A public hearing was conducted on October 30, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair Commissioner David D. Long, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Kim Ogle Public Works representative, Don Carroll Health Department representative, Char Davis The following business was transacted: I hereby certify that pursuant to a notice dated September 6, 2002, and duly published September 11, 2002, in the Tri-Town Farmer and Miner, a public hearing was conducted on September 25, 2002, to consider the request of Tri-State Generation and Transmission Association, Inc., for a Site Specific Development Plan and Use by Special Review Permit#1392 for a Major Facility of a Public Utility (13.2-mile, 115 kV transmission line and two new switching stations) in the A (Agricultural) Zone District. At said hearing the Board continued the matter to October 30, 2002, at the request of the applicant,to allow them additional time to continue meeting with some of the affected land owners along the preferred route. At said hearing on October 30, 2002, Lee Morrison, Assistant County Attorney, made this a matter of record. Commissioner Geile commented that the route passes through three separate jurisdictions. Mr. Morrison stated this hearing is to consider only those portions of the proposed line in unincorporated Weld County. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the unfavorable recommendation of the Planning Commission into the record as written. Mr. Ogle gave a brief description of the location of the line and switching stations, and stated the route has been developed with the full cooperation of the City of Dacono, and the Towns of Frederick and Firestone. He stated the line will extend for 12.7 miles adjacent to road right-of-way, and he reviewed the pole types and sizes, and stated the facilities will be purchased from United Power upon approval of this request. Mr. Ogle stated the proposed line is in close proximity to several residences, and the applicant has offered to compensate the owners for the loss of any agricultural products in the area to be disturbed. He stated the line will not impact any historic or prehistoric sites, wildlife habitat, bodies of water, etcetera, and on August 23, 2000, the Colorado Public Utilities Commission ruled the project is necessary. Mr. Ogle stated 16 referral agencies reviewed this proposal, 14 responded with favorable comments or proposed conditions to be included in the Resolution. He stated staff has received comments from the public expressing concern regarding n 2002-2697 00 ; Y L Pco /!LC r) PL1624 HEARING CERTIFICATION -TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, INC. (USR#1392) PAGE 2 the alignment, placement of the transmission lines underground, health affects, noise, and loss of view corridors. Responding to Commissioners Geile and Masden, Mr. Ogle stated the application materials do not indicate there are other utilities in the area, the City of Dacono indicated no opposition, and the Town of Firestone elected to use town funds to bury the line within its jurisdiction. Responding to Chair Vaad, Mr. Ogle indicated the locations of the five areas under consideration today. Mr. Morrison referenced the various Code sections and Colorado Revised Statute references which must be considered as criteria for this type of application. Don Carroll, Department of Public Works, stated Weld County Road 13 is classified as a major arterial, and the applicant has been asked to secure additional right-of-way for a total of 140 feet. He further stated Weld County Road 26 is identified as a paved rural road which will require 60 feet of right-of-way for future buildout. He stated the transmission line is proposed to be offset from the section line by 63 feet, so there should not be a conflict. Mr. Carroll stated Weld County Road 11 is classified as an arterial, and Weld County Road 6 is classified as a collector status road in the future, with 40 feet of right-of-way on each side of the section line, and the offset of the proposed line should be sufficient. Char Davis, Department of Public Health and Environment, stated she has conducted research on electromagnet fields and studies show no conclusive evidence of negative effects on humans at this time. Responding to Chair Vaad, Ms. Davis stated she referenced the recent studies of the U.S. Institute of Health and the U.S. Academy of Science. Mark Murray represented the applicant and stated they did coordinate with other utility companies in the area, and this is a joint project of Tri-State and United Power. Mr. Murray stated Tri-State has been operating for 50 years, and are a non-profit electric cooperative. He displayed and discussed a Power Point presentation, marked Exhibit W. Bob Broderick, United Power General Manager, stated United Power is under contract to buy all of their power from Tri-State; however, United Power not part of this application. He stated approximately three years ago they conducted a long-range planning study,which showed the Tri- town area needed an upgraded transmission system to accommodate the significant amount of growth. Mr. Broderick stated this is an urgent situation and he encouraged the Board to consider the implications of not upgrading this line. He stated without this upgrade,they will have difficulties serving the customers in this area. He further stated that once this project is completed, they do not foresee the need for any additional lines in this area. Responding to Commissioner Geile, Mr. Broderick stated United Power owns the 34.5 kV transmission line,and eight miles will be removed and replaced with a 115 kV line. He further stated Tri-State will assume ownership of the 115 kV line upon approval of this application. Mr. Murray proceeded with the Power Point presentation, marked Exhibit W, for the record. Dr. Robert