HomeMy WebLinkAbout20021054.tiff HEARING CERTIFICATION DOCKET NO. 2002-23 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND SECOND AMENDED USE BY SPECIAL REVIEW PERMIT#1125 FOR AN OPEN-CUT GRAVEL MINING OPERATION,ASPHALT AND CONCRETE BATCH PLANTS, AND A RECYCLING PLANT ALONG WITH A USE PERMITTED BY RIGHT, ACCESSORY USE, OR A USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (STOCKPILING AND RETAIL SALE OF LANDSCAPING MATERIALS) IN THE A(AGRICULTURAL)ZONE DISTRICT-HALL- IRWIN CORPORATION A public hearing was conducted on April 24, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair Commissioner David D. Long, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated April 5, 2002, and duly published April 10, 2002, in the Tri-Town Farmer and Miner and the Greeley Tribune, a public hearing was conducted to consider the request of Hall-Irwin Corporation for a Site Specific Development Plan and Second Amended Use by Special Review Permit#1125 for an open-cut gravel mining operation, asphalt and concrete batch plants, and a recycling plant along with a Use Permitted by Right, Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts (stockpiling and retail sale of landscaping materials) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman gave a brief description of the location of the site and surrounding uses. He stated the applicant is currently operating an open-cut gravel mining operation, asphalt and concrete batch plants, and a recycling plant on the site. He further stated this amendment will allow the applicant to operate a landscaping stockpile and retail sales of landscape materials on three acres of the currently permitted site, and the permit boundaries will not be expanded. Mr. Gathmar stated the existing scale and office will be open for landscape sales, but the applicant intends to bring in a larger modular to replace the office trailer, which will be removed within one week after the Certificate of Occupancy is issued for the new building. In response to Commissioner Geile, Mr. Gathman stated Condition#1.6.3 for screening and berming is required to bring the applicant in compliance with a landscaping requirement from the original permit. 1 J\ 2002-1054 (C, �L� L�l�J PL0043 HEARING CERTIFICATION - HALL-IRWIN CORPORATION (2ND AMENDED USR#1125) PAGE 2 Julie Chester represented the applicant and complimented the various department staff on working with the applicant to help address many of the issues before coming to the Board of Commissioners. Ms. Chester stated the application proposes to replace the existing structure with a larger 14-foot by 70-foot trailer, which will be on a permanent foundation, in compliance with the Flood Plain Standards. She further stated the plan will meet (American Disabilities Act (ADA) paved parking requirements, and the landscaping materials will be stockpiled in areas which are already permitted to stockpile. She stated the stockpiles will not exceed ten to twelve feet in height, and they will also construct a landscape display yard for the benefit of customers. Regarding Condition of Approval#1.B.3, Ms. Chester stated there is a berm in place,and the applicant intends to add landscaping and trees as required by the previous permit. She further stated they are also willing to do an improvements agreement to ensure the work is completed. Ms. Chester confirmed the old trailer will be removed within one week of issuance of the Certificate of Occupancy for the new trailer, and landscaping operations will require two to three employees,with a maximum of ten employees, which will result in some additional truck traffic. In response to Commissioner Masden, Ms. Chester stated the hours of operation are addressed in Development Standard#3 which stated the landscape sales operations shall be from 6:00 a.m. to 6:00 p.m., Monday through Saturday. Responding to Chair Vaad, Ms. Chester stated Weld County Road 27,also known as 83rd Avenue, is north of Weld County Road 64.5 and the proposed circulation will not interfere with the concrete applications. No public testimony was offered concerning this matter. Responding to Chair Vaad, Ms. Chester stated she and the applicant have reviewed and agree with the Conditions of Approval and Development Standards. Commissioner Geile moved to approve the request of Hall-Irwin Corporation for A Site Specific Development Plan and Second Amended Use by Special Review Permit #1125 for an open-cut gravel mining operation, asphalt and concrete batch plants, and a recycling plant along with a Use Permitted by Right, Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts (stockpiling and retail sale of landscaping materials) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Long, and it carried unanimously.
