Prior to recording the Site Plan Review plat, the applicant shall address the following to the Department of Planning Services' satisfaction: A. The plat shall be amended to delineate the following: 1. The applicant shall delineate ten (10) parking stalls for the office/warehouse facility (Metal Building) and ten (10) parking stalls for the existing office/warehouse facility in addition to the ADA parking stalls discussed in item A.6. The dimensions of the parking stalls shall adhere to Appendix 23-A of the Weld County Code. The proposed off-street parking shall be sufficiently screened and parking areas shall be provided in the industrial zone districts to meet the requirements of employees,company vehicles,visitors and customers of the uses allowed by right and accessory uses. Off-street parking areas shall be located and screened from the public rights-of- way and adjacent properties and shall meet the requirements of Section 23-3- 250.A.2 and Section 23-4-30 of the Weld County Code. Trash collection areas shall be screened from public rights-of-way and adjacent properties and shall meet the requirements of Section 23-2-250.6 of the Weld County Code. The applicant shall use recycled asphalt on the approach from Weld County Road 16 to the existing building.Additional recycled asphalt on the west and south sides of the building will be required to accommodate visitors and customers. The site will be required to meet all requirements of the Americans with Disabilities Act. At least one parking space shall be van accessible. A five (5) foot wide aisle will be required adjacent to the van accessible space. The accessible path to the building and public right-of-way shall be delineated on the plat. (Departments of Planning Services, Public Works) 7. The existing employee parking,trailer,and equipment area shall be surfaced with gravel and shall be graded to prevent drainage problems. Although not specifically,delineated in the application documents, any on-site lighting shall adhere to the requirements of Section 23-3-250.6.6 and shall be shown on the Plat. (Department of Planning Services) 9. Additional landscape treatment shall be delineated near the trash enclosure area and shall meet the requirements of Section 23-3-250.6 of the Weld County Code. Further,the applicant shall submit a landscape and screening plan for review and approval to address screening of adjacent properties, including Weld County Road 16. Due to the nature of the facility, the mobile home storage area shall be screened with an opaque screen material at least eight feet in height. (Department of Planning Services) 10. The plat shall be revised to address the requirements of the Union Pacific Railroad as outlined in their referral received August 8, 2002. No landscaping shall be indicated within the Union Pacific right-of-way and it shall be indicated that the access within the Union Pacific right-of-way shall not be used for this business. (Union Pacific) 11. A total of 50 feet from the centerline of Weld County Road 16 shall be delineated on the plat as right-of-way reservation for future expansion of Weld County Road 16. (City of Fort Lupton) 12. Fencing shall be indicated around the two existing wells on the property. To prevent conflicts between the parking and access of the mobile homes and the two existing wells. (Department of Planning Services) 13. The applicant shall include in the Landscape Plan the following information: B. An installation schedule which specifies when the landscaping will be installed on site. (Department of Planning Services) C. A Plant Material List specifying the Botanical and Common names of all plant material to be installed;the size of the plant material at installation and whether the plant material is to be containerized or B&B. A landscape maintenance schedule which specifically states who will perform maintenance and that maintenance is on-going and shall not end upon final acceptance by the Department of Planning Services. (Department of Planning Services) 2. The following requirements shall be addressed prior to recording the Site Plan Review Plat: A. The septic system serving the shop shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. The applicant shall submit evidence to the D,ppartment of Planning Services, from the Colorado Division of Water Resources, dethonstrating that the well is appropriately permitted for the commercial use. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). D. The applicant shall attempt to address the recommendations (concerns) of the City of Fort Lupton as outlined in their referral received August 19, 2002. (City of Fort Lupton) E. The applicant shall address the requirements of the Union Pacific Railroad in their referral response received August 8, 2002. The applicant shall not use the driveway access located within Union Pacific right-of-way nor install landscaping within Union Pacific right-of-way. (Union Pacific Railroad) F. The applicant shall provide written evidence to the Department of Planning Services from Colorado Interstate Gas that all their concerns have been addressed in regards to their existing gas pipeline right-of-way on the property. Any changes to the plat (if necessary)shall be made to reflect the conditions of Colorado Interstate Gas. (Colorado Interstate Gas) G. The applicant shall provide written evidence to the Department of Planning Services from Duke Energy that all their concerns have been addressed in regards to their existing gas pipeline right-of-way on the property. Any changes to the plat (if necessary) shall be made to reflect the conditions of Duke Energy. (Duke Energy) H. The applicant shall provide written evidence to the Department of Planning Services from KN Energy that all of their concerns have been addressed in regards to their existing gas line