Pearson, Utility Practice CH2M Hill Vice President, stated there have been many studies, including those referenced by the Health staff, and he continued with the Power Point presentation, marked Exhibit W, referencing his background and experience in this project. He reviewed the concerns regarding electromagnetic fields, as well as reports made to Congress by the National Academy of Sciences and National Institute of Environmental Health Sciences. Dr. Pearson stated the general consensus is that there is no evidence of health threats posed by 2002-2697 PL1624 HEARING CERTIFICATION -TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, INC. (USR #1392) PAGE 3 electromagnetic fields. Responding to a previous question of Commissioner Geile, Mr. Pearson stated the lowest OSHA standard is 2,000 mG, and measurements taken directly under this type of line only measure 70 mG. He stated this proposal has been approved by the Public Utilities Commission, which requires Prude Avoidance Standards. Responding to Commissioner Jerke, Mr. Pearson stated the right-of-way is 75 feet wide, and the readings drop to 20 mG at the edge of the right-of-way. Mr. Murray summarized the proposal,and stated they have demonstrated a legitimate need for this utility. He stated they began this permitting process more than two years ago, there has been a significant amount of public involvement, and the proposal has already been approved by the Towns of Frederick and Firestone. Responding to Commissioners Geile and Long, Mr. Murray stated they intend to update the substations,which they anticipate will meet the future needs of the area for the next 10 to 20 years. Mr. Broderick stated this upgrade will triple the current capacity at each substation and put a second transformer at each location. He further stated the long-range planning for the next 20 years should carry them through the complete buildout in the area. Responding to Chair Vaad, Mr. Broderick stated they hired a company that does demographics in southern Denver to do the long-range study. He stated they went through the County and City Planning Departments to come up with an overview of this area in the next 20 years. In response to Commissioner Jerke, Steve Fauset represented the applicant and stated they have coal plants at various locations in the region, as well as hydroelectric contracts at numerous hydro plants on various drainage ways and rivers. He stated they also purchase power from a cooperative in North Dakota. Mr. Fauset stated each of these plants have high-voltage lines that carry power to load centers in the subject area. Through this network of power providers,Tri-State distributes power to various load centers along the front range, and under this proposal they will upgrade to an urban system. He stated many miles of transmission line have already been built just to get the power into this area, and the upgraded equipment in this area will be able to handle the power load. Responding to Commissioner Geile, Mr. Fauset stated they have coordinated and shared information with the Colorado Coordinated Planning Group to confirm their plans for this area so there is no duplicating. He stated the only other large transmission line in the region is associated with the Hudson Plant, and this proposal will be adequate for the next 10 to 20 years. Mr. Fauset stated the poles are for a single circuit with heavy conductors; they are incapable for having two circuits. Responding to Commissioner Jerke, Mr. Carroll stated there will be a bridge project on Weld County Road 13 over the St. Vrain River, as stated in his referral. He stated they are working to acquire the additional right-of-way necessary for the project, and the power line route is outside the future right-of-way, so there should be no conflict. In response to Chair Vaad, Mr. Ogle stated this proposal is in compliance with the recently revised Weld County Comprehensive Plan. Doris Pavlick, surrounding property owner,stated she lives in Weld County; however, her property is surrounded by municipal boundaries. Ms. Pavlick indicated the location of the Lakeview Village ski property directly west of the Rinn Valley Substation done in 1998. She stated development has continued to occur without the consideration of available power sources,and she is concerned with the applicant's proposal which differs from what they presented in the past. Ms. Pavlick stated they have a fill ditch on the south side of their property, which is also within the easement proposed for the power line; however,the applicant has proposed to line the ditch with concrete to eliminate the need for future maintenance. She further stated in 1989 they requested a permit for a water skiing recreation area on this property, and were denied twice by the tri-town municipalities because of 2002-2697 PL1624 HEARING CERTIFICATION - TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, INC. (USR#1392) PAGE 4 a housing development consisting of 20 homes on 80 acres. She stated they were encouraged to delay the plans, and now the easement for this transmission line will be in the way of their access if a subdivision is ever proposed for development in the future. Ms. Pavlick read a portion of the application which indicates the land fenced in for right-of-way and the switching stations will not be allowed for future use by others. She stated she offered a route to cross the north side of her property, which is 600 to 800 feet from any residence; however, that was declined and the proposed route is less than 70 feet from the back doors of numerous homes. Ms. Pavlick stated on Friday there were two surveyors on her property who were not authorized to be there, it will cost approximately $800,000 to bury the line, and the water table is too shallow. She stated they are opposed to this particular section of the route, unless it is