HomeMy WebLinkAbout20020647.tiff 339 - RESOLUTION RE: APPROVE MINOR RESUBDIVISION, S #612, FOR VACATION OF A PORTION OF BLUEBELL AVENUE LOCATED IN ETHERTON SUBDIVISION, FILING #2 - DEPARTMENT OF PUBLIC WORKS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Department of Public Works has presented the Board with a request for Minor Resubdivision, S #612, for vacation of the southern 132 feet of Bluebell Avenue, located in Etherton Subdivision, Filing #2, being further described as a parcel of land located in the NE1/4 of Section 16, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado, and WHEREAS, a hearing before the Board was held on the 5th day of December, 2001, at which time the Board deemed it advisable to continue said matter to February 6, 2002, at 9:00 a.m. to allow the Department of Public Works adequate time to re-evaluate some possible layout designs, and WHEREAS, at said hearing on February 6, 2002, the Board deemed it advisable to continue said matter to February 20, 2002, at 9:00 a.m. to allow referral agencies adequate time to review and provide response regarding a revised proposal, and WHEREAS, at said hearing on February 20, 2002, the Board deemed it advisable to continue said matter to March 18, 2002, at 9:00 a.m. to allow additional time to evaluate the requirements of the Union Colony Fire/Rescue Authority, and WHEREAS, Section 24-5-20 of the Weld County Code provides standards for review of said Minor Resubdivision, and at said hearing on March 18, 2002, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24-5-20.E of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24-5-20 of the Weld County Code including specifically: a. Section 24-5-20.A—There is right-of-way shown on an approved plat or map that has not been used co; its intended purpose for the last twenty- one (21) years or since the recording of the approved plat. b. Section 24-5-20.6—The vacation is compatible with the surrounding area and uses, is consistent with the efficient and orderly development, is consistent with Chapter 22 of the Weld County Code, and does not appear to deprive any parcel of adequate access to a public road or street right-of-way. d. Section 24-5-20.D -The vacation of any right-of-way may require the reservation of an easement for public utility or drainage purposes in order to meet the easement requirements of Section 24-7-60. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Weld County Department of Public Works for a Minor Resubdivision, S #612, for the vacation of the southern 132 feet of Bluebell Avenue, located in Etherton Subdivision, Filing #2, on the hereinabove described parcel of land be, and hereby is, granted, with reservation of easements for existing utilities and/or irrigation structures. The Clerk to the Board is directed to record this Resolution and the map required by Section 24-5-20 E.6 upon completion of the following Condition: 1. The installation of two fire hydrants, one at the southern end of Bluebell Avenue and one on the north side of 20th Street, aligned with the entrance to Bluebell Avenue, to be paid for in its entirety by persons or entities other than Weld County, the City of Greeley, or the Union Colony Fire Rescue Authority. I request this petition be forwarded to the Board of County Commissioners with a recommendation for approval. It is my understanding the request is to vacate the southerly 25-50 feet of the road right-of-way for the purposes of inhibiting through traffic from future development south of the existing street right- of-way. The existing roadway averages 26-28 feet in width, and the surface may be characterized as a sand/gravel surface. As is,the roadway selves the adjacent residential area in a satisfactory manner. It is logical to assume future development to the south will occur as a part of a city annexation. I discussed the options available through the development process with the City of Greeley Public Works Department officials and learned that a connection to Bluebell Avenue would be probable. It was clear during my conversations that improvements to Bluebell Avenue could be requested but not required of a future development. It appears apparent that roadway improvements resulting from additional traffic could ultimately become the County's responsibility. Increasing the traffic load on this roadway would change the classification of the road from local residential to a collector. The road cannot functionally or structurally sustain a higher classification. Currently the homes on Bluebell are served by only one access point. The vacation of the road would prevent a bad situation from ever being corrected with continuance of the street. This vacation could possibly impair fire access to the homes located on Lot I and Lot 2. Any building of fences or structures in the vacated property would require installation of residential sprinkler systems in the homes located on Lot 1 and Lot 2. This most likely would never be known to the Fire Authority until it responded and access was blocked. Development to the south is driving this request and does present issues to the current road surface and design. According to the Weld County Code Section 24-5-20 Subsection A-D the vacation is warranted. Section 24-5-20 A- states that