We are aware that the Air Pollution Control Division will consider this type of criteria in their review for an emissions permit and that the facility has committed to comply with all applicable rules and regulations. However, we believe it is appropriate that the applicant provide this information as we anticipate much discussion concerning this topic during hearings with the Planning Commission and the Board of County Commissioners. It is our expectation that dispersion modeling be conducted to demonstrate the proposed facility's impacts on current air quality over the area where significant impacts may occur. The proposal includes a Power Generator Facility, a one hundred seven(107)acre Wellfield Site, an approximately eight(8) mile long Gas Pipeline and an approximately twenty two(22)mile Water Pipeline. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. In event the Wellfield Site maintenance building or any structures located on the power plant property is equipped with a floor drain, the applicant must apply for an Underground Injection Control (UIC) Class V Injection Well permit through the Environmental Protection Agency(EPA), or provide evidence that the applicant is not subject to the EPA Class V requirements. 2. Submit appropriate Air Pollution Emission Notice (A.P.E.N.)and Emissions Permit applications to the Air Pollution Control Division, Colorado Department of Public Health and Environment for the power plant facility and the construction of the gas and water lines. 3. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment, Environmental Health Division. Any existing septic system(s)which is not currently permitted through the Weld County Department of Public Health & Environment will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s)must be brought into compliance with current I.S.D.S. regulations. 4. An individual sewage disposal system or package sewage treatment plant shall be installed at the power plant to treat sanitary wastes. In the event a septic system is installed, it shall be designed and installed according to the Weld County Individual Sewage Disposal Regulations. In the event a package plant is the chosen method of treatment for sanitary wastes, the plant shall comply with all requirements of the Water Quality Control Division of the Colorado Department of Public Health & Environment. 5. The applicant shall provide evidence it has obtained a permanent, potable water supply to serve the power plant that complies with the Colorado Primary Drinking Water Regulations (5 CCR 1003-6). 6. The facility shall provide evidence that all waste water treatment and disposal systems are designed to meet the"Zero Liquid Discharge"criteria described in the application materials. The systems shall be designed by a registered professional engineer. All waste water treatment systems shall comply with all applicable rules and regulations. Rocky Mountain Energy Center Page 2 7. The applicant shall obtain appropriate stormwater discharge permits, from the Water Quality Control Division of the Colorado Department of Public Health and Environment, for the construction of the well field, gas and water lines, and the construction and operation of the power plant. 8. The applicant shall provide evidence to the Weld County Department of Public Health and Environment, and the Department of Planning Services, that any existing or constructed well(s)have been appropriately permitted/registered with the Colorado Division of Water Resources. We recommend that the following requirements be incorporated into the permit as "development standards": 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities Act,30-20-100.5, C.R.S., as amended. All wastes shall be appropriately handled, treated, and disposed in accordance with the application materials and all applicable rules and regulations. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 6. Adequate toilet facilities shall be provided for employees and the public. 7. The applicant shall provide adequate toilet facilities (port-a-potty) during the construction of phases of the project. 8. The facility shall provide bottled water for drinking during construction of the project. 9. The facility shall maintain compliance with all requirements of the Water Quality Control Division of the Colorado Department of Public Health & Environment. 10. The power plant shall be equipped with an adequate water supply for drinking and sanitary purposes. The water supply shall comply with all applicable portions of the Colorado Primary Drinking Water Regulations (5 CCR 1003-6). 11. The facility shall operate as a"Zero Liquid Discharge" site. With exception to sanitary wastes, no liquids shall be disposed into the earth. 12. Energy Center, LLC (Calpine) COLORADO Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the Use by Special Review Standards. There are three sections to this application: the power- generating facility, including a 107 acre wellfield site,an approximately eight mile long gas pipeline,and approximately 22 miles of water pipeline. Our comments and requirements are as follows: COMMENTS: Power Generating Facility: The applicant is identifying two possible access road sites to the facility, WCR 51 on the east side of the power plant site or WCR 49 adjacent to the west side of the power plant site. A second back-up access road (to be used primarily for emergency access) will be constructed off WCR 16. Service roads throughout the power plant facility will be paved to provide internal access to all project facilities and on-site buildings. There is a portion of WCR 49 in the north half of section 1 which has been annexed by the town of Hudson. The remaining portion of the road is maintained by Weld County. Water Pipeline: Preferred water pipeline Route B runs directly north of the power plant site using either WCR 51 or the section line approximately 22 miles north to the South Platte River. Gas Pipeline: Preferred route for the gas pipeline is WCR 16 or the section line directly east of the power plant site for approximately eight miles. REQUIREMENTS: Traffic Impact Study: All new residential developments with expected ADT>200 and all new commercial developments will be required to submit a traffic study as part of the review process. This study shall include a description of the project, vehicle trip generation and distribution, verification of adequate acceleration,deceleration and storage facilities at all impacted intersections,review of bridge capacity, intersection level of service analysis for existing and proposed conditions and recommendation for needed upgrades to transportation infrastructure to support the development. Weld County Public Works will review your submitted traffic study. The traffic study needs to be submitted no later than two weeks prior to