LOCATION: South of and adjacent to Weld County Road 46.5; east of and adjacent to Weld County Road 43 ACRES: 45.029, more or less PARCEL#: 1055 10 000042 THE DEPARTMENT OF PLANNING SERWOES'STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: THE DEPARTMENT OF PLANNING SERWOES' STAFF APPROVES THIS APPLICATION FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 27-7-30 of the Weld County Code. 2. The request is in conformance with Section 27-7-40.C of the Weld County Code, as follows: a. Section 27-7-40.C.1--That the proposal is consistent with Chapters 19, 22,23,24 and 26 of the Weld County Code. The approved Conditions of Approval will ensure that the twenty standards which are outlined in this section are met. The proposed site is not influenced by an Inter-Governmental Agreement. b. Section 27-7-40.C.2--That the uses which would be allowed in the proposed PUD will conform with the performance standards of the PUD Zone District contained in Article II, Chapter 27 of the Weld County Code. The applicant has met the twenty performance standards as delineated in Section 27-2-10 regarding access,buffering and screening,bulk requirements, circulation, etcetera. The Conditions of Approval and Development Standards ensure compliance with Sections 27-2-20 through 27-2-210 of the Weld County Code. c. Section 27-7-40.C.3 --That the uses which would be permitted will be compatible with the existing or future development of the surrounding area as permitted by the existing zoning, and with the future development as projected by Chapter 22 of the Weld County Code or master plans of affected municipalities. The proposed site does not lie within an Urban PF 633, Latham View Estates PUD,page 1 Growth Area, nor is the applicant proposing an Urban Scale Development. Weld County's Right To Farm has been attached to the Final Plat thus informing any new residents that the area of the surrounding community is agricultural in nature. This proposal is located within the referral boundary of the City of Evans and Town of LaSalle, both have indicated that they find no conflict with their interests.The Department of Planning Services believes that the granting of this PUD Final Plan will have a minimal impact on the surrounding land uses. d. Section 27-7-40.C.4--That adequate water and sewer service will be made available to the site to serve the uses permitted within the proposed PUD in compliance with the performance standards in Article II, Chapter 27 of the Weld County Code. Central Weld County Water District has indicated their ability and willingness to service this application. Sewage disposal will be served by Individual Sewage Disposal Systems(I.S.D.S.). Based on a geo-technical report from Terracon dated July 31, 2000, the site is suitable for conventional septic systems. e. Section 27-7-40.C.5-- That street or highway facilities providing access to the property are adequate in functional classification, width, and structural capacity to meet the traffic requirements of the uses of the proposed PUD Zone District. Development Standards and Conditions of Approval ensure compliance with Chapter 24, Article VII, and Sections 24-9-10 and 24-9-20 of this Code. The Weld County Public Works Department and Department of Planning Services shall require an Improvements Agreement in accordance with Section 27-6-120.6.f of the Weld County Code for improvements to Latham View Estates and all on-site improvements. A finalized Improvements Agreement, (Private Road Maintenance) will be required prior to recording the plat. f. Section 27-7-40.C.6— In the event the street or highway facilties are not adequate, the applicant shall supply information which demonstrates the willingness and financial capacity to upgrade the street or highway facilities in conformance with the Transportation Sections of Chapters 22, 24 and 26, if applicable. g. Section 27-7-40.C.7 -- That there has been compliance with the applicable requirements contained in Chapter 23 of the Weld County Code regarding overlay districts, commercial mineral deposits, and soil conditions on the subject site. The Greeley Weld County Airport, in their referral letter dated May 3, 2002, stated the location of the proposed development is within the Greeley-Weld County Airport's Area of Concern as defined in the Greeley-Weld County Airport Surrounding Land Use Guidelines. Specifically the site is located within the extreme southwest boundary of the Airport's Influence Area and underneath the 7:1 Transitional Surface area. The Airport Authority requests the applicant execute an Avigation Easement, which will protect the interests of Weld County, the City of Greeley, and the Greeley-Weld County Airport Authority in the future from potential nuisance complaints that may be generated by aircraft noise and overflight. This shall