RE: CHANGE OF ZONE #565 FROM THE R-1 (LOW DENSITY RESIDENTIAL) ZONE
DISTRICT TO THE A(AGRICULTURAL)ZONE DISTRICT-CARL AND PAMELA SCHAAL
A public hearing was conducted on January 30, 2002, at 10:00 a.m., with the following present:
Commissioner Glenn Vaad, Chair

The following business was transacted:
I hereby certify that pursuant to a notice dated January 11, 2002, and duly published January 16,
2002, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request
of Carl and Pamela Schaal for Change of Zone#565 from the R-1 (Low Density Residential)Zone
District to the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this
a matter of record. Monica Mika, Department of Planning Services, presented a brief summary of
the proposal and entered the favorable recommendation of the Planning Commission into the
record as written. She gave a brief description of the location of the site, and stated 11 referral
agencies have reviewed this proposal. Ms. Mika explained all of Section 30 was rezoned in 1963
from Agriculture to R-1 (Residential). She stated this area appears to be incorrectly zoned because
the Residential Zone District requires public water and sewer; however, there is no possibility of
public sewer service at this time. She gave a brief description of the surrounding uses which are
predominantly agricultural in nature. She stated the three existing houses will remain as a Use by
Right and will be accessed from Weld County Road 1. In response to Chair Vaad, Ms. Mika
explained the Department of Public Works has indicated the access will only need to be upgraded
in the event a commercial use is operated on this property. Responding to Commissioner Geile,
Ms. Mika stated there is a violation on the site, which is pending approval of this Resolution. In
response to Commissioner Jerke, Ms. Mika reiterated that if a commercial use begins the access
will need to be upgraded; however, the Department of Public Works did not indicate off-site
improvements along Weld County Road 1 would be required.
(Switched to Tape #2002-03.) Drew Scheltinga clarified if the use becomes Commercial &;id
begins generating traffic, the access will need to be better aligned and the applicant would also
need to address parking issues. He stated he has no concerns with the current proposal.

Carl Schaal, applicant, stated he does not want to create a commercial use, and added a new use
will likely require a Use by Special Review Permit,which would require further review by the Board.
No public testimony was offered concerning this matter. Responding to Commissioner Vaad, Mr.
Schaal stated he has reviewed and agrees with the Conditions of Approval. Regarding the
Violation on the property, Mr. Schaal stated he was storing some items for some friends; however,
the vehicles and miscellaneous debris have been removed.
Commissioner Jerke moved to approve the request of Carl and Pamela Schaal for Change of Zone
#565 from the R-1 (Low Density Residential) Zone District to the A (Agricultural) Zone District,
based on the recommendations of the Planning staff and the Planning Commission, with the
Conditions of Approval as entered into the record. The motion was seconded by Commissioner
Long, and it carried unanimously. There being no further discussion, the hearing was completed
at 10:40 a.m.
This Certification was approved on the 4th day of February 2002.
