A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. The applicant has proposed a well as the source of adequate water for Lots A, B, and C. Property owners are advised that the quality of water available for usage may be limited to specific uses, i.e., "Domestic Use Only," etc. Because each situation is unique, the Department of Planning Services encourages property owners to contact the Office of the State Engineer, Division of Water Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581),to discuss each individual situation. St 333 ' • • 3. Prior to recording the plat: IA. The Weld County Department of Planning Services approves the applicant's proposed building envelope located East of and adjacent to Weld County Road 19. The building envelope shall be delineated on the plat. IB. The plat shall be titled: Recorded Exemption No. 1469-15-3 RE-3291 C. In accordance with Chapter 8, Article II of the Weld County Code, Lots A, B, and C shall be granted one residential/agricultural access. Direct access from a public road shall be limited to one access per legal parcel for residential use, no circle drives or additional accesses shall be granted. The road shall be graded and drained to provide all weather access. Accesses shall be placed in such a location as to have adequate sight distance in both directions, shall not be placed below the crest of a hill or where physical obstructions are present and shall be a minimum distance of 75 feet from any intersecting County or State roadway. /D. Lots A and B shall share a joint access point. E. Lot C shall use the existing agricultural,oil and gas,and ditch road access points necessary for agricultural operations as no additional accesses shall be granted. ,✓F. A 30 foot wide joint access and utility easement extending across Lots A and B from Weld County Road 19, for the benefit of Lots A and B, shall be shown clearly on the plat. The joint easement shall be dedicated for the use as shown using the language set forth in the Weld County Code, Appendix 24-F.E. The easement shall be graded and drained to provide all weather access. ✓G. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert please contact the Weld County Department of Public Works to adequately size the culvert. r/H. Weld County Road 8 is designated on the Weld County Transportation Plan Map as a local gravel road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way.A total of 30 feet from the centerline of Weld County Road 8 shall be delineated right-of-way on the plat. This road is maintained by Weld County. Weld County Road 19 is designated on the Southwest Study Area Capacity Improvement Needs as a collector status road, which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 40 feet from the centerline of Weld County Road 19 shall be delineated on the plat as right-of-way reservation for future expansion ofWeld County Road 19. This road is maintained by Weld County. ✓J. The applicant shall attempt to address the requirements (concerns) of the City of Dacono, as stated in the referral response received April 15, 2002. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. ;/K. The applicant shall attempt to address the requirements (concerns) of the Division of Wildlife, as stated in the referral response received April 18,2002. The applicant shall address the requirements of Weld County School District RE-8 as stated in the referral response received March 29, 2002. The following notes shall be placed on the plat: ✓1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. / * No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. +/2) Any future structures or uses on site must obtain the appropriate zoning and building permits. /3) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. i/ 4) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lots A, B, and C have an adequate water supply of sufficient quality, quantity and dependability. /5) Potential purchasers should be aware that Lots A and B may not be eligible for a domestic well permit which allows for outside irrigation and/or the watering of stock animals. The State Division of Water Resources issues all well permits. 6) Potential purchasers should be aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically there after. ✓7) Potential purchasers should be aware that approval of this Recorded Exemption does not guarantee that well permits will be issued for the lots. If the lot owner is unable to obtain a well permit a lot may be deemed non-buildable. The State Division of Water Resources issues all well permits. 8) Prior to the release of building permits for any structure exceeding 3,600 square feet,the applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code. ✓ 9) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. 10) Potential Purchasers are hereby notified that a confined animal feeding operation is located directly southeast of the intersection of Weld County Roads 8 and 19. Off-site impacts that may be encountered include noise from trucks, tractors and equipment; dust from animal pens and odors from animal confinement, silage, and manure. 11) Prior to the release of building permits on Lots A, B, and C, the Lot owner shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sanitary sewer line. In accordance with the Weld County Code, if a sewer line exists within four hundred (400)feet of the property line and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. /) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens,field work, harvest,and gravel roads;odor from animal confinement, silage,and manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 4. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. 5. