Enclosed is a copy of a Notice of Public Hearing and a copy of a proposed ordinance
for the creation of Improvement District No. 464. It appears from information made
available to this office from the Weld County Assessor's Office that you own real property
within the proposed Local Improvement District.
If the ordinance passes,the work referred to in the ordinance will be completed and,
thereafter,a portion of the cost of the project will be assessed against the properties within
the Improvement District,including your property.

NOTICE OF PUBLIC HEARING
FOR AN ORDINANCE
REGARDING THE CREATION OF
LOCAL IMPROVEMENT DISTRICT NO. 464
PERTAINING TO CONSTRUCTION PROJECTS WITHIN THE BOUNDARIES OF THE
GREELEY GENERAL IMPROVEMENT DISTRICT NO. 1, ALSO KNOWN AS THE CORE
AREA OF DOWNTOWN GREELEY AND THE GREELEY GENERAL IMPROVEMENT
DISTRICT NO. 1, AND GENERALLY BOUND BY 5TH AND 6TH STREETS TO THE
NORTH, 7TH AVENUE TO THE EAST, 11TH STREET TO THE SOUTH, AND 11TH AND 9TH
AVENUES TO THE WEST
Notice is hereby given to the owners of land proposed for inclusion in Local Improvement
District No. 464 that there will be a public hearing on this matter before the Greeley City Council
at its regularly scheduled meeting on Tuesday,February 19, 2002, beginning at 6:30 p.m. in
Council Chambers at the Public Safety Building, 919 7th Street, Greeley, Colorado.
The owners of the lands and lots proposed to be included in the Local Improvement District are
invited to attend the public hearing, and those persons are hereby informed that their failure to do
so may prejudice their rights.
The public hearing shall be concerned with the question of whether or not the Greeley City
Council should create a Local Improvement District for purposes of financing the construction of
improvements listed in the ordinance, a copy of which is part of this notice.
You are herein notified that if the Improvement District is created, a portion of the cost will be
assessed against your property. The anticipated maximum construction and incidental costs total
$1,450,000.
The following ordinance, creating said Local Improvement District, was considered favorably on
first reading and will come before the Greeley City Council for final passage on second reading
at the same regularly scheduled City Council meeting referred to above.

AN ORDINANCE CREATING LOCAL IMPROVEMENT DISTRICT NO. 464,FOR THE
CONSTRUCTION OF IMPROVEMENTS GENERALLY CONSISTING OF MODIFYING STREETS
AND PEDESTRIAN MALLS OR PARKING AREAS,RELATED LANDSCAPING IMPROVEMENTS
AND RELATED STREET SCAPE IMPROVEMENTS, WITHIN THE GREELEY GENERAL
IMPROVEMENT DISTRICT NO. 1 AND THE CITY OF GREELEY, COLORADO;DESCRIBING
THE IMPROVEMENTS; SETTING FORTH THE ANTICIPATED MAXIMUM COST OF THE
IMPROVEMENTS; SETTING FORTH THE LEGAL DESCRIPTIONS OF THE LANDS AND LOTS
TO BE INCLUDED WITHIN THE DISTRICT, AND THE NAMES AND ADDRESSES OF THE
APPARENT OWNERS THEREOF; PROVIDING OTHER DETAILS CONCERNING THE DISTRICT;
AND RATIFYING PREVIOUS ACTIONS.
WHEREAS, the City of Greeley (the "City"), in the County of Weld and State of Colorado, is a
municipal corporation,duly organized and existing as a home rule city under Article XX of the
Constitution of the State of Colorado; and
WHEREAS,pursuant to Section 5-20 of the Charter of the City (the "Charter") and Chapter 13.44 of the
Greeley Code of Ordinances, as amended(the "Code"),the City Council(the "Council") of the City has
determined, and hereby determines, to create, on its own initiative, the City of Greeley, Colorado,Local
Improvement District No. 464(the "District"),for the purpose of making certain local and special
improvements as hereinafter described; and
WHEREAS, such improvements will be located entirely within the Greeley General Improvement
District No. 1, created by Ordinance No. 26, 1968(the "Greeley General Improvement District No. 1").
NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF GREELEY, COLORADO:
Section 1. There is hereby created and established within the corporate limits of the City, and
entirely within the boundaries of the Greeley General Improvement District No. 1, a local improvement
district to be known and designated as "City of Greeley, Colorado,Local Improvement District No. 464,"
as shown on Exhibit "A" of this Ordinance, for the purpose of making certain local and special
improvements, as described in Section 3 of this Ordinance(the "improvements"), and to assess the costs
of the improvements to the property benefitted thereby,as provided in Sections 4 and 5 and Exhibit "B"
of this Ordinance.
