COLORADO FROM: Charlotte Dais, Environmental Health Services SUBJECT: USR-1365 Alvin Garcia/Annabelle Canzona Environmental Health Services has reviewed this proposal for a restaurant including drive-in restaurant. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as development standards: ' 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. • 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. This facility shall adhere to the maximum permissible noise levels allowed in the (Residential) Zone as delineated in 25-12-103 C.R.S., as amended. 5. Our comments and requirements are as follows: COMMENTS: /25T" Avenue is designated on the Transportation Plan Map as a paved road, which requires a 60- foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. There is paved parking which borders all the lots adjacent to 25th Avenue in the Espanola subdivision. This area has been utilized for parking. 25`h Avenue is a paved County Road measuring 24 feet in width. The paved parking was extended 20 feet in width, with a slight drainage swale, as most homes at this location do not have driveways or garages. REQUIREMENTS: Off-Street Parking: The applicant is indicating that there will be approximately two to five people utilizing the facility at one time. I would recommend that the applicant design a 45-degree angle parking configuration to accommodate 5 spaces. Utilize County Code Section 23, appendix 23-A, Design Requirements for Off-Street Parking. The residential occupancy must be separated from the mercantile occupancy by one-hour fire resistive construction. 2. Exterior walls in the mercantile occupancy that are less than 20 feet from a property line must be built of one-hour fire resistive construction. 3. Openings in the mercantile occupancy that are less than 10 feet from a property line must be protected by at least a three-fourths-hour fire- resistive assembly. Openings are not permitted less than 5 feet from the property line. 4. The commercial kitchen exhaust hood shall be designed for the type of cooking appliance that it serves and shall be installed per the 1998 International Mechanical Code. Parking on 25th Avenue is already congested along the section where the proposed parking is. Additionally, this is an area that has been congested by residences and small homes. The additional vehicle and pedestrian traffic into this area would help to further congest it. This proposal makes no mention of light and from the diagram it appears that individuals would have to walk beside the house and the wooden fence adjacent to it to get to the kitchen. No lighting is described in the plan. There is no mention of trash receptacles being placed around in case individuals did discard garbage or food containers on their way from the residence's kitchen. Additionally, their is only mention of a dumpster if necessary. There is no mention of the quantity of food to be prepared in this kitchen so there is no way to know how much refuge will be made. Dear Chris, The City of Greeley Planning Department reviewed the above-referenced case administratively and finds that the proposal does not comply with the Greeley 2020 Comprehensive Plan and recommends that the request is denied for the following reasons: • The City of Greeley Development Code would require landscaping/buffering from dissimilar uses adjacent to as well as on the site. The applicants are proposing no landscaping to buffer from adjacent residential uses. The Code requires that landscaping, screen walls, berms, placement of the use, or other site design techniques shall be used to screen cars waiting in the drive-thru,drive-in, or drive-up aisles from the public right-of-way and shall be used to minimize the visual impact of drive-thru, drive-in, or drive-up aisles, menu boards and directional signs. The proposal does not show any increase in landscaping or screening from the right-of-way. • The City of Greeley Development Code states that no drive-thru,drive-in,or drive-up aisles shall exit directly onto, or gain direct access from a public right-of-way, except when approved by both the Public Works and Community Development Departments. • The City of Greeley Development Code states that parking spaces shall not be located in the front setback of any development. For purposes here, the setback would be the average distance between the property line and the front of the houses that are on the block face along North 25th Avenue. • The City of Greeley requires any commercial or residential development to have paved driveways, parking areas, and access points with an all-weather surface, which are not proposed for this development. • The City of Greeley Development Code requires that any home-based business acquire a home occupation permit. Home occupation permits are granted for limited business uses within dwellings when such uses will clearly not alter the character or appearance of the residential environment. The establishment of a commercial use in conjunction with a residential use would not meet the review criteria for permitted home occupations. Contact Doris Biehl (350-9810) for additional information. A grease trap interceptor is also required to be installed for any commercial kitchen. The interceptor will need to be sized per the Uniform Plumbing Code. If the development was to be approved, City staff would recommend the inclusion of heavy landscaping to minimize the negative impacts on the residential properties that surround the site. This would include the minimization of exterior lighting and outdoor storage of materials used in the construction or repair of metal containers.
