DATE: 08/12/2002 COLORADO CC: Environmental Health Services has reviewed this proposal for a landscaping materials, yard along with snow plowing, tree service and firewood business. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1 . Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health & Environment, for approval prior to operation. 2. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for the shop building(s). Any existing septic system(s) which is not currently permitted through the Weld County Department of Public Health & Environment will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. 3. The septic system serving the house shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. EXHIBIT 2002-2556 `� 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 6. The facility shall utilize the existing public water supply. 7. A spillage retention berm shall be required around any container with a volume greater than 50 gallons. The volume retained by the spillage berm should be greater that the volume of the largest tank inside the berm. 8. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling. 9. The applicant shall operate in accordance with the approved "waste handling 2 plan". 10.Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. The employees and patrons to the site shall be allowed to use the toilet facilities in the residence. 11.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 12.The compost piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, or pollutant runoff. Runoff from the compost piles shall be confined to the site. 13.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 14.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 15.The site shall be used for storage of equipment, firewood, and landscape material. The City of Greeley Planning Division has administratively reviewed it against the our Comprehensive Plan and Development Code. However, because of time constraints, this request was not reviewed by the City of Greeley Planning Commission. The staff has the following comments: The request is for a home-based business consisting of a combination landscaping equipment and materials yard/snow-plowing service/tree service with firewood storage and RV storage. The business would operate six days a week and employ 15-20 persons who would park on the site. The applicant has approximately 12 tracks plus several other pieces of heavy and accessory equipment used in the business. Additionally, other items would be stored on-site including trees, mulch, wood chips, compost, tree stumps and limbs, and wood pallets. Gasoline and de- icing tanks are also on the property. The site is located east of and adjacent to Weld County Road 33 and one-quarter mile north of Highway 392. The property lies just outside the City of Greeley's Long-Range Expected Growth Area, the area in which community growth is expected in the next 20 years. It is however, within the three-mile area of influence for the City of Greeley and, therefore, within the purview of the City of Greeley. Sheri Lockman August 12, 2002 Page Two The proposed land uses are generally required to be within the commercial and industrial zones inside Greeley. While the subject property is zoned A (Agricultural) in Weld County, many of the surrounding properties are large-lot residential in nature, and there is a large-lot rural subdivision, zoned R-1, immediately to the east. To the north of the subject property is a cornfield, and the applicant has enclosed the western perimeter of the property with a concrete block wall. However, the view of the yard containing the equipment and the landscape materials is quite visible from the adjacent residential property and from Highway 392 to the south, and is very prominent from the County residentially zoned subdivision to the east. An additional concern of the City of Greeley involves the type and amount of traffic accessing the site, both from employees arriving and departing work, and from the day-to-day operation of a landscape/tree trimming/firewood business in an area surrounded by large-lot residential development. The City of Greeley, therefore, has concerns about the impact of this commercial/industrial type use being located immediately adjacent to residential properties and, therefore, recommends its denial. If, however, Weld County should approve the use, the City of Greeley would recommend the following conditions of approval: 1. The site shall comply with all Weld County development standards including setbacks. 2. Adequate buffering of the use to sufficiently screen all materials stored outside on the property shall be put in place, particularly along the south and east property lines. Screening shall be accomplished through the use of a solid fence or wall of sufficient height to fully screen all stored materials or through the use of landscaping providing year-round screening of a sufficient height to fully screen all stored materials or through a combination of fencing, walls, and landscaping. The City of Greeley recommends its Bufferyard "D" be put in place along the south and east property lines. 3. The RV storage, which appears unrelated to the other business, should either be eliminated from the proposal or, at a minimum, be relocated away from the property line, and sufficient screening shall be in place to screen the stored vehicles from view from adjacent properties. 4. All parking spaces/maneuvering areas shall be an all-weather surface. Sheri Lockman August 12, 2002 Page Three 5. USR-1397 1. A building permit shall be obtained prior to the construction of any building. 2. A plan review is required for each building for which a building permit is required. Except for simple pole type structures, plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 1997 UBC, 1998 IMC, 1997 IPC, 1999 NEC and Chapter 29 of the Weld County Code. 4. Except for pole type structures, each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Existing shop buildings will probably be classified as type S-1 storage buildings with an accessory office. The storage buildings must be separated from residential buildings by a minimum of 20 feet or must have walls constructed with one-hour fire resistive construction. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 1997 Uniform Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Our comments and requirements are as follows: COMMENTS: WCR 33 is designated on the Transportation Plan Map as a collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. The average daily traffic count for WCR 33 is 700 to 800 vehicles in a 24-hour period. This location is directly north of State Highway 392, which shows a count of 3,800 vehicles per day. REQUIREMENTS: Access: There is one main access to the residence, shop, and storage area on the south side of the property. This access has been surfaced with recycled material. The access is adequate to accommodate equipment utilizing the facility. The applicant has constructed a brick wall at the set-back to the future right-of-way line. There is adequate sight distance from this driveway location. The employees appear to be using a secondary access on the north side of the property. This access is not being shown on the plot plan. In reviewing the aerial identifying parcels on the county map, this access appears to be on the property to the north of the proposed USR. The applicant shall indicate on the plat the type of right-of-way/easement and whether it is a dedicated, private, or deeded road-tepcovide a secondary.access..to-the parcel. Circulation/Off-Street Parking: There is adequate room for circulation throughout the proposed USR. The off-street parking spaces and access drive shall be surfaced with gravel, asphalt, concrete, or the equivalent. It shall be graded to prevent drainage problems. Storm Water Drainage: The applicant indicated that any water associated with the USR will run on their property to their alfalpha field and be disbursed.
