RESOLUTION RE: APPROVE PETITION FOR ABATEMENT OR REFUND OF TAXES - CATFISH, LLC, CARPFISH, LLC, AND SUCKER, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, State of Colorado, at a duly and lawfully called regular meeting held on the 30th day of October, 2002, at which meeting there were present the following members: Chair Glenn Vaad and Commissioners M. J. Geile, William H. Jerke, David E. Long, and Robert D. Masden, and WHEREAS, notice of such meeting and an opportunity to be present has been given to the taxpayer and the Assessor of said County, and said Assessor, Stan Sessions, being represented by Michael Sampson, and taxpayer Catfish, LLC, Carpfish, LLC, and Sucker, LLC, not being present, and WHEREAS, the Board of County Commissioners have carefully considered the attached petition, and are fully advised in relation thereto. The assessed value reflected on the petition for each property tax year was $37,700. I am approving value reductions for both years of$37,690 each, and I am disapproving value reductions for both years of$10.00 each. By approving a valuation of zero dollars, the property was granted a de facto exemption by the county commissioners. Section 3(1)(a)of Article X of the Colorado Constitution states that property cannot be granted exemption unless the exemption is described in the same Article X. Based upon a discussion with the county assessor's office, a minimal assessed value of$10.00 will be assigned to the property; and, therefore, becomes the value assigned to the property for 2000 and 2001 property tax years.
