A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. The Applicant has proposed a well as the source of adequate water for Lot B. Property owners are advised that the quantity of water available for usage may be limited to specific uses, i.e.,"Domestic Use Only,"etc. Because each situation is unique,the Department of Planning Services encourages property owners to contact the Office of the State Engineer, Division of Water Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each individual situation. 1 (Th J '- 3. Topographic or physical features of the proposed Lot A, such as ravines, ditches, streams etc. may limit the area available for a new or replacement septic system. Prior to recording the plat the Weld County Department of Public Health and Environment recommends that the applicant review the Weld County Code pertaining to septic systems to assure that any installed septic system will comply with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a septic system the lot may need to be enlarged. 4. Prior to recording the plat: A. Due to the prime agricultural soils on Lot B, the applicant shall submit a proposed building envelope to the Department of Planning Services for review. Upon approval by the Department of Planning Services, the building envelope shall be delineated on the plat. All building envelopes shall take into consideration setbacks from oil/gas structures as required by Section 23-6-10 of the Weld County Code. B. The West Greeley Soil Conservation District has provided information regarding the soils on the site.The applicant shall submit written documentation that they have reviewed the information and will use it to positively manage on site soils. J. The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. K. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. i No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) All structures requiring building permits shall be located within the designated building envelope. 4) All construction or improvements occurring in the flood plain as delineated on Federal Emergency Management Agency FIRM Community Panel Map 080266 0480 C C dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article V, Division 3 of the Weld County Code. 5) The installation of any septic system within the 100-year flood plain shall comply with the Weld County I.S.D.S.flood plain policy.In accordance with the State of Colorado I.S.D.S. Regulations, no septic system shall be installed with in the floodway. 6) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 7) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot B has an adequate water supply of sufficient quality, quantity and dependability. 8) Potential purchasers should be aware that Lot B may not be eligible for a domestic well permit which allows for outside irrigation and/or the watering of stock animals. The State Division of Water Resources issues all well permits. 9) Potential purchasers should be aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically there after. 10) Potential purchasers should be aware that approval of this Recorded Exemption does not guarantee that well permits will be issued for the lots. Any lot may be deemed non- buildable if the lot owner is unable to obtain a well permit. The State Division of Water Resources issues all well permits. 11) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. 12) Potential Purchasers are hereby notified that a confined animal feeding operation is located northwest of the site. Off-site impacts that may be encountered include noise from trucks, tractors and equipment; dust from animal pens and odors from animal confinement, silage, and manure. 13) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens,field work, harvest, and gravel roads;odor from animal confinement, silage,and manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 5. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. This decree locates a domestic well identified as Well No. 7-Unregistered as being 1350 feet north and 100 feet east of the Southwest corner of Section 9, T7N, R65W. It appears that the there is an existing well used for domestic purposes at a location within 200 feet of the decreed location. Under the Water Court Rules, structures may be anywhere within 200 feet of the decreed location and still be considered as at the decreed location. Located on a parcel of land described as N2 SW4 Section 9, T7N, R65W of the 6th P.M., Weld County, Colorado. Dear Mr. Johnson, This letter is in response to your request that Weld County Planning Staff consider a building envelope located in the northeast corner of Lot B. Planning Staff discussed your request on August 9, 2002. The Planners along with Monica Mika, Director, unanimously determined that the justification for the location of the building envelope is insufficient for staff approval for the following reasons: 1) You indicated that a well permit for a home could only be located in the northeast quarter because a domestic well was already located on the northwest quarter. After discussions with the State of Colorado,Division of Water Resources,staff has ascertained that a domestic well permit may be applied for on both quarter sections. The well permit submitted as evidence of adequate water for the existing home on Lot A was located in the southwest quarter of the southwest quarter. 