HomeMy WebLinkAbout20021284.tiff HEARING CERTIFICATION DOCKET NO. 2002-33 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1378 FOR A USE PERMITTED AS A USE BY RIGHT OR ACCESSORY USE IN THE COMMERCIAL ZONE DISTRICT(LAWN CARE COMPANY)IN THE A(AGRICULTURAL) ZONE DISTRICT - DOUGLAS AND KJERSTEN HOBBS A public hearing was conducted on May 15, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair Commissioner David D. Long, Pro-Tern Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Lauren Light Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated April 26, 2002, and duly published May 1, 2002, in the Tri-Town Farmer and Miner and the Greeley Tribune, a public hearing was conducted to consider the request of Douglas and Kjersten Hobbs for a Site Specific Development Plan and Use by Special Review Permit#1378 for a use permitted as a Use by Right or Accessory Use in the Commercial Zone District(lawn care company)in the A(Agricultural)Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Lauren Light, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Light gave a brief description of the location of the site, which is 4.6 acres. She stated the applicant proposes a maximum of five employees, with five light duty trucks. They have modified their application to eliminate composting; all yard materials will be taken off site. Ms. Light stated there is an existing home on the site, and a barn will be constructed for storage of the equipment and materials. Until the barn is completed,the applicant will provide screening. She stated the Town of Frederick has requested the applicant be subject to the road impact fees, which is addressed by Development Standard #10. Ms. Light stated twelve referral agencies reviewed this proposal, three indicated no conflict, six replied with comments which have been addressed in the Conditions of Approval and Development Standards, and three did not respond. She further stated she received three letters of opposition;however,the Conditions of Approval and Development Standards should ensure the concerns are mitigated and that the site remains compatible with the surrounding residential uses. Ms. Light referred to a faxed message from the Town of Frederick, marked Exhibit F, indicating an updated access permit is not needed. She further stated Conditions#1.C,#1.D, and#1,E can be deleted, and Development Standard #3 needs to be modified to add the word "gravel" before the word "asphalt." 1 Odd =/OZ ) , 17 -(e 40 2002-1284 PL1603 HEARING CERTIFICATION - DOUGLAS AND KJERSTEN HOBBS (USR#1378) PAGE 2 No public testimony was offered concerning this matter. In response to Chair Vaad, Kjersten Hobbs, applicant, stated she has reviewed and agrees with the Conditions of Approval and Development Standards, as amended. Don Carroll, Department of Public Works, stated the applicant has met all of the proposed transportation requirements and he has no concerns. Commissioner Geile moved to approve the request of Douglas and Kjersten Hobbs for a Site Specific Development Plan and Use by Special Review Permit#1378 for a use permitted as a Use by Right or Accessory Use in the Commercial Zone District (lawn care company) in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included deleting Conditions #1.C, #1.D, and #1.E, and to amend Development Standard #3 to add the word "gravel" before the word "asphalt." The motion was seconded by Commissioner Long, and it carried unanimously. There being no further discussion, the hearing was completed at 10:15 a.m. This Certification was approved on the 20th day of May 2002.
