HomeMy WebLinkAbout20020082.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 7, 2002 TAPE #2002-01 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, January 7, 2002, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Glenn Vaad, Chair Commissioner David E. Long, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Long moved to approve the minutes of the Board of County Commissioners meeting of January 2, 2002, as printed. Commissioner Jerke seconded the motion, and it carried unanimously. ADDITIONS TO AGENDA: There were no additions to the agenda. CONSENT AGENDA: Commissioner Long moved to approve the consent agenda as printed. Commissioner Geile seconded the motion, and it carried unanimously. PUBLIC INPUT: There was no public input. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $492,936.84 Commissioner Geile moved to approve the warrants as presented by Mr. Warden. Commissioner Long seconded the motion, which carried unanimously. 2002-0082 BC0016 NEW BUSINESS: CONSIDER RENEWAL APPLICATION FOR HOTEL AND RESTAURANT LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN-RAFFERTY'S, INC., DBA RAFFERTY'S: Bruce Barker, County Attorney, stated Sheriffs Deputy Rob Otterstatter indicated no concerns with renewal of this license. Commissioner Long moved to approve said application and authorize the Chair to sign. Seconded by Commissioner Geile, the motion carried unanimously. CONSIDER APPLICATION FOR LICENSE TO CONDUCT DANCE OR DANCES FOR 2002 - RAFFERTY'S, INC., DBA RAFFERTY'S: Commissioner Long moved to approve the 2002 Dance License Application for Rafferty's, Inc.,dba Rafferty's. Commissioner Masden seconded the motion,which carried unanimously. CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES- RINE DURAN: Michael Sampson, Assessor's Office, stated the petitioner requested abatements for 1997, 1998, and 1999; however, he recommends denial of the amounts under 1997 and 1998 because the request is past due. He explained State statute only allows petitions for the current year and two years prior. Mr. Sampson stated Rine Duran, petitioner, claims he contacted the Assessor's Office; however, staff has not been able to find written documentation prior to this request. In response to Commissioner Jerke, Mr. Sampson stated this home was originally owned by the petitioner's parents, and it is not clear whether Mr. Duran owned the property during 1997 and 1998. Responding to Chair Geile, Mr. Sampson stated the property consisted of a house, ten acres classified as residential and 20 acres of vacant land which increased the assessment and taxes. He further stated the entire property has been reclassified as residential and adjusted to reflect the location within the flood plain. He clarified the vacant land has not been used for agricultural purposes, so it does not qualify for anything but residential. No public testimony was offered concerning this matter. In response to Chair Geile, Mr. Sampson stated even if there were documentation prior to 1999, the State would still reject the appeal due to current Statute filing requirements. Commissioner Geile moved to approve said petition in part as recommended by staff. Commissioner Jerke seconded the motion, which carried unanimously. CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES - FEATHER RIDGE, LLC: Mr. Sampson gave a brief description of the location of the property. He stated the Assessor's Office was unaware that the Town of Mead had accepted ownership of the tracks, which resulted in a double assessment. Commissioner Jerke moved to approve said petition. Commissioner Long seconded the motion, which carried unanimously. CONSIDER APPOINTMENTS AND REAPPOINTMENT TO BOARD OF TRUSTEES FOR NORTH COLORADO MEDICAL CENTER:Commissioner Celle moved to appoint Robert Hessler and Ronald Clark and reappoint Kay Drake to the Board of Trustees for North Colorado Medical Center. Chair Geile also requested letters of appreciation be sent to Lori Briscoe and Donald Feldhaus. Commissioner Masden seconded the motion, which carried unanimously. PLANNING: CONSIDER CANCELLATION AND RELEASE OF COLLATERAL AND ACCEPT REPLACEMENT COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT#1217- FAITH TABERNACLE CHURCH, C/O DANNY PERDEW: Don Carroll, Department of Public Works, stated$500.00 had been retained to ensure parking lot striping was completed. Mr. Carroll stated he conducted a site investigation in November and confirmed the striping has been completed; however, he cannot speak to the landscaping and irrigation ditch requirements from the Department of Planning Services. Commissioner Masden moved to continue this matter to Wednesday, January 9, 2002, at 9:00 a.m., to receive comment from the Department of Planning Services. The motion, which was seconded by Commissioner Geile, carried unanimously. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