Section 2. All action(not inconsistent with the provisions of this Ordinance)heretofore taken by
the City or its officers directed toward the creation of the District and the planning, design, and
construction of the improvements,be, and the same hereby is,ratified, approved, and confirmed.
Section 3. The location and type of the improvements (consisting of seven major components)
shall be generally as follows:
Zone 3: All of Blocks 45, 56, and 65,and east'/of Blocks 43, 58, and 63.
Zone 4: North 1/2 of Blocks 76,77, and 78,north V2 of east V2 of Block 75,east 1/2 of
Blocks 46, 55,and 66, south' of east V2 of Block 35, and south' of Blocks 36, 37,and
38.
Zone 5: South 1/2 of Blocks 75,76,77, and 78, west 1/2 of north'/z of Block 75,west'/z of
Blocks 35,46, 55, and 66, north''/z.of east 1/2 of Block 35,north 1/2 of Blocks 36, 37,and
38,all of Block 23, and all of Block 22.
The total costs to be assessed shall be assessed as follows:

The total cost to be assessed in each zone will be assessed proportionately against each lot within such
zone on an area basis (each lot will be assessed a portion to the total cost assessable in such zone in the
proportion that the area of each lot bears to the total assessable area in such zone).
The Council has determined, and hereby determines, that such basis of assessment is equitable and in
accordance with the special benefits to the lands and lots within the District. In case of any lands or lots
which are irregularly shaped or in any other case in which an assessment according to the basis
hereinbefore described would be disproportionate to the special benefits, an equitable adjustment shall be
allowed so that the assessment is in proportion to the special benefits.
Section 6. The lands and lots to be included in the District, together with the legal descriptions
thereof,and the names and addresses as of November 1,2001, of the apparent owners thereof, (as of
, 2000),are shown on Exhibit "B" attached hereto and incorporated herein:
The Council has determined, and hereby determines,that all such lands and lots will be specially
benefitted by the improvements.
Section 7. Within a reasonable time after final passage of this ordinance, the City will make the
improvements or authorize the making of the improvements. Any contract or contracts let for the
construction of the improvements shall be awarded to the lowest responsible bidder in accordance with
Section 5-10 of the Charter and all applicable Code provisions and other ordinances and regulations.
Section 8. If any section,paragraph, clause, or provision of this ordinance shall be held to be
invalid or unenforceable, the invalidity or unenforceability of such section,paragraph, clause, or
provisions shall in no manner affect any other provision of this ordinance.
Section 9. All ordinances, resolutions,bylaws and regulations of the City in conflict with this
ordinance are hereby repealed to the extent only of such inconsistency. This repealer shall not be
construed to revive any ordinance,resolution,bylaw or resolution, or part thereof, heretofore repealed.
Section 10. This ordinance, immediately on its final passage, shall be recorded in the City book
of ordinances kept for that purpose, authenticated by the signatures of the Mayor and Clerk, and shall be
published in the Greeley Tribune, a legal newspaper of general circulation in the City. The Council
hereby determines,pursuant to Section 3-21 of the City Charter, that such publication shall be by
publication of the title hereof together with a statement that the text hereof is available for public
inspection and acquisition in the office of the City Clerk.
Section 11. No legal or equitable action shall be brought or maintained to enjoin or in any way
challenge the creation of the District unless such action is brought within thirty (30)days from the final
passage of this ordinance.
Section 12. This ordinance shall take effect five(5)days after its final publication as provided
by Section 3-16 of the Charter.

All of the blocks in the downtown special improvement district will receive a facelift with new
street signage, lighting, street furniture, and the addition of some uniform landscaping,to the
extent possible within the funding limitations of this S.I.D. All of these updates and additions
will follow the same "Entryway Master Plan of Greeley" to which the 8h and 9th Avenue
renovations will adhere. All of these changes and additions are intended to give the Downtown
District a distinct sense of continuity and identity.
The total project generally includes the removal of portions of the existing asphalt, curb and gutter,
fixtures, and reconstruction and construction of pedestrian malls on each street as generally illustrated in
the approved Schematic Design, including but not limited to:
(d) concrete and masonry unit paving
(e) benches, kiosks,trash containers,bike racks,flagpoles, signage, and striping
(f) decorative and functional lighting
(g) parking areas
(h) new planting areas for trees, shrubs, and flowers (with associated irrigation)
(i) the project will also include any necessary drainage provisions and minor relocation of
utilities where conflicts occur with the Mall elements
(j) adequate utilities(i.e., water,electric,cable,telephone,etc.,) shall be installed within the
Mall area.