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. Condition of Approval Item#3J I will discuss annexation of my property with the City of Dacono at such time it is necessary. In addition, my property is located in unincorporated Weld County. Condition of Approval Item#3K I provided a verbal description of the work necessary to bring the pond back to life to Ms. Haeger with the Division of Wildlife during a telephone conversation on April 15, 2002. As stated in that telephone conversation, the pond has been cleaned and enhanced to further the natural beauty and necessary habitat of the area. Native species will be utilized to re-vegetate the pond area. In addition, the conflicts between domestic and wild animals are cause for concern. Water supply statements addressing the following: a. Domestic use; Lots A, B and C propose to utilize individual, private wells. Each lot will apply for a well from the Colorado Department of Water Resources. Pending approval of this Recorded Exemption application, the appropriate permits will be applied for. Preliminary discussions with the State Division of Water Resources have revealed two sources for water- Denver Basin Aquifer and groundwater. The State Division of Water Resources will be consulted closely to determine the best sources for this specific site. 6. Irrigation water; Existing irrigation water will be retained by Lot C. 2. A statement explaining that the proposed lots will have an adequate means for the disposal of sewage in compliance with the requirements of the underlying zone district and the Weld County Department of Public Health & Environment. A copy of the septic permit or a letter from the sewage disposal facility must accompany the application. The proposed lots will have adequate means for the disposal of sewage and will maintain compliance with the requirements of the zone district and the Weld County Department of Public Health & Environment. The property is currently vacant. Septic systems are proposed for Lots A, B & C. 3. A description of how the property is being used. When the parcel(s) is located in the agricultural zone district, the description shalt include approximate acreage of prime and nonprime farmland as defined in the Weld County Comprehensive Plan, number and types of livestock and any existing improvements such as the principal residence, labor home, mobile home, manufactured home, barn, outbuildings, irrigation ditches, and oil well production facilities on the property. Proposed Lots A, B and C will access onto WCR 19. Agricultural and Oil/Gas accesses exist for Lot C off both WCRs 19 and 8. Lots A and B propose to share an access. Lots A, B and C will have the uses by right in the agricultural zone district and will continue with the existing uses. Lot A, B and C will have the ability to remain consistent with the agricultural uses by right. At this time, there are no animal units located on the site. There are oil and gas operations located on the property. The appropriate setbacks from these facilities will be maintained. A 100-foot setback north of the ditch, and south of Lot B will be maintained and protected for the use of the ditch company. 4. The reason for the proposed recorded exemption with an explanation how each lot will be used. The purpose of this application is to create two 9-acre lots to be used for Residential purposes. As stated above, Lot A, B and C will continue to have the uses by right in the agricultural zone district. 5. A description of the location, size and present use of the area where the proposed new lot(s)will be created. The site of the two 9-acre Lots A and B is located on the high end of the property and clustered together for a low impact to Lot C. In addition, the location of Lots A and B is due to a desire to separate existing oil and gas operations by a great distance. The ditch creates an opportunity to divide off Lots A and B from the southern portion of the property. Lot C will be approximately 142 acres. The actual acreage will be determined at the time of the survey. As stated above, all three lots are adjacent to WCR 19. There are no existing improvements and this property has been used for pasture, crop production and oil and gas operations. 6. A statement describing any unique physical characteristics on the site, if applicable. A small pond and wetlands exist in the southwestern 40-acres. This land is not productive farm ground. However, this land will be maintained and enhanced for wildlife habitat. The site boasts extraordinary views to the Front Range Mountains. 7. A statement indicating that all proposed or existing structures will or do meet minimum setback and offset requirements for the zone district in which the property is located. All proposed structures will meet the minimum setback and offset requirements for the agricultural zone district. 8. A statement indicating whether the applicant is willing to place a conservation easement on the property to maintain farm production or open space. A conservation easement is not applicable to this proposal at this time. 9. A statement indicating whether a building envelope will be designated on any of the lots. Due to the "Prime" designation of the property, Lots A and B have been clustered together in the northwestern corner. Should a building envelope be required by the Department of Planning Services, the app/icant requests a Building Envelope placement in the southwestern portion near the pond site. This placement will keep future development away from the active agricultural portions of the property. 10. A statement explaining how the proposal is consistent with Chapter 22 of the Weld County Code and any adopted municipal plan, and any approved intergovernmental agreement(s), if applicable. The site is within the City of Dacono's Urban Ground Boundary outlined in Chapter 19 of the Weld County Code. A.Goal 4 located in Section 22-23-60.O. 1 states, "Provide a mechanism for the division of land which is agriculturally zoned. The intent of this goal should be to maintain and enhance the highest level of agricultural productivity in the County." This application takes into consideration the present irrigation , oil and gas, and agricultural uses of the property by locating Lots A and B in the northwestern corner. 