be recorded and run concurrently on the properties and be noted in the covenants for this development. The Colorado Division of Wildlife has provided an extensive review of the wildlife and eco- system located at this site. The applicant shall contact Chad Morgan,Colorado Division of Wildlife to address the concerns and recommended mitigation measures proposed by the Division specific to this proposed development. PF 633,Latham View Estates PUD,page 2 h. Section 27-7-40.C.8--/f compatibility exists between the proposed uses and criteria listed in the development guide, and the final plan exactly conforms to the development guide. The proposed PUD Final Plan uses are compatible with the criteria listed in the developmental guide. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral agencies. The Department of Planning Services'Staff recommendation for approval is conditional upon the following: 1. Prior to Recording the PUD Final Plat: A. The Board of County Commissioners shall review and approve the signed and dated Improvements Agreement According to Policy Regarding Collateral for Improvements (Public Road Maintenance)including the form of collateral. The security for the Agreement shall be tendered and accepted by the Board of County Commissioners. (Department of Public Works) B. The Restrictive Covenants for Latham View Estates PUD shall be approved by the Weld County Attorney's Office and be ready for recording in the Office of the Clerk and Recorder. (Department of Planning Services) C. The drainage report calls for drainage improvements and retention ponds that are not reflected in the plans. The application materials indicate a grading plan is included but there is no plan in the set of drawings submitted. The applicant shall submit a Grading Plan. D. The applicant shall submit an digital file of all drawings associated with the Final Plan application. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles,Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). (Department of Planning Services) E. The Plat shall be amended to include the following: 1) The most recent version of Weld County's Right to Farm as listed in Section 22, Appendix 22-E of the Weld County Code. (Department of Planning Services) 2) The requirements of the Utility Board, as delineated in the minutes of the meeting dated May 23, 2002. (Department of Planning Services) 3) The location of the bus pick-up/drop-off location. (Department of Planning Services) 4) The location of the pedestal mailbox. (Department of Planning Services) 5) As indicated in our review of the zoning application,the dimensioning and calls on the final plat is unclear.Weld County Road 43 is designated as a collector roadway and an 80' right-of-way is required. The dedication must be clear on the record plat. The surveyor should be aware of the Colorado State Board of Registration for Professional Engineers an Professional Land Surveyors Policy Statement Number 17 regarding the Depiction of Easements and Rights-of-Way on Subdivision Plats. PF 633, Latham View Estates PUD, page 3 n ^ 6) The road plans call for a concrete apron. The need for this structure is not clear. A paved approach within the right-of-way of Weld County Road 43 from Latham View Drive was requested and is not shown. The concrete apron shall be delineated. G. Written evidence shall be provided to the Department of Planning Services stipulating that the concerns of the Colorado Division of Wildlife have been addressed to their satisfaction. (Department of Planning Services) H. Written evidence shall be provided to the Department of Planning Services stipulating that the concerns of the Weld County Sheriffs office have been addressed to their satisfaction. (Department of Planning Services) 2. The Final Plat is conditional upon the following and that each be placed on the Final Plat as notes prior to recording: A. The Planned Unit Development allows for Estate uses(4 lots)which shall comply with the PUD-Estate Zone District requirements as set forth in Section 23-3-400 of the Weld County Code. The common open space shall be owned and maintained by the homeowners association, in accordance with Section 23-3-500 and 27-2-60 of the Weld County Code. (Department of Planning Services) B. The site shall be developed in accordance with the recommendations contained in the geotechnical report by Terracon dated July 31, 2000. (Colorado Geological Survey) C. Installation of utilities shall comply with Section 24-9-10 of the Weld County Code. (Department of Planning Services) D. Water Service shall be obtained from the Central Weld County Water District. (Department of Public Health and Environment) E. A Weld County Septic Permit is required for each proposed septic system and shall be installed according to the Weld County Individual Sewage Disposal(I.S.D.S.)Regulations. Each septic system shall be designed for site-specific conditions, including, but not limited to maximum seasonal high groundwater, poor soils and shallow bedrock. (Department of Public Health and Environment) F. The applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public health and the Environment, if required. