Request to appeal an administrative decision concerning a
dairy made in the administration and enforcement of the Weld
County Zoning Resolution in the Agricultural Zone District
as set forth in Section 9.1.3. a. of the Weld County Zoning
Resolution on a parcel of land described as part of the N1
NEZ, Section 19, T4N, R68W of the 6th P.M. , Weld County,
Colorado.
LOCATION: 3 miles west of the intersection of State Highways
56 and I-25 on the south side of Highway 56.
The Department of Planning Services staff has determined that
a dairy belonging to Mr. J. L. Wright has been in existence
prior to January 5, 1977 (the effective date of the zoning
and special use permit regulation for this property) . Any
dairy operations started after January 5, 1977, requires
approval of a special use permit by the Planning Commission
and the Board of County Commissioners. Mr. Wright has sub-
mitted evidence indicating that his dairy operations began
sometime during 1973-1974. Mr. Scheopner is appealing the
staff's decision that the dairy was there prior to January
5, 1977.
