FOR A DOG KENNEL(NOT TO EXCEED 150 DOGS) IN THE A(AGRICULTURAL)ZONE
DISTRICT - CORDELL AND CRYSTAL DYE
A public hearing was conducted on November 6, 2002, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 18, 2002, and duly published October 23,
2002, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request
of Cordell and Crystal Dye for a Site Specific Development Plan and Use by Special Review Permit
#1400 for a Dog Kennel (not to exceed 150 dogs) in the A (Agricultural) Zone District. Lee
Morrison, Assistant County Attorney, made this a matter of record. Chair Vaad advised Crystal
Dye, applicant, that she has the option of continuing this matter to a date when the full board will
be present. However, if she decides to proceed today, it will require three affirmative votes, or in
the case of a tie vote, Commissioner Masden will listen to the record and make the determining
vote. Ms. Dye indicated she would like to proceed today.
Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and
entered the favorable recommendation of the Planning Commission into the record as written. She
gave a brief description of the location of the site and surrounding uses, and stated the site is 21
acres, with a majority designated as "not prime." Ms. Lockman stated the applicant lives on the
site, which was approved as a dairy operation for 500 cows by Special Use Permit #344. She
further stated the applicant currently has 400 cows on the dairy, and they have been operating for
12 years. Ms. Lockman explained approval of this Use by Special Review Permit will satisfy a
violation which was initiated due to the number of dogs. She stated there are currently 80 dogs on
the site, consisting of primarily Labrador Retrievers which are housed in kennels. She further
stated the applicant has submitted the necessary permits to convert and upgrade the kennels, and
visitors are only allowed in the kennels by appointment. Ms. Lockman stated the applicant is not
proposing to hire employees at this time; however, if employees are hired in the future, the
applicant will need to contact the Department of Public Health and Environment to ensure there are

adequate restroom and hand washing facilities. She further stated there are three accesses to the
site, and it receives water from the Central Weld County Water District. She stated 11 referral
agencies reviewed this proposal, the Platte Valley Fire Protection District did not respond, and two
indicated no conflicts. The remaining agencies responded favorably or requested conditions which
have been incorporated into the Conditions of Approval and Development Standards. Ms.
Lockman stated a letter of opposition was received from the Dinnel Family; however, they later
called and indicated they are no longer in opposition due to a misunderstanding of the proposal.
Char Davis, Department of Public Health and Environment, stated the applicant has completed
Condition #1.G, therefore, it can be deleted. Responding to Chair Vaad, Ms. Davis stated if the
applicant does hire an employee, she will need to contact the County to ensure the septic system
is adequate. She further stated there is a Development Standard which requires the applicant to
comply with the Individual Sewage Disposal System Regulations.
Don Carroll, Department of Public Works, stated Weld County Road 55 is a local gravel road, and
Condition of Approval#1.1 requires the applicant to do some tree and bush trimming at the access
to provide adequate sight distance. He further stated the applicant does have gravel stockpiled,
which will later be used for spreading on the parking area.
In response to Commissioner Jerke, Ms. Dye stated she does no commercial boarding; however,
she does sell the puppies, which are AKC registered. Responding to Chair Vaad, Ms. Dye stated
she has reviewed and agrees with the Conditions of Approval and Development Standards as
proposed and modified. No public testimony was offered concerning this matter.
Commissioner Long moved to approve the request of Cordell and Crystal Dye for a Site Specific
Development Plan and Use by Special Review Permit#1400 for a Dog Kennel (not to exceed 150
dogs)in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and
the Planning Commission,with the Conditions of Approval and Development Standards as entered
into the record. His motion also included the deletion of CA#1.G. The motion was seconded by
Commissioner Jerke, and it carried unanimously. There being no further discussion, the hearing
was completed at 10:15 a.m.