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. (Department of Public Health and Environment) G. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health department, a fugitive dust control plan must be submitted. (Department of Public Health and Environment) H. In accordance with the Regulations of the Colorado Air Quality control Commission any development that disturbs more than five (5) or more acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. (Department of Public Health and Environment) PF 633, Latham View Estates PUD, page 4 If land development creates more that a 25-acre contiguous disturbance,or exceeds six(6) months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. (Department of Public Health and Environment) J. Any signs,including entrance signs,located on the property shall require building permits and shall adhere to Section 23-4-80 of the Weld County Code. These requirements shall apply to all temporary and permanent signs. (Department of Planning Services and Building Inspection) K. Outdoor storage shall be screened from public rights of ways, and adjacent properties. (Department of Planning Services) L. The site shall maintain compliance with the LaSalle Fire Protection District at all times. (Department of Planning Services) M. The surface agreement for mineral rights on the site limits the drilling of oil and gas wells to a specific location and the applicant has agreed that no waivers will be signed that allow drilling of wells in any other location. (Department of Planning Services) N. Landscaping within the intersection sight distance triangle shall be less than 3.5 feet at maturity. (Department of Planning Services, Department of Public Works) O. Proper building permits shall be obtained prior to any construction,remodeling,demolition or excavation. (Department of Building Inspection) P. All foundations, structures and building systems are required to have engineered foundations shall be based on a site-specific geo-technical report performed by a Colorado licensed engineer. Any fill material shall contain no rock or similar irreducible material with a maximum dimension greater than twelve (12) inches. All fills shall be compacted to a minimum of ninety(90)percent of maximum density. Engineering reports shall be supplied for all fill material. (Department of Building Inspection) Q. All structures shall conform to the Section 29-2-20 of the Weld County Code, Article II (1997 Uniform Building Code), Section 29-2-30 of the Weld County Code, Article II (1998 International Mechanical Code),Section 29-2-40 of the Weld County Code,Article II(1999 Electrical Code),29-2-50 of the Weld County Code,Article II(1997 International Plumbing Code) and Section 29-2-10 of the Weld County Code,Article II, Chapter 29(current Weld County Building Ordinance). (Department of Building Inspection) R. All buildings or structures shall maintain distances from the property lines and adjacent structures as outlined in Section 29-3-160 of the Weld County Code. (Department of Building Inspection) S. Complete drawings shall be submitted for review by the LaSalle Fire Protection District. (Department of Building Inspection) T. At the time an application is accepted for a building permit, a plan review will be done. A complete review of the building or structure by the Weld County Building Inspection Department or the LaSalle Fire Protection District may reveal other building issues or areas needing attention. (Department of Building Inspection) U. The site shall maintain compliance at all times with the requirements of the Weld County PF 633,Latham View Estates PUD,page 5 Public Works Department, Weld County Department of Public Health & Environment, and the Weld County Department of Planning Services. (Department of Planning Services) W. Section 27-8-60 of the Weld County Code-Failure to Record a Planned Unit Development Final Plan - If a Final Plan plat has not been recorded within one (1)year of the date of the approval of the PUD Final Plan, or within a date specified by the Board of County Commissioners, the Board may require the landowner to appear before it and present evidence substantiating that the PUD Final Plan has not been abandoned and that the applicant possesses the willingness and ability to record the PUD Final Plan plat. The Board may extend the date for recording the plat. If the Board determines that conditions supporting the original approval of the PUD Final Plan cannot be