Box 758 Greeley, Colorado 80631 Gentlemen: RE: SEVERED MINERAL RIGHTS Your letter of October 21, 1977 was the last that we have received any information from you on the progress of the research into Severed Mineral Rights (H.B. 1222) . We would like to know why there has been such an extended delay and what has been done or is being done in this matter. Why is Weld County not complying with H.E. 1222? It seems to be trying to shift the burden of compliance with H.B. 1222 to the individual land owners. We are enclosing conies of letters we have received from a encies involved in this matter. COLORADO October 19, 1977 Weld County Livestock Association c/o Mr. Dean Kanode Route 1, Box 363 Ault, Colorado 80610 Dear Gentlemen: Thank you for the copies of your Resolutions regarding Severed Mineral Rights. Verbal information received from Mr. Herb Hansen, County Assessor regarding severed mineral rights indicates his assurance that he will be receiving two persons under the federal CETA program that he feels will be qualified to begin researching the ownership of severed mineral rights. It is his belief that this research will probably take most of 1978 and therefore it would be 1979 before these minerals would be placed on the tax roles. The Council, at its regular meeting on October 18, 1977 voted to request information from the County Commissioners and the County Attorney regarding the mineral rights owned by the County. This request shall include any legal opinions the Commissioners have been given regarding these mineral rights. The cost for record search of minerals in the County was at one time quoted at $300,000.00. This amount was not approved by the County Commissioners. This office will however, put minerals on the rolls if an individual furnishes name, address, legal description and proof of abstract searche that is all that we are able to do at this time. BOX 7O WI I D GRE ELEY, COLORADO H0[ COLORADO October 21 , 1977 Mr. Dean Kanode, Secretary Weld County Livestock Association Route 1 , Box 363 Ault, CO 80610 Dear Mr. Kanode and Association Members: Thank you for sending us the Livestock Association's resolutions concerning severed mineral rights and mineral rights owned by Weld County. The Board of Weld County Commissioners shares your concerns about the status of severed mineral rights. Resolution No. 5, Severed Mineral Rights. The Weld County Assessor is instituting a program, which should begin before the end of 1977, to proceed to clear the titles and ownership of mineral rights severed from real estate and provide procedures for the taxation thereof. From a presentation made by the Weld County Assessor before the Board of County Commissioners , he expects that this process will be time- consuming and may take up to two years to complete. Resolution No. 6, regarding Weld County's ownership of severed mineral rights. As of June, 1977, all property sold by the County includes the mineral rights held by the County. The Board has, and is, investigating procedures to divest itself of County owned mineral rights. The Board has looked into the possibility of returning the mineral rights to the surface owner; however, legal opinions from the County Attorney and the Attorney General state that there is no legal process , at the present time, through which the County could guarantee that mineral rights would return to the surface owner. The only option presently open to the Board is a public auction, at which the rights would go to the highest bidder. In the Board's opinion, this would probably mean the the County owned severed mineral rights would go to the large oil and gas corporations. Livestock Association: 10/21/77 Page Two The Board is studying the possibility of special interest legislation, presently being considered along two avenues. One alternative would allow the first rights of refusal to the surface owner; the second being the right of Weld County to retain the severed mineral rights now owned by the County. The Board of Weld County Commissioners has been very frustrated in its attempts to come to an equitable solution to this problem. We will continue our efforts to divest the County of severed mineral rights which the County holds while protecting the rights of the surface owners, We will keep you advised of any progress in this matter.