easement along the western boundary of the property. (KN Energy) The applicant shall enter into a Private Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for access, parking, landscaping and screening requirements. The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the plat. (Department of Planning Services) J. The applicants shall submit evidence (clause in the lease agreement...)that the mobile homes shall be removed within timely fashion upon expiration of or default on the lease agreement or provide financial assurance to be submitted with the improvements agreement (performance bond...) allowing for the removal of the mobile homes. In accordance with the Weld County Code, no land, building or structure shall be changed in use or type of occupancy, developed, erected, constructed, reconstructed, moved or structurally altered or operated in the commercial or industrial zone districts until a Site Plan Review has been approved by the Department of Planning Services. (Department of Planning) B. All structures, including signs, on site must obtain the appropriate building permits and conform to the Uniform Building Code as adopted by Weld County. (Department of Planning) C. Outside storage shall be screened to meet the requirements of Section 23-3-250.4.a and 23-3-250.4.b of the Weld County Code. Adequate screening of outside storage shall be provided with solid board fencing spaced 1/4 inch and a minimum of six (6) feet in height or an equivalent screening provided that it is approved by the Planning Department. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Department of Public Health and Environment) E. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. (Department of Public Health and Environment) G. Fugitive dust shall be controlled on this site. (Department of Public Health and Environment) H. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. (Department of Public Health and Environment) The applicant shall operate in accordance with the approved "waste handling plan". (Department of Public Health and Environment) J. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. (Department of Public Health and Environment) K. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. (Department of Planning Services) L. If applicable,the applicant shall obtain a stormwaterdischarge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. Landscaping materials as indicated in the approved Landscape Plan shall be maintained at all times. Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time. (Department of Planning) O. The driveway access located within Union Pacific right-of-way shall not be used nor shall landscaping be installed within Union Pacific right-of-way. (Union Pacific Railroad) P. All construction on the property shall be in accordance with the requirements of the Weld County Department of Building Inspection and Chapter 29 of the Weld County Code. (Building Inspection) Q. All construction shall be designed and constructed in accordance with the provisions of the Uniform Fire Code, as ratified by the Weld County Commissioners and all other applicable codes and ordinances, as enforced by Weld County. (Building Inspection) 4. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 23-2-160.V of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of approval. The applicant shall be responsible for paying the recording fee. 5. Prior to the release of building permits: A. The applicant shall address the requirements of the Department of Building Inspection as outlined in their referral received August 19, 2002. (Department of Building Inspection) B. Site Plan Review Plat shall be prepared after the Site Plan Review application is approved. The plat shall be submitted to the planner and be ready for recording at the Weld County Clerk and Recorder's Office within 30 days of approval. The shall meet all requirements of Section 23-2-160 and Article II, Chapter 27 of the Weld County Code. Information was obtained from Don Carroll at Weld County Public Works to help illustrate the turning radii of design vehicles, (AASHTO —Geometric Design of Highways and Streets, pages 22, 30 and 31) which is attached with this letter for use as a reference when looking at the map. Outlined on the map are illustrations of the minimum and maximum turning radii of a WB-60 vehicle. You can see that there is extra room for turning above and beyond these dimensions, which are dotted in on the map for illustration to show turning areas, and in all actuality, the existing space between the home fronts can be utilized as a turning area. Please note that the shortest distance between home fronts is in excess of 45 feet. Our map will not show the exact same as on AASHTO page 31 as for there are not any full 180 degree turns. The direction of travel can be made in both directions, however the majority direction will be clockwise as for this is the easiest for a driver to see when parking or removing a home. Mobile Home Services, Inc. has no immediate use planned for the north building "A" as it appears on the site plan map except for as follows. The"office" portion of the building will be used by us, MHS, for our own purpose. This will consist mostly of just some paperwork or records that we need to keep handy for reference if needed. The other portion of this building is divided into 2 parts, the newer, front"shop" area which is connected by a breezeway to the older, or original part of this building. MHS plans to use this older part for storage of tools and materials related to the business, i.e. axles and or tires, nuts and bolts,jacks,jack stands, anchors, etc. MHS at this time has no plans for the front "shop" area other than parking in it. It is our intension to answer any questions that will or may arise, however if it is felt that a certain area needs a better explanation from M-IS Inc., please feel free to contact us at the above phone number. We will try to address the items requested in order with your application requirements. 