scheduling with the Planning Commission to allow our traffic engineer time to review and comment. Improvements Agreement: The applicant shall enter into a Road Maintenance and Improvements Agreement with the Weld County Public Works Department for the upgrading and paving of Weld County roads which are associated with the power plant site and any additional intersections impacted with heavy hauling/vehicle traffic that may be identified in the traffic study. Storm Water Drainage: The applicant shall supply a storm water drainage report in accordance with 23-2-240 (A5). The storm water management during construction will be controlled through the use of grading, retention ponds, staked hay bales, and other erosion control techniques. Storm water regulations in Colorado are administered by the Colorado Department of Public Health and Environment (CDPHE). Discharge of storm water during construction periods will be permitted through a NPDES construction general permit. USR-1339 June 18, 2001 Page 2 Utility Permits: The applicant shall obtain a Right-of-Way Use Permit for placing or crossing any Weld County rights-of-way. Contact Bill Hawkins (356-4000, Ext. 3750) prior to any construction. Access/Off-Street Parking: The applicant is indicating that service roads throughout the power plant will be paved to provide internal access to all project facilities and on-site buildings. The off-site parking spaces including the access drive shall be surfaced with asphalt, concrete or equivalent, and shall be graded to prevent drainage problems. There will be no staging or parking of equipment or vehicles on Weld County roads adjacent to the proposed facility. Utilize on-site parking only. Non-exclusive License Agreement: Portions of the proposed routes identify that the gas and water pipelines would be utilizing County rights-of-way (section line). A Non-Exclusive License Agreement for the Upgrade and Maintenance of Weld County Rights-of-way shall be required at these locations. Right-of way conflict: The applicant is proposing to place the gas and water pipelines down the center of the section line right-of-way. Weld County does not have a road here at the present time, however,this creates a problem if the Public Works Department recommends in the future to construct a road on this section line. The purpose of the 1889 resolution was to reserve right-of-way on section lines to connect road segments if required in the future. I would recommend offsetting the gas and water pipelines to one side or the other of the County right- of-way, allowing the remaining portion to be available to construct a future roadway. If possible,I would request that this letter supersede the letter I sent you dated October 17,2001. 1 have reviewed the Supplement To Application For Use By Special Review and find that Attachment B regarding the proposed lighting system sufficiently addresses the Division's original concerns about the exterior lights potential to negatively impact wildlife. After reviewing the application submitted by Rocky Mountain Energy Center, LLC (Calpine) and visiting the site several concerns have been identified. Opportunities for enhancing wildlife preservation and diversity are possible to mitigate some of these potential conflicts. The proposed site is located immediately adjacent to a privately owned reservoir and within two miles of Banner Lakes State Wildlife Area. Box Elder Creek borders the west and supplies water to a series of small reservoirs to the south of the proposed site. Collectively, with the Horse Creek and Prospect Reservoirs, this area supports a wide diversity of wildlife. During the spring and fall migrations, a large concentration of waterfowl utilizes the surrounding water impoundments. Riparian areas of Box Elder Creek and nearby lakes and reservoirs are critical for maintaining a rich diversity of wildlife species in a shortgrass ecosystem The Colorado Division of Wildlife recognizes the vital importance of riparian areas not only for sustaining wildlife diversity but also for maintaining the health of the ecosystem through soil stabilization, collecting and filtering runoff, and soil moisture conservation. The comments and concerns of the Division of Wildlife seek to preserve, and if possible, enhance these areas along waterways and water impounds. Concerns: 1. Disruption of avian migration—spring and fall: Visibility could be reduced due to fog created by discharge plumes. Industrial lighting may be disruptive to nocturnal navigating mechanisms of avian species. Intense and unshaded lighting serve as beacons as birds pass through- increasing the risk of mortality due to bird strikes. 2. Avian Electrocution- transmission lines: Transmission towers and lines should be marked and constructed to minimize the risk of bird strikes and electrocution. 3. Conservation easements are expanding the abilities of industries and natural resource agencies to enhance wildlife habitat and preserve local and migratory fauna. Setting aside the remainder, or a portion of the Calpine site, for wildlife preservation offers the greatest opportunity for protecting those species which utilize the Box Elder drainage and nearby lakes and reservoirs. Wells, Jr. In consultation with the Natural Resources Conservation Service (NRCS) , we have reviewed the above referenced case and have the following comments . SOILS/LIMITATIONS: The soils that were identified in the application packet were accurate and consistent with the "Soil Survey of Weld County, Colorado - Southern Part. For the most part, the soils found on the Power Plant Site have slight to moderate limitations for septic systems and shallow excavations . The Gas Pipeline and Water Pipeline proposals cross a variety of soils, some of which will require special care and planning before installation of the pipelines . PRIME FARMLANDS: There will only be minor impacts to prime farmland located on the Power Plant Site. There will be little, if any, impacts from the pipeline projects . SOIL EROSION POTENTIAL: Some of the soils encountered on the Power Plant Site have moderate to severe erosion potential . Steeper soils will have the potential for water erosion as well as wind erosion. Flatter soils will exhibit wind erosion potential. The proposed routes of the Water Pipeline and Gas Pipeline cross a large mix of soils . Some of the soils are very sandy and are very susceptible to erosion. Care needs to be exercised so as to control all erosion. OTHER: All disturbed areas should be revegetated as soon as possible after construction activities are completed. Weeds will need to be controlled until satisfactory cover is reestablished. It is recommended that applicant contact Ron Broda with Weld County for a weed management plan and Norman Wells with the NRCS in Brighton for revegetation assistance .
