HomeMy WebLinkAbout20023153.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN -WESTRIDGE ANIMAL HOSPITAL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Department of Public Health and Environment, and Westridge Animal Hospital, with terms and conditions being as stated in said Memorandum of Understanding, and WHEREAS, after review, the Board deems it advisable to approve said Memorandum of Understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Department of Public Health and Environment, and Westridge Animal Hospital be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Memorandum of Understanding. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 11th day of December, A.D., 2002. Masden Date of signature: /7 2002-3153 00 L HL0029 MEMORANDUM OF UNDERSTANDING between Westridge Animal Hospital and Weld County, Colorado WHEREAS, Combs/Hubert, LLC d/b/a Westridge Animal Hospital (hereinafter"Westridge") has donated a valued public health service to the Environmental Health Division of the Weld County Department of Public Health and Environment(WCDPHE) in the investigation of zoonotic illnesses including, but not limited to, preparation of samples for neurological tissue testing for rabies, and WHEREAS, WCDPHE requires such assistance, and WHEREAS, in order to provide for the protection of the staff of Westridge and in furtherance of the investigation of zoonotic illnesses, WCDPHE is willing to waive the fee for rabies prophylaxis for two members of the staff of Westridge designated by Westridge, and to provide a refrigeration unit for storage of animal carcasses, and WHEREAS, it is necessary and desirable to specify the role and relationship of the parties, NOW THEREFORE, it is hereby agreed that: I. Westridge intends to continue to donate services for the investigation of zoonotic illness on an as needed basis provided staff and resources are available. The WCDPHE agrees to notify Westridge by telephone in the event a sample requires preparation and processing. 2. Should Westridge elect not to continue to volunteer services and such discontinuance is permanent, such notice shall be given in writing to the Director of Environmental Health, WCDPHE, at least one week prior to termination of the provision of services. 3. WCDPHE agrees to waive the fee for rabies prophylaxis treatment performed at the WCDPHE clinic with respect to keeping two staff members of Westridge current in their treatment as designated by Westridge. WCDPHE will also provide at its cost, a 2002-3153 MOU with Westridge Animal Hospital Page 2 refrigeration unit for storage of animal carcasses for the use of Westridge at Westridge so long as Westridge is providing and volunteering the services described in this Agreement. 4. No member of the staff nor any partner or owner in Westridge shall be considered to be an employee of WCDPHE or Weld County for purposes of coverage. Westridge agrees to maintain such workers compensation coverage, as required by state law, with respect to all of its staff,employees, partners and owners. 5. No portion of this Understanding shall be deemed to constitute a waiver of any immunities, the parties or the officers or employees may posses, nor shall any portion of this Understanding be deemed of greater duty of care which did not previously exist with respect to any person not a party to this Understanding.
