Approved with Conditions
The Weld County Department of Planning Services has determined through administrative review that the
standards of Section 24-8-40.B.1 through 24-8-40.8.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. The applicant has a well as the source of adequate water for Lots A and B. Property owners are
advised that the quality of water available for usage may be limited to specific uses, i.e.,"Domestic Use
Only," etc. Because each situation is unique, the Department of Planning Services encourages
property owners to contact the Office of the State Engineer, Division of Water Resources (1313
Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each
individual situation. The applicant will confirm that two wells exist for the residences. Evidence will
be submitted to the Department of Planning Services.
2. Prior to recording the plat:

aU The applicant shall submit a joint ownership,access and/or operation maintenance agreement
for the shared well. This agreement shall be delineated on the plat and an appropriate
certificate using the language set forth in the Weld County Code, Appendix 24-F.E shall be
/ included. This note is only applicable if evidence is not shown that two wells exist.
✓C. In accordance with Chapter 8, Article 11 of the Weld County Code, Lot B shall be granted one
residential access. Direct access from a public road shall be limited to one access per legal
parcel for residential use,no circle drives or additional accesses shall be granted.The road shall
be graded and drained to provide all weather access. Accesses shall be placed in such a
location as to have adequate sight distance in both directions, shall not be placed below the
crest of a hill or where physical obstructions are present and shall be a minimum distance of 75
feet from any intersecting County or State roadway.
/D. Lot A shall use the existing residential access point as no additional accesses shall be granted.
jE. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe (CMP)is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
/F. Pinto Street is within the Green Acres Subdivision. This street is platted with a 60 foot right-of-
way. A total of 30 feet from the centerline of Pinto Street shall be delineated right-of-way on the
plat. This road is maintained by Weld County.
JG. The applicant shall attempt to address the requirements (concerns) of the West Adams Soil
Conservation District, as stated in the referral response received 12/18/01. Evidence of such
shall be submitted in writing to the Weld County Department of Planning Services.
k./H. All commercial vehicles must be parked off site. The applicant is made aware that parking any
commercial vehicles on the property even temporarily without the proper permit may result in
a violation and may require applying for a Use be Special Review permit.
/. The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
J. The following notes shall be placed on the plat:
✓1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.

✓` No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code,shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
12) Any future structures or uses on site must obtain the appropriate zoning and building
permits.

/3) Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
/4) Prior to the release of building permits for any structure exceeding 3,600 square feet,the
applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code.
t/5) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
6) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest,and gravel roads;odor from animal confinement,silage,and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban

setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
3. The applicant shall submit a paper copy of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the paper copy the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty (60)days
from the date of the Board of County Commissioners resolution.The applicant shall be responsible
for paying the recording fee.
4. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

4. The Owner further agrees to furnish the Contractor with a soil test
prepared by a registered Soil Ent,ineer on'the proposed building site prior to
the commencement of construction at Owner's cost and the Owner agrees that the
Contractor will not accept any liability for defects in any structures as a
result of the soil conditions.
5. The Owner, for and inconsideration of the full, complete and faithful
performance of this agreement by the Contractor and the Contractor's payment
of all bills incurred in the construction of the building, agrees to pay on
cause to be paid to the Contractor the sum $FORTY ONE THOUSAND EIGHT IIUNDRia)
PIETY AND MO:100Dollars, ($ /0 .850.00 ), part of which will consist of a
loan witha f endie. institution , which Owner agrees to immediately
apply foriand obtain at his expense, rind in the event that Owner deco not obtain
said loan within thirty. (30) days after the date of this contract, thin contract
shall be null and void and both parties shall he released from further liability
hereunder. The disbursement of funds as tht work progresses will he stipulated
by the lending agent in a separate agreement and the Ovmer agrees that the Con-
tractor shall be permitted to make draws from n tending institution
on its signature alone, and the Owner hereby consents to and approves any dis-
bursement made by the lending institution to the Contractor with-
out requiring; Owner's signature. Any sums due the Contractor for extra work shall
be paid by the Owner at the time said work is authorized and the Contractor shall
not be required to undertake any extra work until the Contractor has been paid
therefor.
6. No chan.ges _in the Specifications or Plans attached hereto shall be made
by the Owner without written order of the Contractor. The amount to be paid by
the Owner or allowed the Contractor shall by virtue of such extras or changes be
agreed in writing by the Owner and Contractor at the time said extra work or
changes are authorized, plus a $25.00 charge for any changes made after the
package goes to the building department. If no price is stated or an allowance
is stated, it is understood price shall be cost of labor, insurance, and mat-
erial plus 15%.

