RE: ACTION OF THE BOARD CONCERNING PETITION FOR ABATEMENT OR REFUND
OF TAXES -THOMAS PFANKUCH
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, State of Colorado, at
a duly and lawfully called regular meeting held on the 30th day of October, 2002, at which
meeting there were present the following members: Chair Glenn Vaad and Commissioners
M. J. Geile, William H. Jerke, David E. Long, and Robert D. Masden, and
WHEREAS, notice of such meeting and an opportunity to be present has been given to
the taxpayer and the Assessor of said County, and said Assessor, Stan Sessions, being
represented by Michael Sampson, and taxpayer Thomas Pfankuch, being present, and
WHEREAS, the Board of County Commissioners have carefully considered the attached
petition, and are fully advised in relation thereto.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Board concurs with the recommendation of the assessor and
the petition be and hereby is, denied, and an abatement refund not be allowed as follows:

PETITION FOR ABATEMENT OR REFUND OF TAXES
This property has been classified as commercial/exempt for several decades, and was
purchased on 051401 with the intention of conversion to residential use, not continued
use as commercial property.
The property was determined to be substandard in many ways. Local building officials
determined that significant improvements to egress windows, water supply, sewer
connections, and to off street parking would be required to meet current building codes,
and landscape requirements.
Total improvements and demolition, simply to meet local building codes, exceeded
$70,000. Qualification for certificate of occupancy obtained on 121201 required almost 6
month of construction.
Due to the age of this building, improvements were significantly substandard to current
building codes. Consequently the valuation of the improvements, at the time of purchase,
did not significantly exceed the value of the land. Petitioner agrees that $3610 accurately
reflects the valuation of the land, and estimates the value of the improvements, at the time
of purchase at $4000.
