HomeMy WebLinkAbout20020545.tiff RESOLUTION RE: GRANT REQUEST FROM HALL-IRWIN CORPORATION TO PRE-ADVERTISE SITE SPECIFIC DEVELOPMENT PLAN AND SECOND AMENDED USE BY SPECIAL REVIEW PERMIT#1125 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has received a request from Hall-Irwin Corporation, 3026 4th Avenue, P.O. Box 2150, Greeley, Colorado 80631, for pre-advertisement of an application for a Site Specific Development Plan and Second Amended Use by Special Review Permit#1125 for an Open-cut gravel mining operation, asphalt and concrete batch plants, and a recycling plant along with a Use Permitted by Right, Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts (stockpiling and retail sale of landscaping materials) in the A (Agricultural) Zone District, and WHEREAS, said property is described as E1/2SW1/4 and part of the SE1/4 of Section 30, Township 6 North, Range 66 West, and part of the NE1/4NW1/4 and part of the NE1/4 of Section 31, Township 6 North, Range 66 West of the 6th P.M., Weld County, Colorado, and WHEREAS, after study and review the Board deems it advisable to grant said request, with the hearing date to be set as April 24, 2002, at 10:00 a.m. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request from Hall-Irwin Corporation for pre-advertisement of an application for a Site Specific Development Plan and Second Amended Use by Special Review Permit#1125 for an Open-cut gravel mining operation, asphalt and concrete batch plants, and a recycling plant along with a Use Permitted by Right, Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts (stockpiling and retail sale of landscaping materials) in the A (Agricultural) Zone District be, and hereby is, granted. Enclosed please find a check in the amount of$35.00 for the fee for advertising. Currently, the approved uses on the site include a gravel mining operation and concrete batch plant. Hall-Irwin Corporation is proposing a landscape yard on the subject property, which requires an amendment to the current Site Specific Development Plan and Special Review Permit. We are requesting pre-advertisement for the following reasons. The Planning Commission Hearing date of April 2, 2002 has been set aside for the update of the Comprehensive Plan. When inquiring with the Planning Department, approximately three weeks ago, we were told that if our application was turned in by February 14, 2002 by noon, that the April god Planning Commission would be scheduled. Due to the review of the Comprehensive Plan on that date, cases are now being scheduled for the April 16, 2002 Planning Commission Hearing. The landscape business is highly seasonal, with Memorial Weekend as the busiest weekend of the season, in terms of sales. It is imperative to the success of this landscape yard to pursue approval of the amendment to the permit, meet all of the conditions of approval and record a mylar plat as soon as possible. We are requesting a Board of County Commissioner's Hearing date of April 24, 2002. Thank you in advance for considering this request. The Planning Commission hearing for April 2, 2002 has been set aside for the review of the comprehensive plan. All cases that would have been originally been scheduled for this hearing date have been moved to April 16, 2002 (including cases submitted prior to AMUSR-1125).