buried at the applicant's expense. Ms. Pavlick also expressed concern with the hazard created for water foul which may get entangled in the high lines, and she submitted an aerial photograph, marked Exhibit X. Jill Haberkorn, surrounding property owner, stated she has submitted a neighborhood protest, marked Exhibit Q,for the area along Weld County Road 11 between roads 18 and 20. She stated there are 18 homes in the Eagle Valley neighborhood which are located within 75 feet of the proposed poles, which is very dangerous if one should fall. She expressed concern with broken lines, and stated this does not appear to be a prudent avoidance of homes as recommended by the Public Utilities Commission. Ms. Haberkorn submitted photos of the area, marked Exhibit Y, and stated once Weld County Road 11 is widened in 2004-2005 it will only be 12 feet from the back fence lines. She stated a majority of Frederick residents did vote to approve the special taxing district for funds to bury the line, and she also expressed concern regarding the health hazards created by electromagnetic fields. She further stated there are other routes which would effect fewer homes. Bob Charles, surrounding property owner, stated he represents five residents who own homes which will be located 70 feet from the proposed line, and there are more homes planned for this area. He stated that although power is needed for the Tri-town area, the preferred route is too densely populated and there is an alternate route which would only impact several lots. Mr. Charles stated it appears the alternate route was avoided by the applicant to avoid compensating three property owners. He stated if the line is not buried, the nearby residents should be compensated. Dan Miltersen, surrounding property owner, stated he was aware of the proposed lines when he purchased his home; however, he figured the vote to bury the lines would address his concerns. He stated he is opposed to aboveground lines and he wants them buried. Doug Edelfelt, surrounding property owner, expressed concern with the line being placed 50 to 70 feet from his back door. He stated there will be potential health risks, the line will have a negative visual impact in the area, and an alternate route has been offered and should be considered. Josh Samuel, surrounding property owner, stated there has been conflicting testimony from the applicant as to whether the lines will produce noise. He stated the line will be approximately 75 feet from his southern property line, and his barn and porch are within the electric field and will receive constant exposure. He stated the Board should consider requiring the lines to be buried, or compensate for displaced residents. He stated burying the lines will protect property values and residents. An alternate route should be considered if the lines are to remain above ground. Responding to Commissioner Geile, Mr. Samuel indicated the location of the proposed alternate 2002-2697 PL1624 HEARING CERTIFICATION - TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, INC. (USR#1392) PAGE 5 route. Jeri Appelhans, surrounding property owner, stated she found studies indicating there is a correlation between electromagnet fields and various forms of cancer, Leukemia,Alzheimers,and Multiple Sclerosis as a result of living near large power lines. She stated the applicant's pictures do not show the new homes in the area, and although the vote to bury the lines in Frederick has been overturned, he requested the Board require the applicant to bury the lines. Ms. Appelhans stated the above lines will provide constant exposure, and responding to Commissioner Long, she stated her research indicated there is a significant decrease in the effects if a transmission line is buried. Sue Wedel, surrounding property owner, stated there are studies indicating connections between childhood leukemia and electromagneticfields. She expressed concern with large poles in her view and decreased property values. Ms. Wedel stated it does not appear to be a prudent avoidance when the applicant intends to construct a line within a short distance of up to 1,000 feet at full buildout. She stated the tall poles will be unsafe, there will be adverse health effects to residents and their children, and although the Public Utilities Commission approved the project, it did not approve this route. Julie Miltersen,surrounding property owner,stated she is speaking on behalf of the other residents who live on Crane Court. She submitted a letter from Kelly Armour, marked Exhibit Z, and stated she supports the previous comments made regarding opposition to the proposed route of overhead lines and power poles. John Geels, President of Lakeview Village Association,stated the proposed lines will be closer than 500 feet from the lot he purchased. He expressed concern regarding electromagnetic fields generated by the lines crossing 75 feet of his property. He stated he purchased the parcel 15 years ago planning to build custom homes along the water ski property. Based on the property values of surrounding subdivisions, he estimated Lakeview Village to be worth$3 to$5 million. He stated property values will decrease because of the large power lines,and an alternate route needs to be established if the lines are not buried along the proposed route. Rich Haberkorn, surrounding property owner, expressed concern for his children and property value. He stated his view of the mountains will be damaged, and it does not appear the applicant plans to upgrade the distribution lines. Robert Pacotti, surrounding property owner, stated the proposed line will be 60 feet from his back door, adjacent to Weld County Road 11. He concurred with previous comments regarding safety, decreased property values, and preferred alternate routes. Mr. Pacotti stated he worked for Sturgeon Electric and in his experience he has found that this type of power line does make noise. He stated the poles will be on a ridge which may attract lightning, the easement is only 37.5 feet from the center line, and it does not appear there will be restrictions on upgrading the amount of voltage carried on this line. Responding to Commissioner Geile, Mr. Morrison stated he will research whether an additional hearing is required for an upgrade to the lines. Carrie Hassebrock, surrounding property owner, requested the line be rerouted. She expressed concern for the health of her children, as well as the 30 other elementary age children in the neighborhood, and stated the safety of the children should be a priority. 