HomeMy WebLinkAbout20022333.tiff RESOLUTION RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING USE BY SPECIAL REVIEW PERMIT#654 - PERMAGREEN, CIO ROXY VENDENA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 26th day of August, 2002, a Probable Cause Hearing was held before the Board to consider setting a Show Cause Hearing to determine whether or not Permagreen, do Roxy Vendena, 5520 Harlan, Arvada, Colorado 80002, was in compliance with certain Conditions of Approval and Development Standards contained in Use by Special Review Permit#654 for a Fertilizer Storage, Mixing, Loading and Sales Operation located on property described as part of the NE1/4 of Section 24, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on August 26, 2002, after hearing testimony from the Planning Department, the Board finds that pursuant to the procedure as set forth in the Weld County Code there is sufficient probable cause to schedule a Show Cause Hearing to consider whether or not said Special Review Permit should be revoked for failure to comply with certain Conditions of Approval and Development Standards, and WHEREAS, the Board shall hear evidence and testimony from all interested parties at said Show Cause Hearing. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that a Show Cause Hearing be scheduled to determine whether or not Special Review Permit #654 issued to Permagreen, c/o Roxy Vendena, should be revoked. BE IT FURTHER RESOLVED by the board that the date for the Show Cause Hearing shall be November 18, 2002, at or about 10:00 a.m., in the First Floor Hearing Room of the Weld County Centennial Center, 915 10th Street, Greeley, Colorado. BE IT FURTHER RESOLVED by the Board that the issue to be considered at said Show Cause Hearing is whether or not the permit holder is in compliance with the following Development Standards: 1. Development Standard 1 - The uses permitted shall be a fertilizer storage, mixing, loading and sales operation in conjunction with a firewood operation as described in the application materials on file with the Department of Planning Services. 2002-2333 � . ///e 014 C1, ) 7_--a f PL0846 SET SHOW CAUSE - PERMAGREEN, 0/O ROXY VENDENA PAGE 2 2. Development Standard 3 - The Use by Special Review shall be limited to one (1) access point on Weld County Road 13. An eighteen (18) inch minimum diameter culvert forty (40) feet in length shall be installed at the point of ingress and egress to the subject site. 3. Development Standard 4 - The applicant and/or operator shall implement a runoff containment program for the Use by Special Review area as approved by the Department of Planning Services. 4. Development Standard 5 - The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq., of the Weld County Zoning Ordinance. 5. Development Standard 6 - The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq., of the Weld County Zoning Ordinance. 6. Development Standard 8 - The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 7. Development Standard 9 - The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. 2002-2333 PL0846 SET SHOW CAUSE - PERMAGREEN, C/O ROXY VENDENA PAGE 3 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 26th day of August, A.D., 2002.
