RE: ACCEPT AMENDED STATEMENT OF PURPOSE - BOXELDER SANITATION
DISTRICT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amended Statement of Purpose
filed by the Boxelder Sanitation District, pursuant to Sections 32-1-207 and 208, C.R.S.,
indicating the provision of service within portions of Weld County, and
WHEREAS, after review, the Board deems it advisable to accept said amended
Statement of Purpose, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Amended Statement of Purpose presented by the Boxelder
Sanitation District pursuant to Sections 32-1-207 and 208, C.R.S., indicating the provision of
service within portions of Weld County be, and hereby is, accepted for filing.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 20th day of November, A.D., 2002.

SUBJECT: Box Elder Sanitation District Amended Statement of
COLORADO Purpose
The Box Elder Sanitation District was organized and has existed in Larimer County since March 31, 1965.
Property has been annexed into the District which lies within Weld County. The area included in Weld
County at this time is one mile from the County line in an area roughly between Black Hollow and New
Windsor Reservoirs. Two years ago, the District asked for recognition of its ability to serve within Weld
County. The Board directed this office to obtain an Amended Statement of Purpose prior to the District
being regarded as authorized to provide public sewer within areas of Weld County. The District filed
materials which, after consultation with Weld County Depai talent of Public Health and Environment, were
determined to be inadequate to constitute an Amended Statement of Purpose. The principal deficiency was
that the District was not properly qualified to serve Weld County under State law since they had not received
recognition within the Larimer/Weld Water Quality Management Plan ( 208 Plan) to serve areas within
Weld County. The District has now provided evidence of its recognition under the 208 Plan and the
Amended Statement of Purpose appears to otherwise be adequate.
Special Districts formed since May 1, 1965 have been subject to the requirement of a service plan approval.
Districts formed without a service plan approval, such as Boxelder, are subject to a requirement of filing of a
Statement of Purpose which does not require a hearing before the Board of County Commissioners.
No formal action is required by the Board except to accept for filing an Amended Statement of Purpose
including the revised map from the Larimer/Weld 208 Plan. The effect of this would be to allow Box Elder
Sanitation District to be considered a public sewer system in the course of evaluating any future land use
proposals within the area recognized in the 208 Plan.

Dear Mr. Morrison:
Please find enclosed the Boxelder Sanitation District Amended Statement of Purpose in
response to your letter of May 26, 2000 and in accordance with C.R.S. Section 32-1-
207. I expect this Statement of Purpose will satisfy the requirements of C.R.S. 32-1-207,
32-1-204.5 and 32-1-208.
I believe this to be required by Weld County since the District has a "material
modification" of its service plan caused by a property located in Weld County being
petitioned into the District. The District has previously existed and operated solely within
Larimer County and has not had any petitioned lands from Weld County.
Also enclosed is the District's position paper on wastewater service area definition, vis-à-
vis the Clean Water Act 208 plans, which governs the District responses to property
owners requesting service.

STATEMENT OF PURPOSE
June, 2000
This Statement of Purpose has been prepared and is being filed pursuant to
C.R.S. Section 32-1-208. Boxelder Sanitation District, hereinafter referred to as
"the District," is a special district and a political subdivision of the State of
Colorado established under Title 32 of the Colorado Revised Statutes.
I. Purpose for which the District was organized.
The District was organized for the purpose of providing wastewater service for
domestic and other private and public purposes. A petition to create the District
was filed after an election was held within the proposed district on March 23,
1965, with resulting votes of 14 for and 0 against. The Order and Decree of the
District Court for the 8th Judicial District creating the District was entered on
March 31, 1965. The District was organized for the purpose of providing services
and facilities both within and without the boundaries of the District and to
establish fees, rates, tolls, penalties, or charges for such services and facilities.
II. Services and Facilities to be Provided by the District.
The District's office is located at 2217 Airway Ave, #3, Fort Collins. At present,
the District provides wastewater services to approximately 7,106 people.
Wastewater is collected through District collection system that is nearly 35 miles
long. In addition, the District operates two wastewater pumping stations to serve
specific locations within the collection system.
The District owns and operates a wastewater treatment plant located at 2705 S.
W. Frontage Road, Fort Collins, Colorado.
The treatment facilities consist of a control building, a four-cell aerated lagoon,
chlorination and dechlorination facilities. The control building houses controls,
flow monitoring equipment, lift pumps, and a backup power supply generator.
The design capacity of the treatment plant is 2.34 million gallons per day for
hydraulic flow and 3,200 pounds BOD5 per day organic loading. The average
household is thought to contribute about 250 gallons per day and 0.63 pounds of
BOD5 per day. A laboratory for analyzing influent and effluent wastewater

