To Whom It May Concern:
This letter is being written in objection to the above
mentioned case of Highland Dairy expanding their facilities .
However, it appears that they have already done that to some
extent by building more pens and a huge barn.
While we feel it is good that people have a right to
make a living as they choose , we have several concerns about
the expansion of this dairy. They are as follows :
1 . First and of most concern is the water situation.
We live East of this dairy and we and it have lived
comfortably together for over 27 years ; however, we
have shallow wells from Weld County Road 41 north
of WCR 92 . We use these well not only for outdoor
use but also for DRINKING WATER. We have no other
source . A herd of 10,000 Cattle would certainly
present the possibility of contaminating our drink-
ing eater.
2. Secondly, since the dairy has changed ownership, we
have had a tremendous increase in flies . Last year
we had difficulty even painting the trim on the house
because of biting flies . Also for an outdoor
gathering, we had to spray everything, every day
for nearly 2 weeks in order to enjoy and evening
with friends . Not only is this a comfort issue
but also a health issue .
3. Thirdly is the odor. We understand that farming
and the cattle business can be a smelly occupation,
(both of us were raised on farms) , BUT a herd of
10,000 cows will certainly be overpowering. It
also has become much worse this past year with the
new ownership.
4 . Fourth and lastly, we have lived here almost 28
years. In that time we have improved our property
and it value has increased greatly since we bought
it . We feel the expansion of this dairy will make
the value of our property plummet thus wiping out
years of hard work and money we will need for
retirement which is not that far away.

To Whom It May Concern:
It has come to our attention that the above-mentioned Dairy is seeking a permit for a Site-
specific development plan. We understand that this is zoned Agricultural, but we have
the following concerns.
1. Our drinking water comes from a domestic shallow well, and is our only
source of water. Due to the size of the above operation, we are concerned that
the animal waste will leach into the water table and contaminate our drinking
water, which will no longer make it potable.
2. Is the area where the above-mentioned dairy is seeking to expand located in a
natural flood plain? If so, will the dairy have sufficient plans for control and
containment? Will the lagoons be lined?
3. The request for expansion states that there will be six mobile homes as an
accessory to the farm. Will the septic and leach system based on the number
of bedrooms in the six mobile homes be adequate? Will the necessary size of
this leach system for these six mobile homes affect the potability of the
groundwater?
4. Will the above-mentioned dairy be separating the solid and liquid waste? If
so, will the number of acres be adequate to spread the solid waste without it
leaching into the groundwater system and adversely affecting the potability of
the water?
5. Are there sufficient plans for insect control?
6. Is there corporate ownership of the above-mentioned dairy? If so, who will be
accountable for problems as they arise?
7. We are concerned about our property values due to the above-mentioned
dairy. We feel that our property will fail to increase in value and in reality
will probably lose value.

Dear Planning Commission:
We are writing in support of the purposed Highland Dairy expansion located northeast of
Pierce. Due to changes in the area, employment has dwindled. Farming does not require
near the labor that it once did and businesses in the community have either closed or they
do not need the number of employees as they use to.
The economics of the dairy are thus two fold; one being jobs and two a market for the
feed crops grown in the northern region. The demand for feed for feedlots has changed
significantly. Both of these have a high impact for this farming community, the dairy
would be a very welcome asset.

Re: Well Augmentation
Dear Eldon:
This letter is to confirm that you have requested and I have agreed to provide legal
services for the adjudication of a plan of augmentation to provide for a legal water supply
for your dairy.
In turn I have retained the engineering firm of Helton and Williamson to provide the
necessary hydrological and water right analysis that will be necessary to prepare and
adjudicate your augmentation plan. Duane Helton is an experienced water engineer and
is familiar with the Water Supply and Storage system in that he was the engineer that
assisted the Town of Johnstown in adjudication an augmentation plan for the town's
water supply using Water Supply as the replacement water source.
Absent some presently unknown physical or legal impediment to the delivery of water to
the vicinity of your well(s) from the Water Supply and Storage system I am not aware of
any issue that would prevent you from ultimately obtaining a plan for augmentation that
will provide a legal water supply for your dairy.
As you are aware,the continued pumping of tributary wells in the South Platte Basin is in
considerable flux. Rules and Regulations for wells in the South Platte basin have been
promulgated by the State Engineer and are now pending in Water Court. These Rules
may or may not permit the GASP and Central Water Conservancy District's plans to
continue in the year 2003. Notwithstanding of whether GASP is approved for 2003, HB
1414 provides a separate basis for the continued use of your wells while your Water
Court application is pending.
HB 1414 was passed by the Colorado legislature this past spring. Section 4 of that bill
provides legal authority to the State Engineer to approve temporary supply plans for
tributary wells where there is a pending application in the Water Court. This authority is
i^� independent of the now pending general Rules promulgated by the State Engineer which
have as their main aim the continued administrative approval of general water supply
plans without ever obtaining a Water Court decree.
A water supply plan based upon a private augmentation decree, as we are proposing for
your dairy, will not be affected by whether the pending Rules and Regulations of the
State Engineer are approved or not. Nor will your water supply plan be affected by the
approval or disapproval of GASP or Central.
On the basis that you presently have a water supply that will provide a renewable source
of replacement water for water withdrawn from your tributary wells and contemplating
that HB 1414 provides a legal basis for continued pumping while the Water Court
application is pending it is my opinion that you will have both an interim and permanent
water su r • for your dairy without interruption.