1. Site plan review application form, included with this packet. 2. Signed and notarized site plan review certification form, included with this packet. 3. Copy of deed, etc., included with this packet. 4. Not required 5. Not required 6. A detailed description of the proposed use. Mobile Home Services Inc. will use this area for the purpose of storing and wholesale sales of Manufactured Housing. 7. Water source see state certification of well included in this packet. 8. Septic, see enclosed included in this packet. 9. WCR access info, WCR 16 serves as the public and only access to 13050 WCR 16. The main means of access to the property will be a common, or existing, drive that is already shared between the railroad ROW and the western border of the property, (see site plan and road access map). This particular parcel of property is different from others because of the railroad and their ROW, along with Highway 85 and their ROW, in that MHS Inc. will use little, if any of actual, Weld County Roads. Most of, if any, truck traffic will be using existing ROW's , however, when homes are moved within the county, the Treasurer issues a"Tax Aut." That showes both, taxes are paid in current, and along with that "paper"they also issue a $10.00 permit that allows use of all county roads, which would include all use of WCR 16. Also, to address acceleration and deceleration lanes, the railroad tracks,(because of their existence at that particular spot) already provide the acceleration and deceleration required for Weld County. 10. # of employees, included in this form(3), however, this number also accounts for all, but which will seldom be at this location all at one time. 11. Statement of offsets, as drawn on the site plan map. Although the fencing will be on the property lines, (minus required setbacks for fencing on the north side), to address this, page 1 see map. To meet Weld County's required offsets will be as follows, 25' from the property line on WCR 16 (North side), 10' from all other property lines, (West, South and East). This meets Weld County's offset requirements for a commercial zone. 12. Building elevations, not required, there are no new buildings being built. 13. Signage, MHS Inc. will follow Sec.23-4-100, part"C", #6 to address this issue. Currently, we propose a sign 4'x6', fastened to the "A"building, consisting of our, Name, Purpose, Phone number and Hours, on an aluminum backing, colors would be black on white, (see included). 14. Landscape requirements, MHS Inc. will try to address parts A-E as one entire entity, with all specifics, as follows; Set backs will meet Weld County's requirements for off sets, as seen above in # 11 of this statement. For the east, west and south perimeters we will leave a minimum 10 foot buffer zone which will be overgrown with"native" plants indigenous to the area, however this area will be maintained so as not to be obnoxious. This leaves us with the north side of the property, which will be landscaped as follows, (please refer to site plan map for exact dimensions and placement). Landscape plan as it appears on map as "A" will consist of Tan Cobble rock 3-6 inches in depth, with Junipers, 2 per planting in a triangle formation and Golden Flame Spirea centered within the triangles, and the triangles will try to accommodate the odd size of the part "A". Part "B", (as on map), will consist of the same Tan Cobble rock along with larger decorative rocks. Part "C", (as on map), will also consist of Tan Cobble rock along with approximately 30 Native Plum. MI of the above parts A, B, and C will be under laid with a weed barrier and steel edging. The watering of these plants will be provided from an offsite water supply, (MHS Inc. will purchase water from Ft. Lupton public works and truck it in on trailer), to keep the plants alive and provide for vigorous growth until the plants can establish themselves and from then on as a needed basis, (drought or summer heat). The lot will be maintained in a manner to keep the landscaping alive as said above, and the remainder of the premises will be maintained through interior roads and of course, mowing and weeding as needed. MHS Inc. would like however to ask Weld County that at the time of this printing we think that it would be best to do the barrier, edging and rock, however with current climate and water conditions that we do all the above except planting the plants, in that early Spring (2003) would be best for the plants survival. 15. Storm water runoff, not required, no new construction. 16. Off street parking, utilizing the existing parking, MHS Inc. strongly feels that there is more than enough existing spaces to accommodate this. 17. Not required. 18. Not required. 19. Water Quality, MHS Inc. will not affect the existing water quality with the placement of manufactured housing on this land, as there will be no dumping of waste that could seep into the ground. D. Glare, there will be no new obstructions, building, etc. that would tend to cause a glare. H. Property maintenance, the entire property will be kept in a professional manner. SOILS/LIMITATIONS: The Julesburg sandy loam found on this parcel has slight limitations for shallow excavations and septic tank absorption fields. The soil has slight limitations for shallow excavations, and moderate limitations dwellings with or without basements and small commercial buildings. Windbreaks and landscape plantings are generally suited to this soil. PRIME FARMLANDS: No Prime Farmlands will be taken out of production. SOIL EROSION POTENTIAL: Surface runoff is slow and the erosion hazard is low. The City of Fort Lupton Planning Commission reviewed the proposed plans at their regular meeting on August 13, 2002. The Commission offers the following comments: 1. This property is within the City's Urban Growth Boundary and the City intends to annex the property at some point in the future, after contiguity is achieved. We recommend that this development meet all applicable City standards for Streets, sidewalk, curb and gutter, parking lot paving, landscaping and screening. 