authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that

Section 23-3-30.1 "Noncommercial junkyard."
Section 23-3-50 "Bulk requirements."
Section 23-3-50.D "Maximum number of animal units permitted per acre:four(4)per acre or portion thereof"
To bring your property into compliance with the Weld County Code:
The"Noncommercial junkyard"consisting of derelict vehicles, trash, wood and miscellaneous debris shall be removed
or screened from all adjacent properties and all public rights-of-way. Additionally, the number of animal units shall be
reduced to conform to Weld County Code. Our records indicate that you have.75 acres.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,we
have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from ,January 7,
2002, to correct this zoning violation. Failure to do so will result in this office scheduling the violation before
the Board of County Commissioners to consider whether to refer the violation to the County Attorney's Office
for legal action.

31.3.9 "Noncommercial Junkyard" consisting of derelict vehicles, wood, and other
miscellaneous debris
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we
have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from , June 23,
2000, to correct this zoning violation. Failure to do so will result in this office scheduling the violation before
the Board of County Commissioners to consider whether to refer the violation to the County Attorney's Office

12/27/99 DROVE BY PROPERTY TODAY. THERE SEEM TO BE ALOT OF
VEHICLES ON PROPERTY. THESE ARE NOT THE DERELICT VEHICLES
THAT WERE HERE BEFORE. SOME OF THE DEBRIS HAS BEEN CLEANED,
HOWEVER, THERE IS STILL QUITE A BIT OF MISCELLANEOUS JUNK
STILL TO THE NORTH OF THE HOUSE. THE TWO TRUCKS THAT WERE
PARKED BEFORE ARE STILL IN THE SAME POSITION AS BEFORE. THE
PROPERTY IS STILL NOT IN COMPLIANCE. I WILL STOP BY AND TRY
TO CONTACT EITHER ROSA OR JOSE TO SPEAK TO THEM REGARDING
THE VIOLATION.
12/28/99 STOPPED AT RESIDENCE AND SPOKE TO JOSE AND ROSA
REGARDING THEIR VIOLATION. I LET THEM KNOW THAT THE 30 DAYS
IS UP AND THAT THEIR PROPERTY IS STILL NOT IN COMPLIANCE.
THEY DID SAY THAT THE 2 DERELICT TRUCKS AND 1 CAR IS THEIR
NEPHEWS, AND THEY WOULD CONTACT HIM TODAY TO HAVE THEM
REMOVED. ALSO I MENTIONED TIRES AND MISCELLANEOUS DEBRIS IN
THE YARD. THEY ASKED FOR A LITTLE MORE TIME TO BE ABLE TO
CLEAN UP THE PLACE. I DID TELL THEM THAT I WOULD EXTEND FOR
2 WEEKS, TO BE OVER THE HOLIDAY AND I WOULD BE BACK OUT TO
REINSPECT THE PROPERTY, AT WHICH TIME MUST BE IN
COMPLIANCE. THEY AGREED TO THIS. I WILL RECHECK PROPERTY
PERIODICALLY AND DO ANOTHER SITE INSPECTION AROUND JAN 7,
2000.

VEHICLES IN YARD. ALSO THE DEBRIS HAS NOT BEEN CLEANED UP.

1/26/00 10 DAY CERTIFIED LETTER SENT FOR BOCC.
02/01/00 SITE INSPECTION DONE ON PROPERTY. IT APPEARS THAT
THE SEPTIC SYSTEM HAS BEEN REPLACED. SPOKE TO A WOMAN ON
PROPERTY ASKING THAT ROSA CALL BACK IN REGARDS TO
VIOLATION.
2/1/00 SPOKE TO ROSA PEREA, SHE SAID THAT THE
SEPTIC SYSTEM HAS BEEN REPLACED AND THAT THEY ARE NOT ABLE
TO WORK AROUND THE EQUIPMENT. I DID LET HER KNOW THAT SHE
WILL BE RECEIVING A CERTIFIED LETTER TO APPEAR AT THE BOARD

LAVE BEEN TAKEN PLACE, I AM WILLING TO EXTEND FOR 30 DAYS
