RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN ACCESSORY STRUCTURE
OVER 1, 500 SQUARE FEET IN A SUBDIVISION - MARTIN AND JEANETTE
BOHLMEYER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 28th day of March, 1984 , at the hour of 2 : 00 o' clock
p.m. in the Chambers of the Board for the purpose of hearing the
application of Martin and Jeanette Bohlmeyer, 25870 Sandy Knolls
Blvd. , Kersey, Colorado 80644 , for a Use by Special Review for an
accessory structure over 1 , 500 square feet in a subdivision on
the following described real estate, to-wit:
Lot 1 , Block 1 , Sandy Knolls Estates, Second
Filing, located in the SE4 , Section 20 , Town-
ship 5 North, Range 64 West of the 6th P .M. ,
Weld County, Colorado
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County Plan-
ning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that this
request shall be approved for the following reasons :
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Weld County
Comprehensive Plan.
b. The Comprehensive Plan supports the expansion and
development of agriculturally oriented industry,
as long as they do not adversely affect the total
economy or environment.
c. The accessory structure is consistent with the in-
tent of the Agricultural Zone District, and is pro-
vided for as a Use by Special Review

d. The town of Kersey has recommended approval of
the proposal .
e. No overlay districts affect the site.
f. Use by Special Review Operation and Design Stan-
dards provide adequate protection of the health,
safety and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application for a
Use By Special Review for an accessory structure over 1 , 500 square
feet in a subdivision on the hereinabove described parcel of land
be, and hereby is, granted subject to the following conditions:
1 . The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . No building or electrical permits shall be issued for
the Use by Special Review Permit area until the Standards
for the Use by Special Review have been placed on the
Use by Special Review plat and the plat has been de-
livered to the Department of Planning Services office.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 28th day of
March, A.D. , 1984 .

1. The permitted use shall be a pole barn, as described in the submitted
application materials on file with the Department of Planning Services.
2. Earth tone colors shall be used to paint the pole barn.
3. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
4. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
5. Representatives or members of the Weld County Health Department and Weld
County Department of Planning Services shall be granted access onto the
site at any reasonable time in order to insure the operations carried out
on the site comply with the Operation Standards stated hereon and all
applicable Weld County Regulations.
6. The Use by Special Review area shall be limited to the plans shown hereon
and governed by the Standards as stated above and all applicable Weld
County Regulations. Any material deviations from the plans, and/or
Standards as shown or stated above, shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the
Board of County Commissioners before such changes from the plans and/or
Standards are permitted. Any other changes shall be filed in the office
of the Department of Planning Services.
7. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated Standards may be reason for revocation of the
Permit by the Board of County Commissioners.

A public hearing was conducted on March 28 , 1984, at 2:00 P.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated March 12, 1984, and duly
published in the La Salle Leader on March 15, 1984, a hearing was conducted
to consider the request of Martin and Jeanette Bohlmeyer for a Use by Special
Review Permit for an accessory structure over 1,500 square feet in a sub-
division. Lee Morrison, Assistant County Attorney, read this request into
the record. Rod Allison, Planning Department representative, read the favor-
able recommendation from the Planning Commission into the record. He said
there are two conditions and seven Operation Standards recommended for this
proposal. Martin Bohlmeyer, the applicant, was present and came forward to
explain his request and answer questions of the Board. Don Hird, a neighbor
of the Bohlmeyers, came forward to voice opposition to this reauest. He said
this USR is contrary to the Covenants of this subdivision. He said this area
is zoned residential. Mr. Allison explained that the uses are residential in
nature, but it is zoned agricultural. Mr. Morrison advised the Board that
the Covenants are not binding upon the Board. After discussion, Mrs. Bohlmeyer
cane forward to offer comments. (TAPE CHANGE #84-24) Mr. Allison submitted
letters from surrounding landowners in favor of this proposal. Commissioner
Brantner said that he understood Mr. Hird's concern, but this hearing was for
the matter of considering the Use by Special Review only, and the Board could
not consider the Convenants or other matters at this time. Commissioner
Johnson said that, based upon the testimony and evidence submitted, she would
concur with this. Commissioner Johnson then moved to approve this Use by
Special Review requested by Martin and Jeanette Bohlmeyer and to include the
Standards & conditions as recommended. Connnissioner Brantner seconded the motion.
Following discussion, the motion carried unanimously.