the ROW shown on an approved plat has not been used as its intended purpose for twenty-one years since the recording. This plat was recorded in Section 24-5-20.B - 70% of the landowners adjacent to the proposed ROW vacation waive any objection to the vacation by signing a petition. The initial contact was from the surrounding citizens to begin the process. This case will be forwarded to the Board of County Commissions for a hearing at a later date. Section 24-5-20.C - The vacation shall only be permitted when it is compatible with the surrounding area and uses, is consistent with efficient and orderly development, is consistent wit Chapter 22 of this Code and does not deprive any parcel of adequate access to a public road or street ROW. This vacation of ROW will not eliminate any access viability from Bluebell. It will however eliminate future road connectivity with development within the City of Greeley. Section 24-5-20.D - The vacation of ROW may require the reservation of an easement for public utility or drainage purposes in order to meet the easement requirements of Section 24-7- 60. This will need to be done as there is a 15 foot utility easement on all sides of the lots, there is also an existing 5 foot irrigation easement on the west side of the labeled Lot 1. The City was originally sent information on October 31, 2001 and had 1 week to review the request. Of the departments which reviewed the proposal when originally submitted in October, four had serious concerns about the proposal: 1. Union Colony Fire and Rescue Authority indicated the Fire Authority does not support the proposal. Currently the homes on Bluebell are served by only one access point. The vacation of the road would prevent a bad situation from ever being corrected with continuance of the street. This vacation could possibly impair fire access to the homes located on Lot 1 and Lot 2. Any building of fences or structures in the vacated property would required installation of residential sprinkler systems in the homes located on Lot 1 and Lot 2. This most likely would never be known to the Fire Authority until it responded and access was blocked. Development to the south is driving this request and does present issues to the current road surface and design. These issues can be worked through without impeding emergency access and eliminating any chance of a secondary means of emergency access. 2. Public Works indicated this connection should continue south to allow more direct access and would attract little pass through traffic and be a local road. They noted Bluebell Avenue is approximately 1/4 mile (1,320 feet), which is considerably in excess of the City's maximum length for cul-de-sacs (500'). They further noted that it is not likely Bluebell would ever become a collector street. Finally,the Public Works Department is against the vacation of existing Bluebell Avenue. The option to extend and connect the street to some future development to the south should be kept. Water and Sewer noted there is an existing public water line in Bluebell Avenue's right-of-way that services residents along Bluebell Avenue and also ties into a water line from Balsam Village 2"d Filing (west of the site) and is stubbed out to provide for development to the south. By allowing Bluebell Avenue to be vacated as proposed would prevent the City of Greeley Water and Sewer Department access to this line for maintenance. In addition, vacating the right-of- way as proposed may prevent a public sanitary sewer line from being constructed in the future to serve this area without going to great expense and time to obtain easements. 4. Planning indicated the proposal does not comply with the City of Greeley Comprehensive Plan, including policy TR1.6 - Promote street design configurations which foster interconnectivity between subdivisions...in order to move all modes of traffic in more direct routes and limit extraneous travel on collector and arterial streets. Planning also noted the Subdivision Regulations state no dead-end streets shall be permitted except in cases where such streets are designed to connect with future streets on adjacent land... With this information, the Planning Commission met on November 7, 2001, reviewed the proposal, and expressed concern about the proposed vacation and recommended denial unless a mutually agreeable conclusion can be reached by the City, County and neighbors. Planning Commission further suggested the City and County spearhead an East Greeley Neighborhood Study to determine what the best course of action is, not only for this property, but for other similarly affected areas in the vicinity. Does this street vacation make sense for the entire area? At the City's request, a neighborhood meeting was held on November 8, 2001 which was attended by the City, County and 11 or so concerned neighbors. At that meeting, several issues were discussed, including the comments listed above and a course of action which would address the concerns expressed by the Water Department and Fire Department. It was determined the plat would need to be changed, and the Board meeting for December 5, 2001 would need to be continued so the plat could be changed. I called the County Public Works Director and provided him with names and