characteristics and those of the receiving stream is located in an office building at
the plant site. An alarm system located at the DistricYs plant alerts the plant
operator and other District personnel of any problems or malfunctions.
III. Areas served or to be Served bv the District
At present, the lands petitioned into the District encompass approximately 16
square miles located east and north of the City of Fort Collins, Colorado. Said
lands lie in Larimer and Weld Counties.
Presently, the lands petitioned into the District consist of a wide variety of
property types including mobile home parks, motels, restaurants, office buildings,
residential developments, industrials and agricultural properties.
Due to its proximity to the City of Fort Collins, Towns of Timnath and Wellington
and their designated urban growth areas, the District is experiencing growth.
The District has received applications for several new commercial and residential
developments.
It is anticipated that in the long term (greater than fifty year planning horizon) the
District will eventually be required to serve additional lands within the Poudre,
Cooper Slough, and Boxelder drainages, for a total area of approximately 45,000
acres, the majority of which is presently undeveloped and consists primarily of
agricultural property. The long-term planning area for Boxelder Sanitation
District, as identified in Larimer and Weld Counties, is shown in Exhibit A.
The District provides services tolintends to provide service not only to properties
already petitioned into the District, but also areas contiguous to the District and
possibly outlying areas. Provision of such service will be either by inclusion of
said property within the District or by providing such services through a written
agreement.
Boxelder Sanitation District provides wastewater services and facilities and
intends to continue to provide the same in the manner and to the extent
authorized by Colorado law as may be amended from time to time by the District.
Furthermore, those areas which are served by the District are those areas
authorized by Colorado law as may be amended from time to time.

SERVICE AREA DEFINITION
FOR WASTEWATER RECLAMATION SERVICE PROVIDERS
The question of service area definition, or the delineation of present day geographical
limits of areas to be serviced by Publicly Owned Treatment Works (P.O.T.W.) in the
future, is the focus of this paper.
The appropriate answer to the service area definition question for a given service
provider is not appropriately a matter of political concem. Rather, it is properly decided
unilaterally by each operating entity, but in concert with the proximate users, or future
users of its service system.
The service area in not an arbitrary map-making function. It is essentially determined by
the P.O.T.W. in consideration of several controlling elements as follows:
1. Plant Caaacitv and Desian:
Consideration must be given to the hydraulic and organic loading capacity
of the treatment works to accept the flows from the combined existing and
future service area users, and to some extent the hydraulic design of the
collector system to be expanded or utilized.
2. Leaal and Contractual Liabilities of the P.O.T.W.:
Consideration must be given to existing long term commitments to serve
petitioned lands, or in-place contractual commitments to serve areas.
These elements will control the definition of service areas, both existing
and future. Bond covenants also impact and contribute to the definition of
service area by each service provider.
3. Financial and Business Manapement Oblipations:
Consideration must be given to the fact that P.O.T.W.'s are mandated for
perpetual operational existence, and the concurrent assumed least costly
service to the user base. These two most important elements direct that
100% utilization of capital investments is an ongoing obligation of
P.O.T.W. management. This is best accomptished by planned,
incremental expansion of the service area to match utilization with overall
plant design.