DETERMINATIONS TO BE MADE BY THE BOARD OF
COUNTY COMMISSIONERS ON USE BY SPECIAL REVIEW REQUESTS
24.4.2 The Board of County Commissioners shall hold a public
hearing to consider the application and to take final
action thereon. In making a decision on the proposed Use
by Special Review, the Board shall consider the
recommendation of the Planning Commission, and from the
facts presented at the public hearing and the information
contained in the official record, which includes the
Department of Planning Services case file, the Board of
County Commissioners shall approve the request for the
Special Review Permit unless it finds that the applicant
has not met one or more of the standards or conditions of
Sections 24.2.2, 24.5 (design standards) and
24.6(operation standards) . The applicant has the burden
of proof to show that the standards and conditions of
24.4.2, 24.5 (design standards) and 24.6 (operation
standards) are met. The applicant shall demonstrate:
24.4.2. 1 That the proposal is consistent with the Weld County
Comprehensive Plan.
24.4.2.2 That the proposal is consistent with the intent of the
district in which the USE is located.
24.4.2.3 That the USES which would be permitted will be compatible
with the existing surrounding land USES.
24.4.2.4 That the USES which would be permitted will be compatible
with the future DEVELOPMENT of the surrounding area as
permitted by the existing zone and with future DEVELOPMENT
as projected by the COMPREHENSIVE PLAN of the COUNTY or
the adopted MASTER PLANS of affected municipalities.
24.4.2.5 That the application complies with the Weld County Zoning
Ordinance, Section 50, Overlay District Regulations if the
proposal is located within any Overlay District Area
identified by maps officially adopted by Weld County.
24.4.2.6 That if the USE is proposed to be located in the
A-District, that the applicant has demonstrated a diligent
effort has been made to conserve productive agricultural
land in the locational decision for the proposed USE.
24.4.2.7 That there is adequate provision for the protection of the
health, safety and welfare of the inhabitants of the
NEIGHBORHOOD and the COUNTY.

color of the structure do not appear to have a negative impact on
the neighborhood;
- The town of Kersey has recommended approval of the proposal;
- No overlay districts affect the site;
- Use by Special Review Operation and Design Standards provide
adequate protection of the health, safety and welfare of the
neighborhood and County.
The Planning Commission recommendation for approval is conditional upon the
following:
1. The attached Standards for Use by Special Review be adopted and placed on
the Use by Special Review plat prior to recording.
2. No building or electrical permits shall be issued for the Use by Special
Review Permit area until the Standards for the Use by Special Review have
been placed on the Use by Special Review plat and the plat has been
delivered to the Department of Planning Services office.

Zoning Ordinance. The applicants raise show goats on the property and
could have up to fifty (3D) goats on the property before a Use by Special
Review Permit is required.
This Use by Special Review Permit proposal is for review of the proposed
accessory structure. The town of Kersey has approved the application,
but the staff has not received the referral.
The Planning staff has received one (1) letter and two (2) phone calls
objecting to the goats and barn.

1 . a. Our proposal is consitent with the Weld County Comprehensive
Plan as it is in a agriculturally rural subdivision and a. barn
used to house farm animals such as registered dairy goats will
be keeping with the idea that this area is a. agriculture rural
subdivision.
b. The district we are located in is a rural subdivision which is
zoned a�ericultural . With a few exceptions most of the neighbors
raise livestock (ranging from chickens and rabbits to horses and
cattle) on their property which is alto our intent. With a barn
like what we have planned we will able to provide the best care
available for our livestock and will improve the appearance of
OUT prperty as it will allow us toremove several of the less
attractive ohtbu.ilding that are currently used to house our
animals.
c . The use of the proposed barn will be to house our livestock.
The surrounding land includes pasture sometimes used to graze
cattle and an occasional horse. This pasture is located with
two acres directly east of us and directly south is open pasture
and farm land as far as the eye can see. To the west and north
are residences and several sheds and large barns used to raise
horses (registered and unregistered) , chickens, rabbits, pigs,
cattle, and farm machinery . Three of the barns in our area
are as large as the one we plan to construct.
d. Our barn will be compatible with the Comprehensive Plan of the
County as it is in keeping with the proposed agricultural and n__
rural plattes in the area. and will no way interfer with any
future developement of the surrounding land.
e. Our property is not affected by any Overlay District Regulations .
f. Our property is in a rural platted subdivision that is not
currently being farmed or in Agricultural production.
g. There will be more than adequate facilities to protect the
health, safety & welfare of the neighborhood and county . OUT
animals are in no manner dangerours and will be housed in the
proposed barn that will provide adequate room, venilation, etc.
for the animals and in pens well built of strong cattle panels
and gates that can be opened only by a human to assure that the
animals will stay in their appointed area unless under human
supervision so as not to interfer with any neighboring property.

Weld County Clerk and Recorders Office, Jennie Reid sold her half
of the mineral riots to W.D. Cross and Cecil ,). Green (addresses
unknown due to the length of time that has past since the transfer)
Gilbert Danley of 1727 7th Ave. , Greeley, Colorado retained his half
of the mineral rights .
