The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial
Center, Greeley, Colorado, October 21, 2002, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:
Commissioner Glenn Vaad, Chair

MINUTES: Commissioner Masden moved to approve the minutes of the Board of County Commissioners
meeting of October 16, 2002, as printed. Commissioner Long seconded the motion, and it carried
unanimously.
CERTIFICATION OF HEARINGS: Commissioner Long moved to approve the Certification of Hearings
conducted on October 15, 2002, as follows: 1)Violation Hearings. Commissioner Masden seconded the
motion, which carried unanimously.
ADDITIONS TO AGENDA: There were no additions to the agenda.
CONSENT AGENDA: Commissioner Masden moved to approve the consent agenda as printed.
Commissioner Long seconded the motion, and it carried unanimously.
PROCLAMATIONS:
BREAST CANCER AWARENESS MONTH,OCTOBER 2002: Chair Vaad read the certificate proclaiming
October 2002, as Breast Cancer Awareness Month.
PUBLIC INPUT: Chris Eikenberg, County resident, expressed concern regarding the health of her 11
month old daughter. She submitted a copy of an emergency care evaluation for her daughter, marked
Exhibit A. She explained the company hired by the County to install a new furnace in her home left
fiberglass material in the baby's crib,which got in her eyes and may have caused significant damage. Ms.
Eikenberg stated due to injuries sustained by herself and her husband they have been unable to work and
were unable to pay for the cost of installing a new furnace in their home. She stated the Weld County

Housing Authority authorized the installation of this furnace; however, due to sawdust in the ducts, they
are unable to operate it due to potential health concerns. She further stated the work crew did not tarp the
rooms so there are metal shaving in her new carpeting,large vents were left uncovered,various debris was
left throughout the house, and they did poor workmanship on the gas piping. Ms. Eikenberg requested
the Board assist her in getting the furnace and the air ducts cleaned, replacing the damaged carpet,
modifying the process so the applicants are involved in the selection process for contractors and materials
prior to signing papers authorizing the work, and paying Gary Baletz of Floor Crafters for his assistance
in trying to clean her carpet. Ms. Eikenberg read a letter from Mr. Baletz, marked Exhibit B,for the record.
Ms. Eikenberg displayed various items recovered from her home, including blocks of wood, nails, screws,
etcetera. Chair Vaad stated a response will be provided regarding the issues expressed by Ms. Eikenberg.
WARRANTS: Claud Hanes, Controller, presented the following warrants for approval by the Board:
All Funds $292,960.00
Commissioner Long moved to approve the warrants as presented by Mr. Warden. Commissioner Jerke
seconded the motion, which carried unanimously.
NEW BUSINESS:
CONSIDER RETAIL LICENSE APPLICATION FOR TAVERN LIQUOR LICENSE AND AUTHORIZE
CHAIR TO SIGN -A AND G CONCEPTS, INC., DBA BEARS SPORTS SALOON: Mr. Barker stated the
application is complete, and the site was inspected by Commissioner Geile. Mr. Barker stated the
applicant could not attend this hearing due to a family medical emergency; however, he recommends
approval. Commissioner Long moved to approve said application and authorize the Chair to sign.
Seconded by Commissioner Jerke, the motion carried unanimously.
CONSIDER TEMPORARY ROAD CLOSURE OF WCR53 BETWEEN WCRS 46 AND 48: Frank Hempen,
Jr., Director of Department of Public Works, stated Weld County Road 53 will be closed between
October 28, 2002 and November 1, 2002, to replace a large irrigation pipe that crosses the road.
Responding to Commissioner Masden, Mr. Hempen stated the pipe is approximately 7.5 feet in diameter.
Commissioner Masden moved to approve said temporary closure. Commissioner Long seconded the
motion, which carried unanimously.
CONSIDER APPOINTMENTS TO WORKFORCE DEVELOPMENT BOARD: Commissioner Long moved
to appoint Alicia Ziegler and Tony Gagliardi to the Workforce Development Board. Commissioner Masden
seconded the motion, which carried unanimously.
CONSIDER RESCINDING RESOLUTION#2002-2464, DATED SEPTEMBER 10, 2002,AUTHORIZING
THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST MARY MILLER AND
KEITH MILLER FOR VIOLATION OF THE WELD COUNTY CODE: Mr. Barker stated Resolution
#2002-2464 needs to be rescinded because the Board's action on September 10, 2002, was to continue
the matter, not refer it to the County Attorney. Responding to Commissioner Masden, Mr. Barker stated
this was just a clerical mistake and rescinding this resolution will correct the paperwork. Commissioner
Masden moved to rescind said resolution. Commissioner Long seconded the motion, which carried
unanimously.