4. User/Applicant Petitioning and Choice:
Where two comparable service providers are in proximity to an applicant
property, and the property owner wishes to obtain service, the extension
of the service area of either service provider should be the choice of the
aoalicant and most probably would be decided based on the relative cost
of such service, including collector line extensions.
Since there exists within state and federal law a multitude of regulatory directives which
must be followed by P.O.T.W,'s, these will, of course, be the dominant control elements
when a goveming entity considers its service area definition. If the four elements listed
above are accepted as incumbent upon all service providers (especially the least cost
mandate) then there should be no need to arbitrate service area boundaries when they
approach contiguity. Rather, if the policy of least cost public service prevails, then well
engineered, joint-use facilities, financed through interagency agreements, should be
utilized to serve properties on or near contiguous agency boundaries; and, thus,

Re: Recognition of Boxelder Sanitation District to operate in Weld County
Dear Mr. Morrison:
This is a rather delayed follow-up to your letter of 14 November 2000 regarding the district's
desires to be declared as an entity that can operate and provide sanitary sewer service to
properties in Weld County.
The Boxelder Sanitation District, a special district of the State of Colorado, is the
wastewater service provider in eastem Larimer County and has received many requests
for service from property owners in Weld County. At least three property owners in Weld
County have already petitioned land into the District.
On 29 November 2001, the North Front Range Water Quality Planning Association adopted an
amended Water Quality Management Plan for the Larimer-Weld region of the state. Included in
the updated plan is the long-term water quality planning area for Boxelder Sanitation District. A
copy of this area, which inGudes lands in Larimer and Weld counties, is enclosed.
I hope this change in the "208 plan" satisfies the issue raised in your 14 November 2000 letter
and allows you to recommend to the Weld County Commissioners that Boxelder Sanitation
District be recognized as a sanitary sewer service provider in Weld County.

Purpose
Dear Mr. Smith:
Thank you for your response to the request for an Amended Statement of Purpose regarding service within
Weld County. With one major exception,the information has satisfied the request. However,before I can
recommend to the Board of County Commissioners acceptance of the Amended Statement of Purpose as
complete,further information regazding compliance with the area wide waste treatment management plan
for Laruner and Weld County(208)plan is needed.
It is my understanding of the 208 process that service to an azea may not be provided unless and until an
entity is recognized as an operating agency for that azea under the 208 plan and any necessary amendments
to the 208 plan have been approved by the state. Trevor Jiricek of the Weld County health Department has
spoken with Dave Dubois at North Front Range Water Quality Management Agency who has indicated that
there have been no steps taken through his agency to obtain designation for your District as a operating
entity in any portion of Weld Counry. Your District needs to demonstrate the legal authoriry to operate in
an azea in addition to establishing form an engineering standpoint,the ability to serve. I am not suggesting
that the County has taken a position for or against your District operating in Weld County under the 208
plan at this time. I am recommending that the County not recognize your District as available to provide
service in Weld County unless and until you are formally recognized in the 208 planning process.

Enclosed is the district's update of its 208 plan.
We have already solicited review and comments from adjacent municipalities (Town of Windsor,
Town of Wellington, City of Ft. Collins). We have received word from Windsor, expressing
agreement on our shared boundary (letter attached). City of Ft. Collins and Town of Wellington
have not offered comments in response to our query of June 2001. However, both entities
provided verbal approval to our mutual boundaries in meetings during December 2000.
I wish to aver that the Boxelder Sanitation DistricYs 208 submittal is not subject to changes by
the NFRWQPA or individual third parties.
Boxelder Sanitation District has elected to submit an entirely new narrative format, rather than a
"corrected 1999" - 208 Submittal, as a result of our updated master plan.
The District is hopeful that the NFRWQPA's 208 plan update can be completed during the third
quarter of 2001. If not, the District requests that a plan amendment be processed prior to
September31, 2001.