RECORDED EXEMPTION QUESTIONAIRE
1. WATER SUPPLY ,STATEMENT:
a. Both existing residences have seperate domestic wells ,
please see copies of well permits attached to this
application for both 17666 Pinto St. and 17668 Pinto St.
b. No irrigation water is associated with this property.
To the best of our knowledge this parcel historically
has never had irrigation waters associated with it.
Parcel is dryland type crops only.
2. MEANS FOR DISPOSAL OF SEWAGE:
Proposed parcels A and B have existing septic system permitted
by Weld County Health Department. Copies of septic permits for
both residences included in this application.
3 . DESCRIPTION OF USE:
Property is used as residence for the Mulkey family with existing
modular home (proposed Lot A) as accessory to farm. The 13 . 715
acres more or less produces an excellent wheat crop and prevents
erosion of the land. Parcel is nonprime farmland as defined by
Weld County Code. At this time one horse may be kept on site,
property historically has had horses , cattle, chickens and swine
Parcel includes the following structures : Primary residence
built in 1971 is a 4-level home constructed by Vantage Builders
and conveyed to the Mulkey ' s October 1972. Second home/farm
accessory is modular home with detached two car garage permitted
and inspected by Weld County June 1995 . Modular is permanently
attached to a concrete foundation with own well and septic system,
seperate gas and electric meters and storage shed. Additional
structure include 20X32 two stall barn, 48X36 shop/garage with
dirt floor, approximately 20X20 tack shed with attached loafing
shed, small enclosed structure for poultry and small shed for
swine. No oil or gas facilities exist on this parcel . Irrigation
ditch abuts easterly boundary. No other irrigation structures
exist on site.
4 . REASON FOR PROPOSED RECORDED EXEMPTION:
Lot A and B as proposed will each be used as single family rural
residential sites. As Mr. and Mrs. Mulkey are both retired, they
have a sizeable investment in this property including the modular
home with detached garage, seperate well and septic to support
modular. As the modular and utilities including water and sewer
are constructed in a permanent nature for an estimated $100 ,000 . 00 .
The Mulkey's may have misunderstood this accessory residence was
permitted as a temporary use. They question why the building
department during construction allowed all structures to be placed
upon the land on permanent foundations together with the Division
of Water Resources approval to drill seperate well for this
residence.
4. Thus this recorded exemption application is submitted to
bring property into compliance as a permanent residence.
Modular, detached two car garage, horse barn with existing
well and septic on approximately 2 . 1 acres more or less ,
hereinafter known as Lot A, will preserve the sizeable
investment the owner ' s have in second home. The approval
of this recorded exemption will also aid in the Mulkey' s
retirement years .
5. LOCATION, SIZE AND USE OF AREA WHERE PROPOSED NEW LOTS WILL
BE CREATED:
Proposed Lot B, approximately 11. 6 acres more or less will
include existing 4.-level home with seperate well and septic,
garage/shop building, tack shed with loafing shed and small
animal structures. This parcel is used as a personal residence
and will remain the same upon approval of this recorded exemption.
This primary residence is located west of existing driveway and
the 11. 6 acres proposed will encompass the residence wi+h all
outbuildings as listed above. The existing property boundaries
will remain the same on the westerly, southerly, northerly and
easterly boundaries.
Proposed Lot A, approximately 2 . 1 acres more or less will
include existing modular home, detached garage and horse
barn with access directly from Pinto Street. Proposed Lot A,
will be approximately 219 feet (frontage and rearage) by 415
feet deep. Present use will be unchanged as a single family
rural residential site. Parcel will be approximately 30 feet
east of existing driveway, run south from Pinto Street approximately
415 ' to horse barn with proper setbacks , east 219 ' then north
to Pinto Street an estimated 415 ' .
6. NO UNIQUE PHYSICAL CHARACTERISTICS EXIST ON THIS SITE.
7 . SETBACK AND OFFSET REQUIREMENTS :
All existing structures located upon the land at this time
meet minimum setback and offset requirements for the agricultural
zone district.
S . As subject property is a small parcel of nonprime farm land
and only two parcels are requested a conservation easement
on property may not be applicable to this parcel or necessary
as no further splits are likely.
9 . BUILDING ENVELOPE:
This application does not include a request for an additional
building envelope. Parcel has existing structures and no
further residences are requested to be constructed upon the land.
10 . CONSISTENT WITH WELD COUNTY COMPREHENSIVE AND MUNICIPAL PLAN:
This application is consistent with Weld County Comprehensive plan
as this property is nonprime farm land, all dwellings, wells and
septic systems exist and both Lots A and B are compatible with
surround area of small rural residential sites. Subject is
surrounded by Green Acres Subdivision, thus use of the land does