The parking lot project component includes final site grading, gutter, and storm drainage,asphalt paving,
lighting,planting areas, irrigation,utility relocation, lane and parking striping and signage.
The Schematic Design referred to above is on file in the office of the City Clerk and is available for
inspection.
Section 4. The anticipated maximum cost of the improvements under this Local Improvement
District, inclusive of incidental costs, is $1,450,000.00. Such anticipated maximum cost shall not
constitute a limitation on the actual cost of the improvements nor upon the amount of the assessments to
be levied therefor,nor for any other purpose. Incidental costs in connection with the District, which are
included in the anticipated maximum cost set forth above, shall include engineering, architectural,
design,and legal fees, and the expenses of inspection,advertising abstracting, publishing,posting,
collection,and any other incidental costs directly related to the creation of the District and the making of
assessments therein (including, without limitation, interest on local improvement district bonds to be
issued until commencement of assessment installment payments and other costs and expenses related to
such bonds).The final amounts to be assessed against the lots and lands in the District shall be
established by ordinance after substantial completion of the improvements. Such assessments shall be
based upon the total cost of the improvements and such incidental costs. All of such total construction
and incidental costs shall be assessed against the lands and lots within the District, as provided in Section
5 of this ordinance.
Section 5. The costs of the improvements to be assessed against the lands and lots within the
District,except those parcels owned by the City of Greeley, Colorado, shall be assessed on a zone basis,
as follows:
The District shall be divided into five zones as follows: (see attached map -Exhibit "A")
Zone 1: North t/s of Block 64, all of Block 57, and the south ''/ of Block 44.
Zone 2: South 1/2 of Block 64, west'/ of Blocks 43, 58, and 63, and north 1/2 of Block 44.
Downtown Infrastructure Improvements
Master Plan
(a) Opening the 9t Street Plaza to Through,One-way Traffic,Maximizing Pedestrian Area -
The plaza on 9th Street will be opened to one-way traffic running west from 81°Avenue to 9th
Avenue. Most of the pedestrian space will be conserved to allow for shopping and an outdoor
commons area when the street is closed for special events. As part of the pedestrian area,patios
for the Rio Grande Restaurant and Magnus Restaurant will be preserved. Approximately twenty
new parking spaces will also be added to the 9th Street plaza in order to give more access and
visibility to the shops and offices in the center of the plaza.
(b) Opening the 8th Street Plaza to Through,One-way Traffic,Maximizing Pedestrian Area -
Like 9th Street, 8t° Street will be opened to one-way traffic,but it will run east to 8th Avenue from
9th Avenue. Although it will contain more pedestrian area, this street will be geared more
towards offices with approximately twenty-five parking spaces and new high-speed
communication conduits installed. Similar to 9th Street, it will have the capability of being used
as a commons area when the streets are closed.
(c) Lincoln Park Diagonal Walk -
This addition to Lincoln Park is intended to give better access and viewing,to and from the 8th
and 9th Street restaurants and shops, with the Union Colony Civic Center.This walk is part of
EDAW's improvements plan for the park, and it can be incorporated into a circular walk around
the park,as well as an access to a proposed band stand on the east side of the park where 81°
Street ties in.
(d) 9's Avenue Improvements -
Along with the re-opening of the 8th and 9th Street Plazas,there is the issue of traffic flow with 9th
Avenue. It must be reconfigured in order to make the changes to the plazas work. This will
include the relocation/removal of the fountain at the west end of 8th Street,redesigning the
parking lot, and the refurbishing of the masonry work within the roadway.
(e) 8th Avenue Improvements -
8th Avenue, or Highway 85 Business route, is considered to be a main entryway into the City of
Greeley. In order to reflect this,portions of the section of 8th Avenue between 10th Street and 7th
Street will be renovated. This renovated portion will follow the "Entryway Master Plan for the
City of Greeley" adopted in 1994.These renovations may include the following: widening of the
sidewalks, the addition of a landscaped median, roadway access to 8th and 9th Streets,uniform
signage, lighting, landscape and street furniture, and current angled parking may be changed to
parallel parking. There are also plans to rejuvenate the remainder of 8h Avenue through Capital
Improvement Projects in the next several years.
(f) Parking Lot on 7`"Avenue From 7`s to 6's Street(Near or on Railroad Property) -
The proposed parking lot will run north and south along side the current railroad tracks near 7i°
Avenue. This well lit and landscaped parking lot will have approximately 100 parking spaces
available for easy access to nearby shops and offices. The parking lot will also improve the
appearance of the rarely used railroad track that will run through it and will require approval and
leases with the appropriate railroads.