Boxelder Sanitation District
Since 1965, this special district has served an area generally east of the City of
Fort Collins along the east side of LeMay Avenue and east of the Cache La
Poudre River. Currently, the existing Boxelder Sanitation District treatment plant
is located alongside the confluence of Boxelder Creek and the Cache La Poudre
River. This existing treatment plant will be utilized to serve a much farger area
than in the past.
The larger service area will extend north to within a mile of the Town of
Wellington's existing service area generally along CR 58 to the easternmost area
and CR 60 on the west toward the foothills. The Boxelder Sanitation District
service area will border, generally, the Cherry Hills Sanitation District and the City
of Fort Collins on the west. On the east, the District service area extends into
Weld County where there is not another service entity. On the south, the
anticipated area to be served extends to CR 34 and generally is expected to
approach both the Town of Windsor and South Fort Collins Sanitation District
areas of interest.
Through formal and informal arrangements, it is expected that there will be some
consideration given to cooperative planning with possibly both the City of
Windsor and the South Fort Collins Sanitation District on the south and with the
Town of Wellington on the north to determine the most economical and expedient
manner to serve properties of interest. The District will continue cooperation with
other wastewater treatment entities.
The District Board of Directors has determined that planning for a second
treatment facility (WWTP), near the southem portion of the area the District has
committed to serve, should proceed. Planning will include land control, site
application submittals, and preliminary engineering in accordance with existing
regulation and statutes applicable to the approval process. This facility would be
located so that it can provide wastewater treatment to properties in the vicinity of
Harmony Road and the east side of I-25, in accordance with the DistricYs Utility
Plan.
The DistricYs Utility Plan was revised in 2001 to include a description of the
existing treatment facility, anticipated upgrades and improvements, which will be
done over the planning period. It also reaffirms the intention of the District to
proceed with the process of review and approval of the WWTP #2 facility within
the next two years. The Utility Plan also considers the possibility of reuse of
treated wastewater for landscape irrigation.

Service Area Map: The NFRWQPA water quality planning area for Boxelder
Sanitation District is designated as shown in the accompanying map, with lands
in Larimer and Weld counties. it should be noted that this map is substantially
consistent with the language approved by NFRWQPA in the 1999 Water Quality
Management Plan.
As a resuit of Board actions, the District has the following projects planned:
1. Wastewater Pumping Stations: Wastewater pumping stations and
accompanying pressure sewer systems may be constructed in the
following loca6ons:
a. In the proximity of Section 24, Township 7N, Range 68W, to serve
properties in the Timnath Reservoir watershed.
b. In the SE 1/4, Section 8, Township 7N, Range 68W, to serve
properties between Lake Canal and State Hwy 14.
c. In the NE '/., Section 2, Township 6N, Range 68W, to serve a set of
properties in the vicinity of Larimer County Rd. 3 and Harmony
Road.
d. In the area east of Interstate 25 and west of Larimer County Road
5, south of the Poudre River near its I-25 bridge, and north of
Larimer County Road 34.
e. In the area to the west of the Poudre River, north of Horsetooth
Road, and east of Larimer County Road 9.
Additionally, the existing wastewater pumping station at CDOT is to be
enhanced for a larger hydraulic capacity. Other pumping stations may be
needed at locations not readily served by graviry sewer.
2. Treatment Plant Expansion: There will be an enhancement of the existing
wastewater treatment facility located in Section 22, Township 7N, Range
68W. This potentially includes, among other things, an experimental
constructed wetlands treatment system, an additional chlonne contact
basin, a reworking of the influent works, additional aeration capability for
the existing lagoons, a modification of the treatment process to treat
wastewater for ammonia, nutrients and other pollutants--along with
treatment for BOD, TSS and conventional pollutants--in anticipation of
possibly more restrictive water quality regulations. Work on the
enhancement of the electrical infrastructure at the plant, modification of
the effluent structures and monitoring devices, potential removal of
wastewater sludge from the lagoons, and construction of a maintenance
building will be completed in the short term.
3. Collection System Enhancement: A study of the collection system and
identification of potential sites of infiltration and inflow has been carried
out. The District intends to build on this database a program for reduction,