phone numbers of City staff in the Water and Fire Departments so he could contact them and make changes to the plat which would address their concerns. City staff waited for the revised plat. Finally, two weeks before the rescheduled Board meeting, a plat was delivered to the City. Unfortunately, none of the issues brought up by the Water and Fire Departments three months before had been adequately addressed. By waiting until the last minute again, an acrimonious situation has been created by the County Public Works Department where one does not need to exist. Providing further confusion is a Weld County Referral form provided to the City and dated January 30 which indicates, "Please reply by February 20, 2002." Unfortunately, this date is 2 weeks after the Board meeting! Page 3 Board of County Commissioners February 6, 2002 Still more confusion is provided by the proposed vacation in relation to a Resolution unanimously adopted by the Weld County Board of County Commissioners on June 2, 1999, which provided, "Consent to the enforcement by the Western Hills Fire Protection District of the 1997 Uniform Fire Code and Standards, with amendments, within the District's unincorporated portions of Weld County." The requirements put forth by the Fire Department are fully in compliance with the Fire Code and are required because of the proposed vacation. Without the vacation, an adequate turnaround and three fire hydrants would not be required. The bottom line from the City's perspective includes: 1. Fire - Provide an adequate turnaround. Provide three fire hydrants - one at the end of the street, one at the middle, and one at 20`h Street. 2. Public Works - Suggests leaving the street open. 3. Water and Sewer - Provide a 30' wide exclusive water and sewer easement at the site of a proposed 30' utility easement. 4. Planning - Suggest leaving the street open. This issue could have been handled much more smoothly. As proposed, the City is strongly against the vacation. The City of Greeley, including the Planning Commission, Fire Department, Public Works Department, Water and Sewer Department and Planning Department recommends against the proposed vacation of the southern 132' of Bluebell Avenue. Attachment B RESOLUTION RE: CONSENT TO THE ENFORCEMENT BY THE WESTERN HILLS FIRE PROTECTION DISTRICT OF THE 1997 UNIFORM FIRE CODE AND STANDARDS, WITH AMENDMENTS, WITHIN THE DISTRICT'S UNINCORPORATED PORTIONS OF WELD COUNTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Section 32-1-1002(1)(d), C.R.S., provides that a fire code promulgated by a fire district may be enforced in the unincorporated portions of a county only with the consent of the Board of County Commissioners of such county, and WHEREAS, the Western Hills Fire Protection District ("the District") has presented a copy of the District's Board of Directors' December 3, 1998, resolution adopting the 1997 Edition of the Uniform Fire Code and Standards, with certain amendments, within the District's unincorporated portions of Weld County, and WHEREAS, after review, the Board deems it advisable to consent to said enforcement. I request this petition be forwarded to the Board of County Commissioners with a recommendation for approval. It is my understanding the request is to vacate the southerly 25-50 feet of the road right-of-way for the purposes of inhibiting through traffic from future development south of the existing street right- of-way. The existing roadway averages 26-28 feet in width, and the surface may be characterized as a sand/gravel surface. As is,the roadway serves the adjacent residential area in a satisfactory manner. It is logical to assume future development to the south will occur as a part of a city annexation. I discussed the options available through the development process with the City of Greeley Public Works Department officials and learned that a connection to Bluebell Avenue would be probable. It was clear during my conversations that improvements to Bluebell Avenue could be requested but. not required of a future development. It appears apparent that roadway improvements resulting from additional traffic could ultimately become the County's responsibility. Increasing the traffic load on this roadway would change the classification of the road from local residential to a collector. The road cannot functionally or structurally sustain a higher classification. Families are attracted to Bluebell Avenue and purposely purchase the property here because - the semi-rural environment provides a quiet atmosphere, although the bordering development by the City with high density affordable housing is altering that immensely - it provides a somewhat secluded neighborhood with the dead-end dirt road - a dead-end road prevents a high traffic pattern thus enabling such activities as riding our horses on the road, interactive neighborhood play, cross country skiing with our kids, etc. - it provides a very safe location to raise our families - it provides a quality of life that is getting increasingly difficult to find in an ever-expanding community The value and maintaining of our properties is of great concern in that - the aesthetic value of the small acreages will decrease as owners see the opportunity of maintaining these properties