RE: DECLARE CERTAIN REAL ESTATE AS SURPLUS PROPERTY, AUTHORIZE SALE
OF SAME TO FORT MORGAN SCHOOL DISTRICT RE-3 FOR MIGRANT HEAD
START FACILITY, AND AUTHORIZE CHAIR TO SIGN BILL OF SALE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, State statute and the Weld County Code require that all items disposed of
be declared surplus by the Board of County Commissioners, and
WHEREAS, the County has determined that certain Real Estate, described as a 42-foot
by 74-foot modular classroom, including all fixtures, equipment, and appurtenances associated
therewith, located at 315 Southridge Road, Fort Morgan, Colorado 80701, is no longer required
for County use, and
WHEREAS, the Board has been presented with a Bill of Sale for said Real Estate to
Fort Morgan School District RE-3, for and in consideration of the sum of$54,392.00, and
WHEREAS, the Board deems it advisable to declare said Real Estate as surplus and
approve said Bill of Sale.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the abovementioned Real Estate be, and hereby is, declared
surplus.
BE IT FURTHER RESOLVED by the Board that the Bill of Sale for said Real Estate to
Fort Morgan School District RE-3 in the amount of$54,392.00, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said Bill of Sale.

KNOW ALL MEN BY THESE PRESENTS, That the COUNTY OF WELD, a political
subdivision of the STATE OF COLORADO,by and through the Board of County Commissioners of
the County of Weld, of the first part, for and in consideration of the sum of Fifty-Four Thousand,
Three Hundred Ninety-Two Dollars ($54,392.00), in hand paid by Morgan County School District
RE-3, of the second part, the receipt whereof is hereby acknowledged,has bargained and sold, and
by these presents does grant and convey unto the said party of the second part, its executors,
administrators, successors or assigns, the following property, goods and chattels, to wit:
A buildings and improvement described as a 42 foot by 74 foot modular classroom,including
all fixtures, equipment and appurtenances associated therewith, located at 315 Southridge Rd., Ft.
Morgan, CO 80701.
TO HAVE AND TO HOLD the same unto the said party of the second part, its executors,
administrators, successors or assigns, forever. And the said party of the first part, for its heirs,
executors, administrators, successors or assigns, covenants and agrees to and with the said party of
the second part, and its executors, administrators, successors or assigns, to WARRANT and
DEFEND the sale of said property,goods and chattels,hereby made unto the said party of the second
part, its executors, administrators, successors or assigns against all and every person or persons
whomsoever.
IN WITNESS WHEREOF,The party of the first part has hereunto set its hand and seal this
7th day of October 2002.