met, the Board may, after a public hearing, revoke the PUD Final Plan; X. Section 27-8-70 of the Weld County Code - Failure to Commence a Planned Unit Development Final Plan - If no construction has begun or no USE established in the PUD within one (1)year of the date of the approval of the PUD Final Plan, the Board of County Commissioners may require the landowner to appear before the it and present evidence substantiating that the PUD Final Plan has not been abandoned and that the applicant possesses the willingness and ability to continue the PUD. The Board may extend the date for initiation of the PUD construction and shall annually require the applicant to demonstrate that the PUD has not been abandoned. If the Board determines that conditions supporting the original approval of the PUD Final Plan have changed or that the landowner cannot implement the PUD Final Plan,the Board may, after a public hearing, revoke the PUD Final Plan and order the recorded PUD Plan vacated. Y. Section 27-8-80.A of the Weld County Code- Failure to Comply with the PUD Final Plan - The Board of County Commissioners may serve written notice upon such organization or upon the owners or residents of the PUD setting forth that the organization has failed to comply with the PUD Final Plan. Said notice shall include a demand that such deficiencies of maintenance be cured within thirty(30)days thereof. A hearing shall be held by the Board within fifteen (15)days of the issuance of such notice, setting forth the item, date and place of the hearing. The Board may modify the terms of the original notice as to deficiencies and may give an extension of time within which they shall be rectified. Z. Section 27-8-80.B of the Weld County Code -Any PUD Zone District approved in a Final Plan shall be considered as being in compliance with Chapter 24 of the Weld County Code and Section 30-28-101, et seq., CRS. AA. No development activity shall commence, nor shall any building permits be issued on the property until the final plan has been approved and recorded. (Department of Planning Services) 3. Upon completion of 1 and 2 above, the applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'Staff. The plat shall be prepared in accordance with the requirements of Section 27-9-20 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within thirty(30)days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. PF 633, Latham View Estates PUD,page 6 4. Prior to the release of any building permits: A. The applicant shall supply a designated street sign and stop sign at the appropriate location. (Department of Public Works) B. The applicant has signed a cash-in-lieu payment agreement with the Weld County(Gilcrest) RE-1 School District. Todd Hodges, applicant's representative was present. Mr. Ogle stated that Central Weld Water District is the water district and the residents will be on septic systems. There is oil and gas on the property, refer to drawing 6 of 7. La Salle (not Galeton, as was stated) is the Fire Protection District, and is not requiring a fire hydrant. Cody Wooldridge, Central Weld County Water District, said a water line will be brought in off of WCR 43 and was signed off by the fire department. They did not require a hydrant because there is no fire flow available at this time. He also had questions regarding the15 foot front line and perimeter utility easement. It is not indicated that there is an easement. Lots 3 and 4 on the east side do not indicate utility easement. Could this be listed as open space/utility easement to allow for utilities access around back side? Todd Hodges, applicant's representative,was agreeable to this. Mr. Hodges then asked Mr. Wooldridge for further clarification pertaining to the east side? Mr. Wooldridge said that at least 15 feet around the perimeter of Lot 4 would be needed. Only the east side of Lot 3 would need the additional 15 feet, as all other sides and the cul-de-sac provided for easements. Cody Wooldridge, Central Weld County Water District, made a motion to approve the applicant's request with the condition that the preceding utility easement changes be included. On the west side of the road, immediately adjacent to WCR 23, there is an easement for Panhandle Eastern pipeline. There is a hydrant at the corner of WCR 23 and WCR 14 '/z. There will be septic systems, and there is oil and gas just off the property on the western most corner of Lot 1, on tangent with the center line of Blue Sky Drive. Don Magnuson, Cache La Poudre Irrigation Company, expressed a concern with reference to the agreement with Slate Ditch Company. The agreement is not a recorded agreement and he recommended it be recorded so that it shows up in future deeds and insurance for that property, and that the recording number be placed on the map so that it is referenced