In the past couple of weeks an issue concerning this USR has come to light that must be
brought to your attention:
The proposed water source for this USR is a cistern. The Board of Health approved a variance
to allow the applicant to obtain a Cistern permit. The Department recommended approval of
the variance. However, our recommendation and the variance were based upon an assumption
that an alternative water supply was not available. Note: The Cistern Rules do not allow for
the issuance of a Cistern permit if an alternative water source is available.
Since the issuance of the Cistern permit, it has come to our attention that the North Weld
i-. County Water District (NWCWD) has a water line that runs in front of the proposed B&B.
The NWCWD has indicated that this property can be served by the water line. Its our
understanding that the cost to obtain NWCWD water is approximately $20,000 to $30,000.
However, had we been aware that NWCWD water was available for use on the property,per
Weld County Code,the Department would have had no choice but to recommend denial for
any proposed variance for a Cistern permit.
Potential options if the USR is approved:
1) Allow the cistern for a period of one-year (term of the permit per WCC).
Following that year the applicant must obtain North Weld County water.
2) Grant a variance and allow the cistern permanently.
3) Do not allow the cistern and require the applicant to obtain North Weld water.
Should the cistern be approved for use, conditions addressing the use and maintenance of the
cistern are already a part of the USR (added following Board of Health approval).
