HomeMy WebLinkAbout20020180.tiff HEARING CERTIFICATION DOCKET NO. 2002-01 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1362 FOR A SINGLE FAMILY DWELLING UNIT, OTHER THAN THOSE PERMITTED UNDER SECTION 23-2-20.A OF THE WELD COUNTY CODE, IN THE A (AGRICULTURAL) ZONE DISTRICT -THEODORE SCHRAGE A public hearing was conducted on January 16, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair Commissioner David E. Long, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Lauren Light Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated December 28, 2001, and duly published January 2, 2002, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Theodore Schrage for a Site Specific Development Plan and Use by Special Review Permit #1362 for a Single Family Dwelling Unit,other than those permitted under Section 23-2-20.A of the Weld County Code, in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney, made this a matter of record. Lauren Light, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Light stated the property is 45 acres in size, and she gave a brief description of the location of the site. She stated the proposed home will be located south of the ditch and will be accessible for wheelchairs to serve the needs of the applicant. Ms. Light gave a brief description of the surrounding uses,and stated the subject property is designated as"Prime," but the size and location of the ditch make it difficult to farm. She further stated 11 referral agencies reviewed this request, three responded with no conflicts,four responded with comments which have been addressed by the Conditions of Approval and Development Standards, and four did not respond. Theodore Schrage, applicant, stated the new home will be totally accessible for wheelchairs. He explained he has fallen several times at his current residence due to two complete knee replacements and arthritis. In response to Commissioner Geile, Mr. Schrage indicated the location of proposed home and two other homes on adjacent parcels which will all share one access from Weld County Road 3. He also indicated the location of existing home. Responding to Commissioner Jerke, Mr. Schrage stated the new home will be stick built with brick trim. In response to Commissioner Masden, Mr. Schrage stated the property is 45 acres, and he indicated location of ditch, which is concrete lined. 2002-0180 ee LL /)/(-) PL1576 HEARING CERTIFICATION - THEODORE SCHRAGE (USR#1362) PAGE 2 No public testimony was offered concerning this matter. Responding to Commissioner Vaad, Mr. Schrage stated he has reviewed and agrees with the Conditions of Approval and Development Standards. In response to CommissionerJerke, Ms. Light stated approval of this request will result in two homes on one 45-acre parcel. She further stated the proposed house will be accessed from Weld County Road 3, and the existing house is accessed from Highway 60. Responding to Commissioner Masden, Ms. Light stated at the Planning Commission hearing the applicant indicated he intends to rent the existing home. Commissioner Geile moved to approve the request of Theodore Schrage for a Site Specific Development Plan and Use by Special Review Permit #1362 for a Single Family Dwelling Unit, other than those permitted under Section 23-2-20.A of the Weld County Code, in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Masden, and it carried unanimously. There being no further discussion, the hearing was completed at 10:15 a.m. This Certification was approved on the 21st day of January 2002.