for people in the future. Kirk Goble, applicant's representative agreed that this was a good idea and had no objections to the request. Doug Melby, Evans Fire Protection District, said there doesn't appear to be a 15 foot easement along the Slate Ditch? Cody Wooldridge, Central Weld County Water District, said he believed what Doug is referring to is an additional 15 feet besides the Slate Ditch easement, so utilities are not encroaching on the ditch company's right-of-way should they need access in the future. Mr. Gobel had no objection to implementing Mr.Wooldridge's suggestion. Don Magnuson, Cache La Poudre Irrigation Company, made a motion to approve the applicant's request, subject to the clarification of the easements along WCR 23; the recording of the agreement with the Slate Ditch; and the addition of a 15 foot easement paralleling the ditch easement on Lot 1. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads,no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within a subdivision are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas,in many cases,will not be equivalent to municipal services. Rural dwellers must,by necessity,be more self-sufficient than urban dwellers. Children are exposed to different hazards in the County than in an urban setting. No noxious, offensive or hazardous trade or activity shall be conducted on any lot. 7. Natural drainage associated with any corrals shall be altered and so maintained that such drainage shall not drain onto adjacent properties or onto Association common areas. 8. Noxious or dangerous or undesirable weeds or animals as defined by Colorado Department or Agriculture or by majority of Association members shall be controlled or eradicated. 9. No outside storage of semi-tractors, semi-trailers, or derelict(junk)vehicles shall be permitted on any lot or roadway or common ground. 10. Not more than four(4)large animals(horses, cattle, or any other similar size animal)may be maintained on any lot. No pigs allowed except domestic pot bellied pigs. 11. Not more than 10 small animals in addition to the four large animals named in item 9 are permitted. Small animals include dogs, cats, rabbits, Chickens, and similar sized animals. GRANT OF AVIGATION EASEMENT. The landowner ["Grantor"], hereby grants and conveys the Greeley - Weld County Airport Authority, ("Grantee"), a municipal corporation within the County of Weld of the State of Colorado, provides that: 1. The Grantor for good and valuable consideration, does hereby grant to the Grantee, its successors and assigns, a perpetual and assignable easement in and over that certain parcel of real property (the "Parcel") more particularly identified and described in Exhibit "A" attached to and made a part of this instrument, and a right-of-way for the free and unrestricted passage and flight of aircraft of the class, size and category as is now or hereinafter may be operationally compatible with the Greeley-Weld County Airport, in, through, across and about the airspace above an imaginary plane, as such plane is defined by Part 77 of the Federal Aviation Regulations, over said Parcel, as described below(the"Airspace"). 2. For the use and benefit of the public, the easement and continuing right to fly, or cause or permit the flight by any and all persons or aircraft, of the class, size and category as is now or hereinafter may be operationally compatible with the Greeley-Weld County Airport, in, through, across or about any portion of the Airspace described above; and b. The easement and right to cause or create, or permit or allow to be caused or created within the Airspace, such noise, dust, turbulence, vibration, illumination, air currents, fumes, exhaust, smoke and all other effects as may be inherent in the proper operation of aircraft, now known or hereafter used for navigation of or flight in air and specifically including the possibility that the noise that the property may, at some point in time, become subject noise in excess of the 65 LDN, maximum acceptable level set by the Federal Department of Housing and Urban Development ; and c. The continuing and perpetual right to clear and keep clear the Airspace of any portions of buildings, structures, or improvements of any and all kinds, and of trees, vegetation, or other objects, including the right to remove or demolish those portions of such buildings, structures, improvements, trees or any other objects which extend into said Airspace and the right to cut to the ground level and remove any trees which extend into the Airspace; and d. The right to mark and light, or cause or require to be marked or lighted, as obstructions to air navigation, any and all buildings, structures, or other improvements, and trees or other objects now upon, or that in the future may be upon, said Parcel, and which extend into the Airspace; and e. The right of ingress to, passage within, and egress from said Parcel, solely for the above stated purposes. 