ORDINANCE NO. 89-F
IN THE MATTER OF THE REPEAL AND RE-ENACTMENT, WITH AMENDMENTS, AND THE
ADDITION OF CERTAIN SECTIONS OF ORDINANCE NO. 89, WELD COUNTY ZONING
ORDINANCE, REVISING AND ADDING CERTAIN PROCEDURES, TERMS, AND REQUIREMENTS
RELATING TO THE PAYMENT OF FEES TO A STATE AGENCY FOR LAND USE APPLICATIONS
REVIEWS.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO:
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has the power and authority
under the Weld County Home Rule Charter and Article 28 of Title 30, CRS 1973,
to adopt zoning regulations for the unincorporated areas of the County of

WHEREAS, the Board of County Commissioners of Weld County, Colorado,
adopted Ordinance No. 89, Weld County Zoning Ordinance, establishing a
comprehensive revision of the zoning regulations and zoning maps for the
unincorporated areas of the County of Weld, and
WHEREAS, said Ordinance No. 89 is in need of revision and clarification
with regard to procedures, terms, and requirements relating to the payment of
fees to a state agency for land use application reviews.
WHEREAS, on July 1, 1983 the State of Colorado enacted legislation which
requires the payment to certain State agencies for the review of different
land use applications and further that the Board of County Commissioners deems
it appropriate that this additional cost be paid by the individual applicant
and therefore, the Board hereby finds and determines that the necessity of
enacting this Ordinance No. 89-F, in order to accommodate State law,
constitutes an emergency under the provisions of Section 3-14 of the Weld
County Home Rule Charter.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of
Weld County, Colorado, that certain sections of said Ordinance No. 89 are
repealed and re-enacted, with amendments, as follows:
Repeal and Re-enact Section 29 to read:
29 Fees
29. 1 Fees for all Land Use Permit applications provided for in the
Weld County Zoning Ordinance shall be established by resolution
of the Board of County Commissioners in conjunction with a
hearing process that will consist of a ten (10) day public
notice prior to the Board of County Commissioners' hearing.
Notice of said hearing is to be published once in the newspaper
designated by the Board of County Commissioners for publication
of notices.

29.2 Review fees charged by a state agency for the review of any
Land Use applications shall be made payable, by check or money
order, to the State reviewing agency in the amount set by State
law. The fee shall be paid at the time the application is
submitted for consideration by the County. Failure to pay said
fee shall result in the Land Use Application being considered
an incomplete application and will not be assigned a case
number or hearing date until the fee is paid.
BE IT FURTHER ORDAINED THAT AN EMERGENCY EXISTS WHICH REQUIRES THAT THIS
Ordinance No. 89-F is declared an emergency Ordinance under the provisions of
Section 3-14 of the Weld County Home Rule Charter.
The above and foregoing Ordinance was, on motion duly made and seconded,
adopted by the following vote on the 24th day of October ,
