The purpose of this letter is to amend e"Agreement for the Relocation and Realignment of a Portion of
the McIntyre Ditch," dated June 111 2001 (see attached). This Agreement provided documentation
describing the conditions of the relocation and realignment of a portion of the McIntyre Ditch located
along the East property line of Lot A and B of Recorded Exemption No. 1061-07-2-RE 2668.
After final review of the constructi?n drawings provided per the "Agreement," the McIntyre Ditch
Company has determined that the initipl design of the ditch is not acceptable.
The McIntyre Ditch Company has agreed to revise the location of the ditch to be located East of that()
^^ foot right-of-way reservation, and has determined that the open ditch with drop structures, as designed,
should be replaced with underground(piping. The applicant will have this portion of the McIntyre Ditch
designed and will pay for the installs on. The applicant has agreed to this request and will coordinate the
construction of the new ditch with the McIntyre Ditch Company.
The ditch relocation is a private utility in a private easement. Construction will begin as soon as the
design has been completed and accepted by the Ditch Company. A copy of the design can be made
available by the Ditch Company to the County upon request.
The undersigned accepts this amend t to the "Agreement for the Relocation and Realignment of a
Portion of the McIntyre Ditch" da d June 11, 2001. This modification and other provisions in the
original Agreement shall constitute the Agreement between the Applicant and the McIntyre Ditch
Company. •

AGREEMENT FOR MERELOCATION AND REALIGNMENT
OF A PORTION OF THE McINTYRE DITCH,
A public hearing was held on October 25,2000 at 10:00 a.m.for the purpose of hearing the application of
Harlen Schultz, do Landmark Engineering Ltd. The application requested a Change of Zone from the
Agricultural Zone District to the Estate Zone District for a parcel of land located in pat of the W1/2 of the
SW I/4 of Section 7,Township 4 North,Range 68 West of the 6th P.M.,Weld County,Colorado. The Weld
County Board of County Commissioners approved this request with conditions. The adopted Resolution
stated the following as one of the conditions of approval:
"The applicant shall enter intio an Improvements Agreement regarding collateral for all onsite
improvements to the Minor Subdivision,and for all offsite improvements proportional to their share
of traffic on Weld County R I as determined by a traffic study-"
It was determined in the public testi ony that the Weld County staff, Larimer County Engineering and
Harlan Schultz, the applicant, would work together to determine the "scope" of the abovementioned
Improvements Agreement regarding o site roadway improvements end collateral. On March 3,2001,3:00
p.m. a meeting was held at Landmark Engineering Ltd.to determine what the"scope"would include. In
attendance were Harlen Schultz,Appli t;Don Schultz,attending with Applicant;Ken Merritt,Karl Matz
and Tiffane Moore, all of Landmark Engineering Ltd.; Drew Scheltinga, Weld County Engineering
Department;and Dale Miller,Larimer County Road and Bridge Department.
It was determined and agreed by those in attendance at the March 3, 2001 meeting,that the applicant's
requirements to meet the Board ofCoMrty Commissioner's Condition of Approval for the proportional share
of offsite improvements to Weld Cou ty Road I would be as follows:
A. The applicant, with he approval of the McIntyre Ditch Company, shall relocate the
McIntyre Ditch so th it lies East of the proposed future 20-foot right-of-way reservation.
B. The applicant must p vide a set of engineered construction drawings to the McIntyre Ditch
Company,Board of ounty Commissioners,and Weld County Planning and Engineering
for the relocation and lignment of the proposed new McIntyre Ditch for their review and
approval.

C. The construction drawings for the relocation and realignment ofthe ditch must be approved
by the McIntyre Ditch Company and Weld County Engineering.
D. Upon approval of the new ditch location and design, the applicant will coordinate the
construction ofthe new ditch with the ditch company. The applicant may begin construction
upon approval of the engineered construction drawings per the following conditions:
1. The applicant will not interfere or disturb the operation of the existing McIntyre
Ditch during construction of the new ditch.
2. The applicant must construct the new ditch so that it lies East of the proposed future
20-foot right-of-way reservation,per the approved construction documents.
3. The applicant must remove the existing trees and stumps located in the existing
McIntyre Ditch,so there are no remaining stumps located in the future road area.
4. The applicant must fill in the existing McIntyre Ditch to the existing grade of Weld
County Road 1.
The intent of this Agreement is to provide documentation describing the Agreement made on March 3,2001
betwep the parties involved in the relocation and realignment of a portion of the McIntyre Ditch located
along the West property line of Lot A and Lot B of Recorded Exemption No. 1061-07-3-RE 2668.
The undersigned accepts the conditions of this Agreement as described:

Final Plat
New Plat Language for Septic Envelopes
During the Planning Commission hearing on January 15, 2002, the applicant's representative
requested that the locations of the proposed primary and secondary septic envelopes be
modified such as the potential buyer of the property is not tied to building on a parcel relative to
the septic envelope location. The Department of Public Health and Environment proposes the
following language to address this issue.
1. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer system.
Sewage disposal shall be by septic systems designed in accordance with the regulations of the
Colorado Department of Public Health and Environment, Water Quality Control Division and the
Weld County Code in effect at the time of construction, repair, replacement, or modification of the
system. The construction documents for this subdivision were prepared by
Project Number and dated . These construction drawings
indicate proposed primary and secondary envelopes for the absorption fields. These envelopes
may be movable, provided the envelopes are of equal or greater area, and meet all required
setbacks. The lot owner shall not place any permanent landscaping, structures, dirt mounds or
other items that would interfere with the construction, maintenance, or function of the fields in the
primary and secondary envelope.
2. Language for the preservation and/or protection of the second absorption field envelope shall be
placed in the development covenants. The covenants shall state that activities such as permanent
landscaping, structures, dirt mounds or other items are expressly prohibited in the absorption field
site.