2002-2697 PL1624 HEARING CERTIFICATION -TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, INC. (USR#1392) PAGE 6 Heather August, surrounding property owner, stated she and her family would be affected if the alternative route is chosen. She stated there is no perfect route, and this proposed route has been determined to be the best option after 2.5 years of consideration. She stated there are many homes being built in the area, so this type of infrastructure is necessary; however, she feels the line should be buried in areas of sensitivity, with the cost borne by the power users. Mark Hassebrock, surrounding property owner, stated he concurs with the previous comments of concern. He stated along Weld County Road 13 the impact will be less; however, there are still cumulative health risks to be considered which may be caused by a consistent and very high frequency of power. He stated it appears the power line may also be located near an elementary school, and although the proof is not conclusive,the Board should be proactive in helping diminish the potential for harm. He stated there is adequate support for an alternate route. James Lawson,surrounding property owner,stated he lives adjacent to Weld County Road 11,and the proposed line will be approximately 75 feet from his back door. He stated running the lines underground may cost $1.2 to $1.5 million, and the aboveground option will be cheaper for the applicant. Regardless of cost, Mr. Lawson stated he does not feel the studies are objective because in this case the exposure will be consistent rather than intermittent. He further stated there have been recommendations presented to Congress requesting the OSHA standards be decreased to 2 mG. There being no further comments, Chair Vaad closed public testimony and recessing the hearing for ten minutes. Upon reconvening, Mr. Murray clarified that if the line were to be upgraded, the applicant would have to come back through the various agencies involved for approval. He stated the issue to bury the line between Roads 18 and 20 went to a public vote. A petition was circulated to allow more than one vote per household,which overturned the vote and the matter is being contested in court. He displayed a photograph of Weld County Road 11, facing north, showing a utility easement platted through the Town of Frederick. He stated they will use that easement to place the line. He also displayed an aerial map of the Lakeview property and the Rinn Valley substation. He stated United Power will eventually take down their line, so ultimately there will only be one line. He stated they did review the route proposed by the owners of the Lakeview property and elected not to pursue that option. He stated they also reviewed 26 alternatives and selected the route under consideration. Mr. Murray indicated the location of No Name Creek and the ski lake, and stated the Lakeview development was denied twice. Mr. Murray submitted the No Name Creek Subdivision Sales Information, marked Exhibit AA, as well as a letter which was sent to the Town of Frederick from No Name Creek, marked Exhibit BB. He expressed concern with delaying this project while more development takes place and more residents move in, which increases the conflict. In response to Commissioner Geile, Mr. Murray indicated the location of the undergrounding district for Frederick between Roads 18 and 20. Responding to Commissioner Jerke, Mr. Murray stated the Town of Firestone charges a $5,000 fee for all the homes being built, which will finance burying the line. In response to Commissioner Masden, Mr. Murray stated the line will pass over Weld County Road 13 and then go underground at the Firestone Trail. Mr. Murray displayed various photos of other areas with this type of transmission line near nice homes. He stated transmission lines do have impacts; however, there are many along the route who are not opposed. 2002-2697 PL1624 HEARING CERTIFICATION -TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, INC. (USR#1392) PAGE 7 Steve Faucet returned and stated noise is caused by frost or rain on the lines; however, under normal circumstances the noise is not audible and they also use noise minimizing hardware. He stated the distribution lines in the area have a limited capacity for distance and high voltages, so they use transmission lines to minimize the number of lines crossing an area. He further stated there is a National Electric Safety Code which determines the design and construction for public safety. Mr. Faucet stated the proposed poles will not accommodate an upgrade in voltage,and he reiterated they cannot upgrade without starting a new permitting and application process. Responding to Commissioner Geile, Mr. Faucet stated the applicant has joint ownership of the substations with United Power, and this upgrade will triple the existing capacity. He further stated United Power will install a parallel transformer bank to carry the power if one goes down. Responding to Chair Vaad, Mr. Faucet stated the proposed line will not make any more noise than the existing line, with the exception of noise caused by rain or snow. Dr. Pearson stated during a