2) Your letter indicated that the access road and non-exclusive easement could not be extended further north past the existing house on Lot A because the house, propane tank and domestic well are too close. A field inspection was done of the site on August 8, 2002 by Lauren Light and myself. As you can see from the attached photographs, there is more than enough room for vehicles to access along the existing roadway west of the home. Further, an access easement at this location will have no impact on the well. 3) Your letter states that the access road to the building envelope will be along the south property line, then cross the property to the north then along the north property line. -- During our field inspection we drove the proposed access road. The road would never support an emergency vehicle. In fact the road is non-existent along the north property line. Further,from the aerial photographs taken of the site, it is questionable as to what property the road truly lies on.To establish and maintain an access of this distance will be extremely costly for future property owners. 4) Your letter states that locating the building envelope in the northeast corner will have little or no effect on irrigation and crop land. Because the irrigation ditches run along the north and west edges of the property and will irrigate perpendicular to any access, staff believes the existing irrigation and crop land will be affected at either location. 5) Placing the improvements in the interior of a lot could cause conflict in the future should future owners wish to divide off improvements. The results of such a division are island lots that do not conform with orderly and efficient development. 6) There is only a small area in the northeast corner that is not within the flood plain boundary. 7) Your letter did not address where utilities will be placed. The cost for future property owners to extend utilities this distance could be extreme. I interpreted that this location was satisfactory to you. Anyway, the following are our reasons for the northeast location: A. First of all, the NE corner is where Dennis wants to build his house. In Dennis' and my mind, it has the least impact on the farm. We do have substantial farm experience and understand what is best for us and the farming operation. B. As to the farm impact, please refer to the Schulte/Johnson Plot Plan as presented in the original application packet (one attached) 1. The access road and non-exclusive easement can not extend further north past the house because the house, propane tank and domestic well are too close. Also the concrete head ditch is located where the road would be. A cost of over$25,000 would occur if the ditch, to irrigate the field north of the house, was relocated eastward. 2. The historically located road goes eastward from the house along the electric power lines to the creek area(approximately in the middle of the farm) and both go north on the east side of the creek, to the north boundary where the irrigation wells are located. Then the road continues east between the north property line and the existing concrete head ditch. This ditch irrigates to the south and irrigates the field to the east of the creek. By locating the building envelope in the northeast corner, irrigation and crop land have little or no effect. Our comments and requirements are as follows: COMMENTS: WCR 41 is designated on the Transportation Plan Map as a section line. This road is NOT maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of- way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The Weld County Public Works Department would like to review the final plat drawing prior to recording. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the State Highways. Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. (State Highway 14) In accordance with Section 24-7-50 J of the Weld County Code , Chapter 24, Article VII, the flag lot configuration will be avoided where possible. The installation of any septic system within the 100-year flood plain shall comply with the Weld County I.S.D.S. flood plain policy (attached). In accordance with the Colorado I.S.D.S. Regulations, no septic systems shall be installed within the floodway. Additionally, please note the following: 1) This application is proposing a well(s) as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. ''" f i 526 NONEXCLUSIVE LICENSE AGREEMENT FOR THE UPGRADE AND MAINTENANCE OF WELD COUNTY RIGHT-OF-WAY THIS NONEXCLUSIVE LICENSE AGREEMENT, made and entered into this 29 day of July , 2002,by and between WELD COUNTY, COLORADO, by and through the Board of County Commissioners of Weld County, Colorado,whose address is 915 Tenth Street, Greeley, Colorado 80631, as First Party,Dennis L. Schulte and A. Bruce Johnson, whose business address is 801 8th St, suite 220, Greeley, CO 80631as Second Party. WITNESSETH: WHEREAS, Second Party desires to more effectively access property located at the N Y2 of the SW 1/4 of Section 9,Township 7 North, Range 65 West of the 6th P.M., Weld County, Colorado in Weld County, Colorado, and WHEREAS,First Party will become the owner of the right-of-way known as Weld