L> V Ls-L) October 4, 2002 Weld County Department Of Planning Services 1555 N. 17th Avenue Greeley, Colorado 80631 Re: Case Number USR-1401, Raymond and Dorthula Lohr, To Whom It May Concern; This letter will serve as our notice to the Weld County Planning Commission and Staff that we are opposed to the zone change requested by the applicants noted above. We purchased our rural acreage directly east across County Road 51 from the subject property three years ago and are currently in the process of building our new home on that property. We have a full view of the farmstead proposed for a zone change from Agriculture to Industrial use with only the county road separating our properties. We believe that the negative impact of this "portable restroom business" is to great for this agriculture/ rural residential area. This type of business most certainly belongs in an industrial location with other compatible business'. There are several alternative sites a few miles west along the U.S. Highway 85 Corridor, of which the distance difference would not be a deterrent to the success of the business. If this business is allowed to operate at this proposed location, the value of our property would most certainly be negatively affected. I have spent a lot of time and money for my house and property at 32776 Vista Lake Rd. and I feel it is inappropriate for this type of business to be located here as this could affect our property values. We liked that about this area and wanted to keep it zoned as such to keep the area beautiful and scenic. We feel that industrial businesses need to be kept in areas zoned as such. Industrial businesses have more traffic and other offensive problems. Please leave this area-zoned agriculture for the benefit of its residents. Water service is presently being provided to the above-described property through meter#540(40). North Weld County Water District is able to supply additional service estimated to be an additional 300 gallons per day through the existing meter. Water tap/service shall be placed on the physical property, defined by a legal description. In case of a Recorded Exemption,the water tap shall only serve the parcel that the water tap is located on. Service shall NOT cross the legal description of one parcel to serve the other parcel. The District recommends that anticipated water usage be purchased through the District. The District guarantees treatment and delivery of water purchased. All water that is delivered with surcharge is subject to water availability and will be issued on a first come-first serve basis and is not guaranteed to be available. Meter# 540(40)has one Acre-Foot Unit(1 AFU)attached to it. With 1 MU purchased any usage beyond 228,000 gallons annually will be in surcharge. The Plant Investment Fee purchased with this meter has paid for the infrastructure required to deliver 1 AFU (228,000 gallons),but the District grandfathered the Plant Investments based on 1998s annual usage which for meter#540(40)was 3 MU or 684,000 gallons. If annual usage exceeds the 684,000 gallons, an additional charge will be applied to your account. Plant Investments may be purchased to increase the amount of water to be delivered and avoid the additional charge(s). I have spent a substantial amount of money building my residence at 32828 Vista Lake Road. I feel that I have increased the property values in the surrounding area. I think that it would be inappropriate to rezone the property in question for industrial use, as it will decrease the property values in this area. There are areas that are zoned industrial that would be more appropriate for this type of business. It would be irresponsible planning to allow this to happen. There seem to be properties already zoned industrial that would be available to handle this type of business.
