the following present:
Chuck Carlson Chairman , Excused
John Martin Pro Tan
Gene Brantner Commissioner
Norman Carlson Commissioner

The following business was transacted:
I hereby certify that pursuant to a notice dated December 12, 1983, and duly
published December 15, 1983, in the LaSalle Leader, a public hearing was held
for the purpose of considering the request of Frederic L. Syman for a Use by
Special Review for one single family dwelling unit per lot other than those
permitted under Section 31.2.1 of the Weld County Zoning Ordinance. Prior to
this hearing, the Chairman Pro-Tem, John Martin, stated that since only four
Commissioners were present, the applicant could request the hearing be continued
to another date. The applicant wished to continue with today's hearing. Russ
Anson, Assistant County Attorney, read the request into the record. Mike Mullen,
• Planning Department representative, read the favorable recommendation of the
Planning Commission, along with the proposed Operation Standards. The applicant
came forward. He stated that he wishes to build a single family dwelling on a
parcel of ground containing approximately 45 acres. The Zoning Ordinance provides

zoned land such as this is 160 acres. No objections to the request were pre-
sented. Following discussion, Commissioner Johnson moved to approve this request
for a Use by Special Review for one single family dwelling unit per lot other

for Frederic L. Syman, subject to the recommended Operation Standards. Seconded
by Commissioner Brantner, the motion carried unanimously.

Paulette Weaver voted "no" because, as Mr. Swank suggested, there is a
chance of setting a precedent in dividing productive, although maybe not
prime, agricultural land into smaller acreages that do then become non-
productive. And while it is nice for people to have their rural acreages,
she does not necessarily feel that it is always in the best interests of
the community as a whole.

POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
The criteria for review is listed in Section 24.3 of the Weld County Zoning
Ordinance. -This request is to build a residence on less than 45 acres of
ton-irrigated agriculturally zoned land. The minimum lot size to build a
residence on non-irrigated agriculturally zoned land is 160 acres.
Approximately 80 percent of the subject site is Colby - Adena beams. The
capability sub class is IVe non-irrigated and is not considered prime
agricultural land. It appears that the subject site has been used
historically for cultivation dry land wheat crops.
The Department of Planning Services staff has not received any objections to
this proposal.

Re: Request for a on a parcel of land in the
W2NW4 Sec 8, T1N, R64W of the 6th P.m. , Weld County, Colorado
Dear Mr. Allison:
I am requesting this n o m . on this piece of ground for the
following reasons:
1. We desire a country home that is convenient and assessable to the
Weld ;;a-Itral Schools for whom I am employed.
2. The subject is a very desirable home site and not particularly
suitable for farming because of its size, configuration, soil condition
and topography.
3. Presently this land is nonproductive and by allowing my wife and I
to build a home on it, changes it from a marginal tax base to productive
tax base.
4. The use is certainly compatible with the strictly agricultural area.
5. Primarily, the need is due to the 43 acre size of subject and the
county requirements of a minimum site of 160 acres.
I am attaching a copy of the purchase contract with Raymond Kauffman and
Bruce Kauffman along with a copy of the Deed. Upon presentation of this
application, all required fees will have been paid.
Respectfully submitted,
Frederic L. Syman