and possible elimination, of much of the infiltration/inflow for various
segments of the collection system. This may include replacement and/or
repairs to various segments of the collection system and installation of
alternative collection systems (e.g., vacuum systems) in hard to serve
areas. Major new collectors are anticipated to be put into place to serve
the existing plant. These include:
a. Boxelder Interceptor extension (to serve East Basin)
b. Poudre Interceptor extension (to serve West Basin)
c. Cooper Slough Interceptor extension (to serve West Basin)
d. Prospect Collector (to serve East Basin and Timnath Lake Basin)
e. Timnath Lake interceptor (to serve Timnath Lake Basin)
In addition, collectors wouid be instalied for the proposed (new) treatment
plant, to serve the New Timnath Basin, the Poudre Riparian Basin, and to
serve as relievers to the CDOT Lift Station Basin. Force main
replacement and/or expansions are also contemplated for some of the
existing wastewater pumping stations.
4. New treatment plant: The District intends to exercise its option of siting a
new wastewater treatment plant and obtaining an NPDES permit for a
fac�lity which could potentially serve the following areas: Properties in the
vicinity of Harmony Road and on the east side of I-25, on the basis of
landowner petitions for inclusion into the District; and an area bounded on
the south by (extended) Larimer County Road 34, and west by I-25,
extending north to State Highway 14 and generally east to Weld County
Road 19, as depicted in the accompanying map. The siting of the new
treatment plant would assist in the elimination of one or more of the lift
stations presently contemplated for construction. The treatment plant, as
presently envisioned, could potentially be a small temporary lagoon or a
package plant that is designed in accordance with State requirements. As
the flows increase to approximately 1 MGD, or if water quality
considerations demand so, a full-fledged mechanical wastewater
treatment plant is contemplated as a replacement for the package plant or
lagoon.
5. Utility Plan: The District completed a revision of its Utility Plan document in
2001, addressing the expansion of existing collection and treatment
system, and invesfigations of financing mechanisms to bring these
expansions to fruition.
6. District Infrastructure Protection: The District is likely to continue its work
on the protection of its infrastructure (flood proofing plant site and
collection system components) that is described in the 1999 update to the
North Front Range Water Quality Planning Association Areawide Water
Quality Management Plan.

7. Wastewater Reuse: The District anficipates a potential need for reclaimed
domestic wastewater for use in landscape irrigation from the existing
and/or the proposed wastewater treatment facility. In the course of 6me,
as the need for such reclaimed water is manifested, the District will initiate
planning, design, construction and operation of appropriate works to
satisfy the requests made of the District.
8. Watershed Water Quality Monitoring: The District will continue to pursue
acquisition of water quality data in the Poudre Basin, especially in
Segments 11, 12 and 13 and will collaborate with the City of Fort Coliins,
NFRWQPA, South Fort Collins Sanitation District, City of Greeley, Town of
Windsor, Town of Wellington, Town of Timnath, Kodak Colorado Division,
and any other interested parties who seek to work together on the
enhancement of water quality in the Lower Poudre River Basin.
The DistricYs existing treatment facilities consist of two aerated lagoons and two
polishing ponds, followed by chlorination and dechlorination. Discharge is to
Boxelder Creek just above its confluence with the Cache la Poudre River. The
rated capacity of the plant is 2.34 MGD and 3,200 Ib BOD5/day. Current
wastewater flows average about 1.7 MGD, and the District has adequate
capacity for projected growth for 15 to 20 years for those parts of the service
area that are north of Larimer County Road 40 and west of Weld County Road
17.
The District will submit a site application for enhanced treatment capacity at the
existing plant, which will include upgrades of the existing treatment system, to
increase the hydraulic capacity to about 4.5 MGD and organic capacity of up to
6,000 Ib BOD�/day.