2. The driveway for the storage area, as shown, is a closed loop. It appears that the applicant intends for the loop to connect with the north side of the property from the northwest corner of the loop. The drawings should be modified to reflect this condition. A closed loop would not be practical or acceptable to the Fire District. 3. The Fort Lupton Transportation Plan shows Weld County Road 16 as a Minor Arterial. The cross-section for a minor arterial is attached. Minor Arterials require 100 feet of right-of-way. The interim plan is to construct a 2-lane arterial, which includes two through-lanes and a center turn lane. It is recommended that Weld County Road 16 be improved to meet the interim standard. 4. The Commission recommends that access be shared with the property to the west. If this is not practical, then the Commission would like to see the curbcuts better defined and reduced to 36 feet in width to increase safety. 5. It is recommended that the parking lot that serves the employees and the public be paved. City Standards require 4% interior parking lot landscaping. 6. It is strongly recommended that the developer provide a stormwater detention pond to mitigate the impact to surrounding properties created by the addition of more than 50 new rooftops. 7. This plan hardly qualifies as a proper plat given it is not located within the section that it is a part, nor is it ties to any adjacent properties. A cursory review would lead one to think that any proposed development should be confined within the area marked "Property Line". Yet where is this property in relationship to anything? One would also think that the area marked "Existing Shared Driveway" is clearly not within the property owned by the developer and therefore it is not a part of the plan, yet it appears to be included. At the same time, it is not clear if it is intended for access. How can a developer develop property they possibly do not control nor own? Likewise, the Landscape"B"area appears to extend outside the site property, yet it too looks like it is included as part of the overall development. Therefore, it is the opinion of the Railroad that based upon the scant information supplied on the site plan that the proposed development does encroach upon the property rights of the Railroad. And that the Railroad does not approve of the development nor has it joined in the development of this site to provide any property for access or landscaping purposes. The Railroad is adamantly opposed to any purported use of its property without written permission from the Railroad and expects these issued to be addressed by the Weld County Planning Department. The Applicant , R & R Hot Shot Service, Inc . , submits the following as its statement in accordance with the application requirements for site plan review certification . 1 . The 4 . 633 nacres comprising the recently rezoned property which is identified as Recorded Exemption No. 296 will be utilized in the Applicant ' s oil and gas well servicing business . The Applicant has operated for a number of years from the northerly 2 . 633 acres in the tract and recently amended the recorded exemption to encompass the south 2. 0 acres . The Applicant was in need of the additional acreage in order to provide additional storagespace _for_...,machinery_ and equipment . which is utilized . in his oil and gas well ....servicing...business. The entire acreage will continue to be utilized primarily for storage of the equipment and machinery, and for the performance of some repair work upon the equipment and machinery. Additionally, the building located on the northern portion of the acreage is utilized as the Applicant ' s office_. The only additional construction which the Applicant plans to undertake upon the property from that which is already existing is the erection of a chainlink fence around the perimeter of the additional 2 . 0 acres TE -have been added to the recorded exemption. No structures will be erected or expanded upon the property. 2 . The storm water retention facilities upon the property have been adequate up to this point, and since no additional improvements will be added to the property, Applicant does not anticipate that any storm water run-off or other waterflow problems will develop upon the site . The Short Line ditch which runs north and south is only a number of feet to the east of the Applicant ' s site. The storm water and any excess water flow into the ditch and proceed away from the property by virtue of that ditch. The statement of the engineer employed by the Applicant to address the storm water run-off is shown upon the site plan map. 3 . The proposed use of the property meets the off-street parking requirements listed in the Weld County Zoning Ordinance as the property has sufficient paved parking space at the northern most portion of the property, and also has additional unpaved parking space on the south portion of the acreage if that should ever become necessary. The off-street parking is sufficient to provide adequate parking space for not only the personal vehicles of the employees at the site, but also the various business vehicles which visit the site and are stored upon the site. 4 . The load areas upon the Applicant ' s site are in conformance with the applicable Weld County standards in that adequate space is provided in all loading areas to accommodate the trucks and other vehicles when loading and unloading without the need to encroach upon any neighboring property or rights of way. These loading areas are paved with asphalt. The copy of the map submitted in the Applicant ' s rezoning application demonstrates the compliance with this standard . The loading areas further comply with the use regulations under the Weld County Zoning ordinance. 