10 . comply with Weld County Codes as the only change is the creation
of two rural residental parcels.
This proposal will not interfere with any municipal plans
or any intergovernmental agreements,
11. COMPATIBLE WITH EXISTING SURROUNDING LAND USE:
As the use of both parcels A and B will go unchanged, sites are
compatible with existing surrounding land uses as small rural
residential sites with one single family home. Both existing
homes are in excellent condition, extremely well cared for
and actually enhance the area surrounding subject properties .
12 . INTENT OF THE DISTRICT:
This proposed Recorded Exemption will have no adverse impact
on the goals to preserve prime farmland, per Weld County Zoning
Ordinance and Comprehensive Plan. This RE will create one new
legal parcel with existing improvements in place. Lots A and B
will comply with the "A" district as to one single family dwelling
per site meeting all setback and offset requirments . This
proposal will cause no hardship on public facilities , roads or
services. Additional domestic water sources or sewage disposal
systems are not required therefore no further draw on natural
resources. The approval of this RE does comply with the intent
of the zone district and surrounding area use and development as
small rural residential sites.
13 . PROPOSALS CONSISTENT WITH EFFICIENT AND ORDERLY DEVELOPEMENT:
As proposed this Recorded Exemption creates one (1) new legal
site with existing dwelling, well and septic in place. Multiple
sites or new building sites are not requested, thus complying
with orderly growth as well as conforming with surrounding properties
and surrounding land use. As parcel is nonprime farm land this
does not impact the Counties prime farmland preservation. This
application is consistent with the goals of Weld County, the zone
district (A) and general welfare of the County, residence surround-
ing subject parcel and nearby municipalities.
This application promotes the welfare of the Mulkey family a long
time Weld County resident as well as the welfare of the community
as the existing structures on Lot A and B are beautiful and well
cared for properties, unlike many surrounding properties.
Flood hazards , land slides , geologic hazards are not a risk or
threat nor is loss due to fire as proposed parcels are not
wooded, are well maintained and controlled by the hard efforts
of the Mulkey family.
Irrigation waters are not associated with this property. As no
additional building site is requested the existing vegetation and
cover will not be interfered with and is in very good condition.
Largely the majority of smaller rural residential sites utilize
the agricultural zoning for horses , 4-H projects, cattle, sheep,
llamas or may house farm help or family all of which help support

13. local farming activities and contribute to small business in
near by cities and towns.
The Mulkey' s respectfully request your approval of this
Recorded Exemption and would appreciate any suggestions
concerning comments as part of the approval or by deed
to restrict junk including vehicles upon the' land in the
event Lot A is sold. Many surrounding properties are eye
sores, as the Mulkey ' s have pride in ownership they hope
this would not occur on Lots A and B in the event of a
sale.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Weld County Recorded Exemption Standards. Our comments and requirements are as follows:
COMMENTS:
Pinto Street is within the Green Acre Subdivision. This street is platted with a 60-foot right-of-way and is maintained
by the County.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present.
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

In consultation with the Natural Resources Conservation Service(NRCS),we have reviewed the above
referenced case and have the following comments,
SOILS/LIMITATIONS: The soil found on this parcel of land is not limited for dwellings with or without
basements. However,the soil is very limited for septic tank absorption fields, shallow excavations, and
drainage. The soil is generally well suited for windbreaks and landscape plantings.
PRIME FARMLANDS: No Prime Farmlands will be taken out of production.
SOIL EROSION POTENTIAL: Surface runoff is slow but erosion hazard due to due to wind is high.
OTHER: If future land use will include grass establishment and grazing, we would recommend that the
new landowner contact the local NRCS office for guidelines on establishing and maintaining the grass and
grazing management. Additionally, the future landscape plan should address the reduction of water use
with the use of Xeriscape. We also recommend that Ron Broda,Weld County Vegetation Management
Specialist be contacted to assist the landowner in developing a weed management plan. Ron can be
contacted at 970-356-4000 x3770.

5) The use of iyround water from this well Is limited to ordinary household purposes inside one single family dwelling,
the watering of domestic animals, and the irrigation of not more than 14,520 square feet (1/3 acre) of home
gardens and lawns.
6) The maxim= pumping rate shall not exceed 15 GPM.
7) The annual amount of ground water to be withdrawn shall not exceed 2.4 acre-foot.
8) Production from this well is restricted to the Lower Arapahoe aquifer which corresponds to the interval between
200 feet and 495 feet below ground surface.
9) The return'low from the use of the well must be through an individual waste water disposal system of the type so
that not less than 2% of the total amount of water withdrawn is returned to the same stream system in which the
well is located.
10) This well shall be not more than 200 feet from the location specified on this permit.