4. Grantor, on behalf of itself, its successors and assigns hereby covenants with the Grantee, Greeley-Weld County Airport, as follows: a. Grantor, its successors and assigns, will not construct, install, permit or allow any building, structure, improvement, tree, or other object on said Parcel, to extend into the Airspace, or to constitute an obstruction to air navigation, or to obstruct or interfere with the use of the easement and right- of-way herein granted; and b. Grantor, its successors and assigns, will not use or permit the use of the Parcel in such a manner as to create electrical or electronic interference with radio communication or radar operation between any installation upon the Greeley-Weld County Airport and any aircraft. 12. All animals must be contained on the owners' lot. Electric and/or conventional fences allowed. 13. No lot as platted shall be subdivided for the purpose of making two or more lots. 14. No storage of campers, boats, or similar recreational or related equipment except such equipment owned by the lot owner shall be permitted on any Latham View Estates lot. 15. No retail business allowed on any lot. No signs or advertising pertaining to any business ma be displayed. 16. Revisions, additions, deletions, to these covenants must be accompanied by signature and date of all Association members. 17. An Avigation Easement for the Greeley/Weld County Airport shall be granted. See attached recorded easement. 5. Location: Property is in the W '/2 SW 1/4 Section 10, Township 4 N., Range 65 W., 6 Principal Meridian, Weld County, Colorado. Project Name: Latham View Estates PUD - Dave Keiser&Mike Sigg, owners Reference: A). Soil Survey of Weld County, Colorado - Southern Part by United States Department of Agriculture, Soil Conservation Service. B). Soil Conservation Service Engineering Field Manual, Chapter 2.- Estimating run-off. Site Conditions: A farm field of 45 acres being converted into a P.U.D. containing four lots for residential homes. The land currently has hay stubble covering the land. All irrigation facilities have been removed from the site. The land has a gentle slope to the NE where current run-off exits the land into the ditch of WCR 46 YZ and proceeds east V2 mile to a lake. Future Use & Conditions: The future use of the land will be for one home on each lot with a garage and possibly a small barn. The lawn of grass is estimated not to exceed one acre and the balance of the lots to remain in hay or natural vegetation. Design Parameters: The following items are fixed by others that apply to this project. A. 5 Yr. Storm frequency for general run-off calculations. B. 100 Yr. Storm frequency for quantity of water required to be retained on the property. C. Land use to be residential. D. Rainfall intensity curves furnished by the Soil Conservation Service. E. Constants, coefficients, charts and equations by Soil Conservation Service. Narrative: The procedure has been to perform a series of tasks in sequence to arrive at values for run-off flow and retainage requirements. Task one was to classify the soils found on the site in accordance with the soils conservation soil maps for the area. Page two Project No. KSIG 2001 Task two involved the classifications of future land uses to curve numbers for hydrologic soil groups and proportioning by weighed values for a combined CN for later use. Also, plotted drainage flow direction and length of flow on contour map. Task three was the use of rainfall intensity curves, CN's, watershed slope and length to establish a time of concentration for the site. Task four applies these various items to determine the peak discharge and quantity needed for the retainage pond. Task five was the completion of two percolation tests in the field at the site of the drainage area. Task six was the calculation of the pond size to hold the needed quantity of run-off water. Task seven involved the check calculation to determine that the required quantity of water will drain from the pond in 24 hours. Task eight was the modification of the contour map to reflect the pond location and elevation and location of the drainage swales to feed water into the pond. Task nine is the writing of the report, transmittal letters and copying portions of SCS Chapter 2 as part of the report. Construction Recommendations: Construct a pond in the NE corner of the property that is 200' by 180' top size and 160'by 140' on the bottom and 8.5' deep. This size pond needs to be 8.3' to hold the needed 238,291. Cubic Feet of water. Side slopes of this pond will be 2.35:1 which is within the stable range for this soil. The drainage swale is needed for the first 600' south of the pond on the east side of the subd. and the first 400' west of the pond on the north side of the subd. This assures the subd. drainage to go the pond and not off the property to the side as it does now. As indicated in our review of the zoning application, the dimensioning and calls on the final plat in unclear. WCR 43 is designated as a collector roadway and an 80' right-of-way is required. The dedication must be clear on the record plat. The surveyor should be aware of the Colorado State Board of Registration for Professional Engineers an Professional Land Surveyors Policy Statement Number 17 regarding the Depiction of Easements and Rights-of-Way on Subdivision Plats. 