Environmental Health Services has reviewed this proposal for two self storage buildings to be leased to individual customers. We have no objections to the proposal,however,we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: An individual sewage disposal system is required for the proposed self storage building(s)and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. The applicant shall provide current evidence that the facility has an adequate water supply. (i.e., well or community water system) We recommend that the following requirements be incorporated into the permit as "development 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 6. Adequate handwashing and toilet facilities shall be provided for employees and the public. 7. The facility shall utilize the existing public water supply. (Central Weld Water District) The site shall be used for self-storage for lease to customers only. Our comments and requirements are as follows: COMMENTS: WCR 52 (49th Street) is designated on the Transportation Plan Map as a collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by the City of Evans. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3- _,50, the required setback is measured from the future right-of-way line. Traffic Counts: The average daily traffic counts (ADT) for WCR 52 between WCR 33 and WCR 35 is 4,344 vehicles 5/22/2000. REQUIREMENTS: Additional Items: • Show adequate turning radius to accommodate larger U-haul lease trucks at all turning locations • Show retention pond on plat drawing • Is there an office located on Lot A? • Is the storage area fenced? Access: The City of Evans has jurisdiction of all accesses in their annexed street system. Please contact the City of Evans office to verify access permits or for any additional requirements that may be necessary to obtain or upgrade the permit. Weld County recommends a shared access point with Lots A and B to minimize additional accesses to a collector status road. Off-street Parking Requirements:The off-street parking spaces(lanes)including access drives shall be surfaced with asphalt, concrete, or the equivalent and shall be graded to prevent drainage problems. Storm Water Requirements: A drainage report shall be provided in compliance with the requirements of Section 24-7-120 and 24-7-130, Article VII, Design Standards, Chapter 24, Weld County Code. ^pc: USR-1371 M:\WPFILES\DON-C\PLAN11USR.WPD MEMORANDUM TO: Sheri Lockman, Planner II COLORADO DATE: February 13, 2002 FROM: Kim Ogle, Planner III Ito SUBJECT: Rodriguez, USR 1371 Landscape Plan Review The applicant shall provide additional information addressing the following Sections of the Weld County Code, specific to Landscape Requirements: Section 23-2-240.A.10 states: Buffering or screening of the proposed use from adjacent properties may be required in order to make the determination that the proposed use is compatible with the surrounding uses. Buffering or screening may be accomplished through a combination of berming, landscaping and fencing. Section 23-3-250.A.5.a, Required Landscaped Areas in Commercial Zone Districts states: No more than eighty-five percent(85%) of the total area of a Lot in any Commercial Zone District shall be covered. Land shall not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by decorative gravel or wood chips, or if it is otherwise suitably landscaped. Section 23-3-250.A.5.b, Required Landscaped Areas in Commercial Zone Districts states: That portion of a Lot in any Commercial Zone District which abuts a Public or Private Street right-of-way shall be landscaped for a distance of ten (10)feet, measured at a right angle from the Lot line towards the interior of the Lot. Based on the information provided by the applicant, there is not sufficient detail provided to complete a full review of the proposed Landscape treatment for this site. A second submission shall be required for evaluation. EXHIBIT I Iy sa February 5, 2002 COLORADO Weld County Department of Planning Ms. Sheri Lockman 1555 N. 17th Avenue Greeley, CO 80631 Re: Case Number USR-1371 Dear Ms. Lockman: This letter is in response to the request for a Use by Special Review to allow a special permit for storage units to be constructed at 4248 W. 49th Street, Weld County. Staff has reviewed the proposed request and finds that it does not comply with Evans Comprehensive Plan. Per the Coordinated Planning Agreement adopted by Evans and Weld County on October 4, 1999, Evans Future Land Use Map, Exhibit A, identifies this area as low density residential. Thus, commercial/industrial activity would not be a permitted use for this area. To alleviate potential non- conforming uses in the future, the City of Evans requests denial of this proposal. Upon review of Article III, Div.1., Sections 23-3-10 to 40 of Weld County's Zoning Ordinance, I could not determine that storage units are allowed by right, considered an accessory use or are even listed as a use by special review. If the intent of the request is to construct the units through a home occupation permit then the request clearly does not meet Weld County's Zoning Ordinance, which states a Home Business as an incidental USE to the principal permitted USE for gainful employment of the FAMILY residing on the property, where: 1. Such USE is conducted primarily within a DWELLING UNIT or ACCESSORY STRUCTURE and principally carried on by the FAMILY resident therein; 2. Such USE is clearly incidental and secondary to the principal permitted USE and shall not change the character thereof. Since the use is intensive enough to locate within a commercial or industrial zoning district, the request would not be compatible with the surrounding residential area. Therefore,per the coordinated planning agreement, staff respectfully recommends denial of this proposal, and requests that Weld County accept our recommendation. USR-1371 1. A separate building permit for each building shall be obtained prior to any construction. 2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the 1997 UBC, 1999 NEC and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance. 6.