5 . The site has two accesses onto Weld County Road 16 . Both accesses enter the site from the north, and these accesses have been utilized by the Applicant for a number of years . The Applicant has encountered no difficulties in the utilization of these accesses to Weld County Road 16 . 6 . The proposed use of the site by the Applicant meets with the set-back requirements of the zone district in that the building located upon the site is at least 55 ' from the centerline of Weld County Road 16 . The Applicant does not plan on building any structures whatsoever upon the property, and certainly no improvements which would be less than 55 ' from the centerline of Weld County Road 16 will be built. 7 . The building located upon the Applicant ' s property meets the off-set requirements of the zone district in that it is more than 10 ' from any of the property lines of the Applicant ' s site. 8 . The landscaping requirements of Weld County have been met in that far less than 85% of the total area of the lot is covered. As described above , the 2 . 0 acres which comprises the newly added land to the recorded exemption will not be covered by any structures . The only improvements to be erected upon that property will be a chainlink fence around the perimeter of that 2 . 0 acre tract . The Applicant ' s site has a driveway which abuts the southern portion of Weld County Road 16 for at least 10 ' . 9 . The trash collection at Applicant ' s site is fulfilled by virtue of Applicant ' s personnel removing the trash collected on the site on a regular basis . This trash is hauled away from the site by the Applicant ' s employees on a regular basis, and certainly no less than once a week . 10. The site has an adequate source of potable water from a water well located in the northern portion of the 4. 633 acre tract . As mentioned above, the Applicant recently applied for and received approval for a rezoning of the subject property, and the water source was reviewed and determined by Weld County to be adequate at that time. 11 . The site has adequate sewage disposal facilities as it has a septic tank located upon the northerly portion of the site . Again, the sewage disposal facility was approved by Weld County at the time of the Applicant ' s request for rezoning of the subject property. 12 . The Applicant ' s property has been utilized in the same fashion for which it will be utilized in the future for at least the past eight years . The Applicant does not plan upon altering any of the use of the subject property, with the one exception being that the Applicant will store additional equipment and machinery on the 2 . 0 acre track which comprises the southern portion of the entire tract . The storage of this additional equipment and machinery should not affect in any way the amount of noise, the air quality, the water quality, the presence of any radiation or radioactive materials, or the amount of heat and light which will exist upon the subject premises . With regard to the northerly portion of the property, the Applicant does not emit any noxious orders or emissions from the operation of this facility, nor does the Applicant discharge any effluent into any water system. The Applicant does not deal with radiation or with radioactive materials , and the processes which have occurred upon that property for many years have never caused any noise problems . The Applicant may do occasional welding at the site, but such welding processes do not result in the reflection of any beems or rays of light onto any adjacent properties . The Applicant ' s operation, then, will not cause any traffic hazard or cause any hazard to any adjacent property owners . The Applicant acknowledges that he must continue to maintain the property in the manner which presents it in a pleasing appearance. Applicant states that he has always maintained his property in such a fashion and is proud of the appearance of its property. The Applicant will continue to maintain the property in that method . 13 . The site plan review map is attached hereto and incorporated herein fully . As we agreed, I am writing you this letter to describe the use of the property and to accordingly explain that we are neither a landfill nor a solid waste disposal site. R&R Hot Shot Service is a frac tank service company, providing 500 BBL tanks to the oil industry. As a consequence of using the tanks to "flow back" oil & gas wells prior to the wells being put on production, some sand used in the fracturing process is accumulated in the tanks. After use, the tanks are returned to our yard where they are cleaned out/prior to re-use. t, - u The process used to clean out the tanks consists of washing the sand out of the tanks into a cleaning pit on the yard, and when sufficient sand accumulates iii the pit, it is removed and transported to a disposal site. Unfortunately, we have had problems with finding reputable transporters and disposers of this sand, and as a result a large amount has recently accumulated on the yard, giving the impression that our yard is a disposal site itself. This is neither our intention or our normal mode of operation. Upon approval by the Weld County Health Department, we will remove all accumulated sand to an approved disposal site in short order. We have been ready to do so since July 11, and are simply awaiting approval. If you have any further questions, please feel free to contact me at (303) 426-8911.