PLANNING:
FINAL READING OF CODE ORDINANCE #2002-7, IN THE MATTER OF AMENDING THE WELD
COUNTY CODE, SPECIFICALLY, THE ADDITION OF ARTICLE IX - LONGMONT PLANNING
AGREEMENT, TO CHAPTER 19 COORDINATED PLANNING AGREEMENTS: Commissioner Long
moved to read Code Ordinance#2002-7 by title only. Commissioner Masden seconded the motion,which
carried unanimously. Mr. Barker read said title for the record. Ms. Mika stated after further discussions
with the neighbors, most have indicated they are now satisfied with their options. She referred to the
agreement between the City of Longmont and the St. Vrain Sanitation District, marked Exhibit P, which
addresses the concerns of the property owners. Mr. Barker stated the term of the Intergovernmental
Agreement (IGA) was amended at the second reading, the Mayor for the City of Longmont has initialed
that change, and Longmont will follow up by amending its Ordinance to reflect the change. He stated the
Board needs to clarify whether the City of Longmont has agreements in place with the property owners.
He further stated the City has entered into an agreement with the St. Vrain Sanitation District which
stipulates that sanitary sewer may be provided in the IGA area regardless if a property is annexed to the
City. Dale Radimacher, Director of Water/Wastewater Utilities for the City of Longmont, stated the
followup letter from the WCR 1 Coalition's engineer indicates their concerns have been adequately
addressed. Mr. Rademacher stated the residents will be able to develop their property in the county, they
will not be required to annex to the City, and sewer service can be made available. He stated they are still
discussing the issue of development density with the Bogotts because the increased density will need to
be determined by the City Council. Responding to Chair Vaad, Phil DelVecchio, Longmont Planning
Director, stated it will take approximately one to two months to amend the City's Ordinance. Responding
to Mr. Barker, Mr. Rademacher stated the City's proposal is to delay the annexation requirement for ten
years. In response to Chair Vaad, Ms. Mika stated at the last meeting is was unclear whether the property
owners could continue with their current development plans or whether new Sketch Plans would be
required. She stated based on the terms of the IGA and subsequent negotiations,the Bogotts and Willises
will be pursuing sketch plans with an urban density, and the ten-year delay of annexation. The City has
made an offer to purchase portions of the properties that will be involved in the reservoir expansion, and
the property owners want assurance they can still develop the same number of lots on the remaining
portion of land resulting in a higher density. Mr. Rademacher stated he has no concern because he feels
the City can serve the higher densities. Mr. DelVecchio stated they would like to work with the property
owners and create a more integrated development, but ultimately the City staff needs to ensure the
densities are reasonable,with no annexation required for ten years. He clarified that the property owners
will still have the ability to annex within the ten-year term. No public testimony was offered concerning this
matter. Commissioner Jerke stated he is still opposed to this IGA. He thanked the County and City staff
for their efforts to improve the document and for working with the citizens in the area. However, he still
does not believe this will benefit the citizens of Weld County because the services are currently available
without the IGA, and this will create an additional hurdle prior to development with the County if that is the
owners' desire. Chair Vaad commented it appears the negotiations have been relatively successful and
the concerns of those who were initially opposed to the matter have been resolved. He stated there was
evidence of opposition from 13 property owners out of approximately 500 residences in the area.
Commissioner Masden moved to approve Code Ordinance #2002-7 on final reading. The motion was
seconded by Commissioner Long, and it carried, with Commissioner Jerke opposed.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent
agenda. Code Ordinance #2002-7 was approved on final reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
