RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR LIGHTHOUSE
COVE, PHASES I AND II, S #522 AND S #578 - DONALD LAFAVER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by on March 3, 2000, the Department of Planning Services approved the
application of Donald LaFaver, 4480 North 109th Street, Lafayette, Colorado 80026, for
Planned Unit Development Final Plat for Lighthouse Cove, S #522, Phase 1, for ten (10)
residential lots with forty-five (45) acres of open space in the Mixed Use Development Area of
on the following described real estate, to-wit:
Lot B of Recorded Exemption #2330; part of the
N1/2 NE1/4 of Section 16, Township 2 North,
Range 68 West of 6th P.M., Weld County,
Colorado
WHEREAS, on November 3, 2000, the Department of Planning Services staff did
approve Planned Unit Development Final Plan for Lighthouse Cove, S #578, Phase 2, for
Donald LaFaver, 2185 Pinedrop Lane, Golden, Colorado 80401, on the following described real
estate, to-wit:
N1/2 NE1/4 of Section 16, Township 2 North,
Range 68 West of 6th P.M., Weld County,
Colorado
WHEREAS, on June 26, 2000, the Board of County Commissioner of Weld County,
Colorado, did approve an Improvements Agreement According to Policy Regarding Collateral
for Improvements (Private Road Maintenance) for Planned Unit Development Final Rat for
Lighthouse Cove, S #522, Phase 1, between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, and Donald LaFaver with terms
and conditions being as stated in said agreement, and is currently holding Irrevocable Letter of
Credit, in the amount of$18,091.00, drawn on the New Frontier Bank, 2425 35th Avenue,
Greeley, Colorado 80634, and
WHEREAS, on January 8, 2001, the Board of County Commissioner of Weld County,
Colorado, did approve an Improvements Agreement According to Policy Regarding Collateral
for Improvements (Private Road Maintenance) for Planned Unit Development Final Plan for
Lighthouse Cove, S #578, Phase 2, between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, and Donald LaFaver with terms
and conditions being as stated in said agreement, and is currently holding funus in the Clerk to
the Board Trust Fund in the amount of$11,227.50, and

WHEREAS, staff from the Weld County Departments of Public Works and Planning
Services have conducted visual inspections of and recommend release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Irrevocable Letter of Credit, for Planned Unit Development Final
Plat for Lighthouse Cove, S #522, Phase 1, in the amount of$18,091.00, drawn on the New
Frontier Bank, 2425 35th Avenue, Greeley, Colorado 80634, be, and hereby is, canceled and
released.
BE IT FURTHER RESOLVED by the Board, that funds for Planned Unit Development
Final Plan for Lighthouse Cove, S #578, Phase 2, in the Clerk to the Board Trust Fund, in the
amount of$11,227.50, be, and hereby are, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate parties.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 22nd day of May, A.D., 2002.

The Weld County Department of Public Works and Planning Services received a letter from
Don LaFavor, developer of Lighthouse Cove PUD requesting the final release of collateral for
S-522 - Lighthouse Cove I and S-578 - Lighthouse Cove II. Per Mr. Carroll's memorandum
dated May 2, 2002, all transportation items have been verified as being complete.
The Weld County Department of Public Works recommends the release of collateral for S-522,
Lighthouse Cove I, Phases I and II and S-578, Lighthouse Cove II.
The Department of Planning Services and Department of Public Works recommends that
twenty-nine thousand three hundred eighteen and 50/100s (29,318.50) dollars, be released.

At the written request of the applicant, I made a final inspection of the site on April 30, 2002, for the
transportation portion of the Exhibit A, Lighthouse Cove, Phase II. All transportation items have
been verified as being complete.
No retainage is being requested from the Public Works Department on the transportation portion
of this project.
All other non-transportation items shall be verified by Planning Services prior to release.

Mr. Carroll,
Please consider this my request for final inspections on the two above sub-divisions. All work,
including the final cap on the entrances at Lighthouse Cove,have been completed. I understand
that after final inspections that the Board of County Commissioners will release the balance of all
money and other security that is presently held. Please advise me of the next step,if any,that I
must take to complete the close out of the security agreement.
Don,It's been a real pleasure working with you over the last 3 years. You've been one of the
people that has helped make the process much easier.

Cove located at 9777 Weld County Road 7, Longmont Colorado Weld County Colorado, for a
sum not to exceed the aggregate of Eighteen Thousand Ninety One and no cents. ($ 18,091.00)
Each draft so drawn must be marked "Drawn under New Frontier Bank, 2425 35" Avenue,
Greeley, Colorado. 80634. This Letter of Credit must be accompanied by a "signed statement
from the Board of County Commissioners of Weld County, Colorado starting the 6`h of October
that there has been a material breach of the Improvements Agreement According to Policy
Regarding collateral for Improvements regarding Lighthouse Cove dated the 6th day of October
2000 by and between Lighthouse Cove and the County Commissioners of the County Weld"
This credit is subject, so far as applicable to "The Uniform Customs and Practice for
Documentary Credits, 1983 Revision, The International Chamber of Commerce Publication No
400"
We hereby agree with you that all drafts drawn under and in compliance with the teens of this
credit will be duly honored and presented for payment to our main office, NEW FRONTIER