County Road 41 for a distance of mile North of State Highway 14 and located as follows: West 30 feet of the S '/2 of the SW 1/4 of Section 9, Township 7 North,Range 65 West of the 6th P.M., Weld County, Colorado in Weld County, Colorado, which is hereinafter referred to as "ROW," and WHEREAS, First Party, simultaneous with the execution of this agreement has tendered deed of dedication for said right-of-way, and WHEREAS, ROW is currently not being maintained by First Party, and WHEREAS, Second Party wishes to upgrade and thereafter maintain ROW at his/her/its sole expense in order to provide said more effective access. NOW, THEREFORE, in consideration of the covenants contained herein and the agreements of said Second party to be performed hereunder, and upon the conditions herein stated, First Party does grant to Second Party, its successors and assigns, a nonexclusive license to upgrade and maintain ROW without gating or fencing across the same. The conditions by which Second Party may upgrade and maintain ROW are as follows: 1. First Party retains the right to revoke this Nonexclusive License Agreement at any time for any reason, but such revocation shall not prohibit Second Party's continued use of the ROW for access to Second Party's property,to the extent that such continued use is consistent with the right of the public to use the ROW. First Party shall give Second Party written notice of its intent to revoke this Nonexclusive License Agreement at least ninety(90) days prior to the intended date of revocation. The upgrade and maintenance of ROW by Second Party shall be done in such manner as prescribed by First Party, which manner shall include, but not be limited to, the following: a. ROW shall be constructed and maintained as a graded and drained all-weather road. b. . If the installation of a cross culvert is required through an existing drainage pattern or ditch, Second Party shall be responsible to supply and install such culvert, which shall be inspected by First Party to ensure adequacy of capacity, strength, and length. Second Party shall be responsible to maintain the culvert after its installation, including periodically cleaning the same. c. If the installation of a cattle guard is required, Second Party shall be responsible to supply and install such cattle guard, which shall meet County standards. Second Party shall be responsible to maintain the cattle guard after its installation, including periodically cleaning the same. d. This Nonexclusive License Agreement does not grant the right to gate or fence ROW for private use, but is intended to provide access to private property. 3. The upgrade and maintenance of the ROW by Second Party, including those items set forth in Paragraph 1., above, or any other requirements stated by First Party, shall be at its own expense and without the aid or use of Weld County funds. Second Party shall be responsible for snow removal from ROW as part of the maintenance responsibilities referred to herein. 4. Except for the negligence of First Party, Second Party shall indemnify and save harmless First Party, its successors, assigns, employees, and agents from any damage or loss sustained by them or any of them arising by reason of Second Party's negligence with respect to the upgrade and maintenance of the ROW. 5. Except for the negligence of First Party, Second Party agrees to protect First Party and save and hold it harmless from any and all third party claims and damages that said upgrade and maintenance may directly or indirectly cause and hereby releases First Party, its successors, assigns, employees, and agents from any and all claims and damages of whatsoever character to property owned by Second Party resulting from any act, either on the part of the First P arty or on the part of any third party. 6. This Nonexclusive License Agreement embodies all agreements between the parties hereto and there are no promises, terms, conditions, or obligations referring to the subject matter whereof other than as contained herein. 8. If any term or provision of this Nonexclusive License Agreement, or the application thereof to any person or circumstances shall, to any extent, be held invalid or unenforceable, the remainder of this Nonexclusive License Agreement, or the application of such terms or provisions,to a person or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected, and every other term and provision of this Nonexclusive License Agreement shall be deemed valid and enforceable to the extent permitted by law. 9. No portion of this Nonexclusive License Agreement shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may possess, nor shall any portion of this Nonexclusive License Agreement be deemed to have created a duty of care which did not previously exist with respect to any person not a party to this Nonexclusive License Agreement. 10. It is expressly understood and agreed that the enforcement of the terms and conditions of this Nonexclusive License Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this Nonexclusive License Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Nonexclusive License Agreement. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this Nonexclusive License Agreement shall be an incidental beneficiary only.