and their attractions diminish - the impact of opening the road would change a much sought after way of life thus putting at risk potential sales in the future and the devaluation of these properties - bringing the irrigation water to our properties will present a challenge none of us have experienced before with a potential high traffic pattern and increased visitation to our neighborhood if the road is open There is more than sufficient access for connectivity to the surrounding community: - Birch Avenue, 442 feet from Bluebell Avenue, is already paved and stubbed in for future development south of the new Balsam Village II Subdivision just west of us - 1st Ave (.50 mile to Balsam Ave), Balsam Ave (.25 mile to Birch Ave), Birch Ave. (.35 mile to Cherry Ave), and Cherry Avenue (.40 mile to Hwy. 34) will provide full access running north and south - E. 20th, E. 22nd, and E. 24th Streets provide access running east and west - the new elementary school, which will be located on E. 20th Street, will not only have that access but will also benefit from Cherry Avenue to the west and Hwy. 34 to the east The granting of the petition to vacate the south end of Bluebell Avenue will enable our neighborhood to maintain that which has been established for more than 50 years. We were aware that the east side of Greeley with its high-density , low income housing oh First-Avenue and east was not the most desirable part of town. . . but here in the midst of all that was this tiny rural neighborhood that had what we were looking for. . . a nice brick home, a chicken house, plenty of garden space , irrigation water and a large workshop and we hope to live out our lives right here. Unfortunately, such a solution was not found. The City of Greeley is still concerned about the proposal to close off the southern end of the street. The residents who have initiated the request have indicated the required costs for the installation of water lines and fire hydrants to serve this area are cost prohibitive. Therefore, the easy answer is to deny the requested street vacation. As background, please refer to my letter of February 6, 2002 to the Board of Commissioners and which I'll summarize here. The City Planning Commission, Fire Department, Public Works Department and Planning Department have all recommended against the proposed vacation. Concerns raised include poor connectivity from this neighborhood to other neighborhoods which may develop in the vicinity, as well as to the proposed elementary school east of this site. The Greeley Planning Commission has even suggested an East Greeley master plan jointly pursued by the County and City to address potential impacts of development to areas such as Bluebell or the impacts of proposed street vacations. Unfortunately, the biggest issue at this point seems to be cost. The existing fire protection for this area is less than required by the current Fire Code. If the street was not proposed to be vacated, the Fire Department would not require this area to be brought up to Code. However, the vacation of the street ensures this area would not be compliant with the Fire Code. The vacation would be a trigger event to allow the Fire Department to require compliance with the Fire Code which has been ratified by the Board of County Commissioners. Two issues remain to be decided; one - should the street be vacated at this time. If no, an upgrade to the fire protection in the area is not required. If yes, an upgrade in fire protection is required. If yes, then who will create the special improvement district to fund the improvements,the County or the Fire Authority? The City suggests the County create the SID, since it is a direct result of a street vacation. The people who have requested the vacation and would benefit from the vacation should pay for it, but they aren't willing to do so. The easy answer is to deny the proposed street vacation for Bluebell Avenue. Bluebell stubs into a parcel of land which is not annexed to the City and has no current development plans proposed. I would suggest continued discussions between the City, County and residents of east Greeley to address issues associated not only with Bluebell, but potential development of this area as a whole. A compromise has been reached! The neighbors have agreed to install two fire hydrants. One at the south end of Bluebell Avenue, and one at the entrance to Bluebell Avenue, on the north side of 20t1, Street. Vacating the street and placing two hydrants is not the best situation for the City. Ideally, the street would continue to stub into the property south of the site and afford an access alternative for future development of that parcel. Ideally, the Fire Department would have a total of three hydrants along this stretch of road. However, the City recognizes the southern portion of Bluebell is likely to be vacated, and sought ways to reach a mutually agreeable compromise, which has been achieved. Therefore,the City respectfully requests the County condition the vacation of the southern 132 feet of Bluebell on the addition of two fire hydrants, one at the southern end of Bluebell and one on the north side of 20th Street at the entrance to Bluebell, and that the neighbors pay for the cost to install the two hydrants.