heavy rain the decibel level directly under the line is approximately 60, and at that level, the sound will likely be masked by the sound of the rain. During a normal storm the noise level would be 30 decibels. Ms. Davis stated this permit would allow for 70 decibels at the property boundary. Responding to Chair Vaad, Michael Barningham, Environmental Specialist for Tri-State,stated the Colorado Division of Fish and Wildlife has provided letters concurring that the project will not have significant impacts on the area wildlife. In response to Chair Vaad, Mr. Murray stated they are working with Mr. Samuel to come to an agreement for crossing his property. He further stated the surveyors are on a contract basis and they provide them with a right of entry; however, they did enter Ms. Pavlick's property in error and he apologized for the inconvenience. He stated the pole heights will vary, based on topography, to keep a consistent distance between the lines and the ground, and although the substation and area around the poles will be taken out of agricultural production, the remainder of the land can continue to be cultivated. He further stated the distance between the poles will vary from 250 to 400 feet for a total of six or less per quarter mile. Responding to Chair Vaad, Mr. Morrison stated the Board must reference the criteria listed in Section 21-2-40 in making a determination on this matter. (Switched to Tape #2002-37.) Responding to Commissioner Geile, Mr. Morrison stated the lawsuit has to deal with whether the undergrounding district was property formed or disputed; it does not have an effect on the established route. In response to Chair Vaad, Mr. Ogle stated staff feels the Conditions of Approval and Development Standards will adequately mitigate the concerns expressed. Mr.Carroll stated the issues regarding the right-of-way, bridge replacement, switching stations expansion and access, off-street parking during construction, and stormwater retention at the switching stations are all addressed in the Resolution. Chair Vaad reiterated that Section 21-3-340 must be referenced in the motion. Commissioner Geile commented item#1 has been addressed because the discussion regarding electromagnetic fields is inconclusive at this time, and letters from several Real Estate companies provided comments which were unsubstantiated regarding the decreased value of homes near this type of facility. Commissioner Geile further stated the increased amount of growth and use of technology has put pressure on the local utility companies to provide this added capacity to maintain private and industrial uses, which also addresses item #2. He further stated item #3 and #5 have been addressed because there does not appear to be a more suitable route,and the attached Conditions and Development Standards will adequately mitigate any adverse impacts as required by item#4. 2002-2697 PL1624 HEARING CERTIFICATION - TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, INC. (USR #1392) PAGE 8 Commissioner Geile stated the project complies with item#8, and#12 does not apply although the applicant will likely serve their own needs during construction. He stated there has been communication between the various utility agencies to ensure there is no need for another major facility under consideration in the near future. He further stated this application is for wooden poles with varying heights to get energy into the area, not just a pass through to take the power elsewhere. Commissioner Geile commented the Board must deal with the impacts of House Bill 1195, and a denial of this matter would result in a final determination by the Public Utilities Commission with no further input from the County. Commissioner Geile moved to approve the request of Tri-State Generation and Transmission Association, Inc., for a Site Specific Development Plan and Use by Special Review Permit#1392 for a Major Facility of a Public Utility (13.2-mile, 115 kV transmission line and two new switching stations) in the A(Agricultural)Zone District, based on the recommendation of the Planning staff, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Masden. Commissioner Jerke commented the applicant has met all of the criteria listed under Section 21-3-340, and will be bringing a major electrical provider into an area of high growth,which is preferable to the risk of electrical outages or rolling brownouts. He commented a property owner is always at some risk when they locate along major routes which typically have more commercial uses and utilities, therefore, he supports the motion. Commissioner Long stated it appears the applicant has meet all of the criteria of Section 21-3-340, and he appreciates all of the testimony provided today. He stated this route will result in a reduced amount of infrastructure and materials, which would be less visually pleasing. Commissioner Masden commented he supports the motion. He stated this is not the type of use that most people want near their home; however, this has been under consideration for 2.5 years in an effort to find the best route, and to work with the surrounding municipalities and residents. He further stated the natural alignment and the socio-economic alignment will be enhanced and protected in an effort to provide proper electrical services. He stated ultimately this will help protect land values and keep businesses in the area. He stated items #4 and #6 have been met. Chair Vaad stated he appreciates the testimony which indicates all reasonable routes have been assessed and the proposed route represents the best interest of the residents of the County. He stated the proposal is compatible with the Comprehensive Plan,as well as item#22 by meeting the need of an increasing population. He stated it is not being put in to draw more businesses, rather, it is needed to serve what's here now.
