RE: Reevaluation of Rent for Lease, Agreement Audit No. OMA-7318 at Fort
Lupton and Lucerne, Colorado
Reference is made to your letter dated September 26,2002 verifying that the improvements at Fort
Lupton, CO have finally been removed. Although the photos you sent do not specifically show the area
where the building foundation sat,I trust since you personally took these photos that you have verified that
the foundation has been removed.
Therefore, please be advised the Railroad hereby accepts the County's notice that the area at Fort
Lupton shown on that print marked Exhibit A, dated May 15, 1995, has been vacated and cleared of all
improvements. Accordingly, said print marked Exhibit A is hereby removed from the workings of this lease
and the annual rental for this agreement is hereby reduced to$1,500.00 per annum effective October 1, 2002.
Removal of the area shown on said Exhibit A from this Lease shall not affect any of the rights,
obligations or liabilities of the parties, accrued or otherwise,with regard to all installations covered by the
Lease prior to the cancellation date.