2. The drainage report calls for drainage improvements and retention ponds that are not reflected in the plans. The application materials indicate a grading plan is included but there is no plan in the set of drawings submitted. 3. The road plans call for a concrete apron. During the review I made a site visit to the parcel. In this letter you will find the Division of Wildlife comments concerning the proposal. The site is located south of and adjacent to Weld County Road 46.5 and east of and adjacent to Weld County Road 43. The grasses that were growing on the site had been mowed, leaving the stalks and bare ground. This creates a short grass ecosystem that is preferred by many ground-nesting birds. Some of these birds include the Western Meadowlark and the Horned Lark, both of which I observed while I was out there. In past trips to the area, I have also observed Red-tail and Swainson's Hawks and observed a Bald Eagle at Lower Latham Reservoir. Lower Latham Reservoir is located to the northeast of the proposed development. Lower Latham provides excellent habitat for many species of waterfowl and shorebirds. The surrounding area is primarily in agricultural use. The short grass with the bare ground makes for desirable nesting habitat for many of the ground-nesting birds. Human activities around these nests can have negative impacts on them. It is recommended that any construction that takes place on the site occurs before April 1 and after August 15 to minimize any impacts that human activity may have on these nests. I did notice that scheduled improvements pretty much fall within this time range. It is recommended that any future construction occur during the same time periods. Constructing a pond will provide new habitat for a variety of waterfowl, shorebirds, herons, amphibians and fish species. We recommend that ponds be constructed to have irregular-shaped shorelines and not simply rectangular or square shaped. Shoreline slopes should be 4H:1 V or 3H:1 V, with some areas of shoreline in each pond having slopes no steeper than 8H:1 V or 10H:1 V. Such shallow areas will allow for establishment of a variety of different types of aquatic vegetation and also invertebrate prey for waterfowl. Such a shoreline coupled with planting a variety of wetland plant species will allow for a variation in wetlands to be established which will have long-term benefits to wildlife, public viewing of wildlife, and an overall increased aesthetic value to this site. With the numbers of waterfowl that are found in the area, it will be very likely that many species of waterfowl and shorebirds will come to visit the pond. This will make a great wildlife viewing area for the homeowners in the area and it will be close to home. We are concerned for the safety of the deer and other wildlife in this area if a fence is erected as some types of fencing can be dangerous and even fatal to deer. Therefore, we recommend that if any fencing is to be used within or around the mitigation site either during or after the project, it should be the type that would allow the free passage of wildlife. Fencing plans should avoid the use of woven wire type fences that will trap or prevent movement of wildlife. The Division prefers the use of% strand fencing with a bottom strand height of 17 inches and a maximum top strand height of 36 inches. Noxious weeds reduce property value and wildlife habitat. Care should be taken to avoid spreading and introducing noxious weeds. Equipment should be cleaned periodically to remove weed seeds even if no weeds are recognized. The area should be promptly revegetated using native species to prevent erosion and invasions by weeds. This applies not only to the homeowners, but also to any of the construction vehicles that come into the area. One of the reasons that people move to areas such as this is to be able to observe wildlife close to home. Most wildlife try to avoid human interaction, but some will come too close for some and can cause problems for homeowners. It is recommended that future homeowners are made aware of nuisance animals that are found in rural areas. Coyotes, raccoons, skunks, and