11. A statement explaining how the proposed uses will be compatible with existing surrounding land uses. The existing surrounding land uses include grazing, confined animal operations, crop production, rural residential, and a large industrial operation one-half mile north. This proposal is very compatible with the existing surrounding land uses. 12. A statement explaining how the proposal is consistent with the intent of the district it is located within as expressed in Chapters 22 and 23 of the Weld County Code. This proposal is consistent with the intent of the Agricultural zone district in the fact that the proposed split will not take active agricultural out of production. The proposed split is based on historical and current property uses including oil and gas, crop production, and irrigation practices. As stated above, this proposal allows the property owner to split a non-productive portion from the remaining property. The applicant believes that this proposal meets the intent of the Agricultural zone district. • 13. A statement explaining how the proposal is consistent with efficient and orderly development as defined in the Weld County Code, Section 24-1-30. This proposal is consistent with efficient and orderly development by splitting the property based on the existing uses of the property, including oil and gas, irrigation, and crop production. Although it is recognized that the construction of these homes will occur time, there is a potential adverse effect upon school facilities and financial capacities. This letter first summarizes the implications for school sites and facilities. Second, it addresses the school district' s ability to financially accommodate such an influx of students. Based upon expected student generation rates, the 3 new homes would generate approximately 3 new students to be accommodated within district. The number of students generated that will be generated by this development is very small, so a corresponding land dedication is impractical. Therefore, cash-in-lieu of land is requested at $939 per unit. This is the same level that the District is using in its intergovernmental agreements with the cities within the District. It is understood that approval of the proposed development does not yet add to enrollment potential. However, certain school issues should be considered at this important juncture, including school site planning, transportation access and facility capacity. Facility and Fiscal Capacity Issues Current facilities that would serve this development are Twombly Primary, Butler Elementary, Fort Lupton Middle School and Fort Lupton High School. Even with temporary solutions, facility capacities are not adequate to serve growth such as that proposed in this development and others previously approved and in the planning stages. Although the nine units proposed within this development seem insignificant, the cumulative effect of their construction, along with those previously approved, will present the same impact as a home in any other subdivision. At present, the District's bonding capacity is approximately $35. 8 million, or 20 percent of assessed valuation per state statute. Facility costs necessary to provide adequate school structures for the students generated by new development, including this project, will exceed $40 million excluding costs related to land acquisition and development as well as capital equipment necessary to make the facilities functional/operational. Even if the District received voter approval to issue debt to the maximum allowed, it would fall short of providing the facility space needed to supply seats for the students from other already approved residential developments. This, along with the two year lag in receiving property tax revenues from new construction, substantially compound the District' s ability to adequately provide capacity for students. Recommendations The School District is very concerned about the recent trend toward accelerated residential activity and the ensuing enrollment that will follow as well as the District' s physical and financial abilities to serve that growth. If approved, the district requests that the development pay cash-in- lieu of land at $939 per unit. It is further recommended that capital construction mitigation be made a condition of the County' s approval with those agreements included within recordation of the subdivision improvement agreement. It is the District' s recommendation that project approval be contingent upon the Mr. Enter having a meeting with Weld County School District Re-8 to confirm payment of the cash-in-lieu of land dedication and to establish the mitigation compensation to offset facility construction cost deficits that will be experienced. The first thing I noticed is that the small pond that was there has been bulldozed. As per a phone conversation with you on April 15, apparently the pond is being dredged due to silt build-up and will be enlarged. These comments are based upon the assumption that the pond will be rebuilt. In the past, it has been a very productive pond and wetland in terms of waterfowl and other wetland species of birds, amphibians, and small mammals. I recommend that the area around the pond be replanted with native species of emergent vegetation surrounded by native species of grasses, forbs, and other appropriate wetland species in order to maintain or improve the wildlife value that it has had in the past. Homesite development should be set back from the pond in order to reduce impact to aquatic wildlife. It is further recommended that homeowners be required to keep pets confined to their property in order to prevent encounters that are often detrimental to wildlife. Backyard livestock such as chickens and rabbits must be housed in coops and hutches adequate to prevent predation by native wildlife such as coyotes, badgers, and foxes.