foxes can cause problems for landowners. Raccoons and skunks can get into trash feed for livestock, even in enclosed areas. Coyotes and foxes will eat chickens and other fowl and the skunks will get into the eggs. Also, homeowners should be made aware of the potential problems that coyotes and skunks can cause with dogs and cats. The Division of Wildlife has brochures available to the homeowners that talk about living with wildlife and will also be happy to give suggestions on how to prevent any potential problems. Dogs can cause many problems for wildlife. Being able to see wildlife is one of the benefits to moving to rural areas. If dogs are allowed to run freely, they can deter wildlife from coming to the area and ruin opportunities for others to view the wildlife. Dogs can also add stress to wildlife if they are harassing them on a consistent basis. This can cause wildlife to become sick and even die. It is also illegal to allow dogs to chase and/or harass wildlife. It is recommended that along with requiring dogs to be confined to the owners yard, that a leash covenant be set up to prevent any problems from occurring off of the owners land. Lower Latham Reservoir and Milton Reservoir to the south are excellent staging and nesting areas for a variety of wildlife. Because of this, the area has a lot of waterfowl that moves through the area in the spring and the fall. Many bird watchers and hunters come to this area for that very reason. It is recommended that the homeowners be made aware that during the fall, hunting does take place in the area. Lower Latham has a lot of waterfowl hunting that is done on it and it is possible that the surrounding fields will have goose hunters on them. a (it MEMORANDUM TO: Kim Ogle, WC Planning DATE: May 13, 2002 COLORADO FROM: Pam Smith, W.C. Department of Public Health and Environment CASE NO.: PF-633 NAME: Keiser/Sigg/Latham View Estates The Weld County Department of Public Health and Environment has reviewed this proposal. The applicant proposes a 4 lot PUD on 45 acres. The minimum lot size is 6.2 acres with an overall density of one septic system per 11.25 acres. The application has satisfied Chapter 27 of the Weld County Code in regard to water service. Water is to be provided by the Central Weld County Water District. Evidence of pre-purchased water taps from Central Weld County Water District is provided in the application materials. The application has satisfied Chapter 27 of the Weld County Code in regard to sewer service. Sewer will be provided by individual sewage disposal systems. The minimum proposed lot size of 6.2 acres coupled with the overall density of one system per 11.25 acres meets the current Department policy. The Department recommends approval with the following conditions: 1. Water service shall be obtained from the Central Weld County Water District. 2. A Weld County Septic Permit is required for each proposed septic system and shall be installed according to the Weld County Individual Sewage Disposal System Regulations. Each septic system shall be designed for site-specific conditions,including but not limited to maximum seasonal high groundwater, poor soils, and shallow bedrock. 3. The applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment,if required. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 6. If land development creates more than a 25-acre contiguous disturbance,or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan,submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 7. I have no mention as to whether the entrance for the subdivision will be deeded to the county or maintained by the residents of the subdivision. If it is maintained by the subdivision, there needs to be plans put into effect to maintain the road into perpetuity. This should include a snow removal and maintenance on the road so that emergency vehicles are able to access this minor subdivision under any weather condition. There are two oil well sites listed on the final plat for this minor subdivision. Both of these oil sites should be fenced to exclude small children and tampering. Tampering not only creates a significant danger to the safety, but also environmental damage with extensive litigation and cleanup costs. At the entrance to this minor subdivision off of WCR 43, we would request that a bus stop waiting area be made on the east side of road 43 as well as mailboxes for the housing division if mailboxes are not going to be placed on each one of their respective properties. There should also be signage preferably in graphical design to enable emergency responders to find residences within this minor subdivision. This sign should be placed at the entrance to the subdivision on WCR 43. In addition, all residences within this subdivision should have their address clearly marked as well.
