Approved with Conditions
The Weld County Department of Planning Services has determined through administrative review that the
standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. The applicant has proposed a well as the source of adequate water for Lot B. Property owners are
advised that the quality of water available for usage may be limited to specific uses, i.e.,"Domestic Use
Only," etc. Because each situation is unique, the Department of Planning Services encourages
property owners to contact the Office of the State Engineer, Division of Water Resources (1313
Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each
individual situation.

3. Topographic or physical features of the proposed Lot A, such as ravines, ditches, streams etc. may
limit the area available for a new or replacement septic system. Prior to recording the plat, the Weld
County Department of Public Health and Environment recommends that the applicant review the Weld
County Code pertaining to septic systems to assure that any installed septic system will comply with
all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to
allow the installation of a septic system, the lot may need to be enlarged.
4. Prior to recording the plat:
/A. The plat shall be titled: Recorded Exemption No. 0709-36-4 RE-3281
C-g. Lot A shall use the existing agricultural access point as no additional accesses shall be granted.
C. Lot B shall use the existing residential access point as no additional accesses shall be granted.
/D. Weld County Road 74 is designated on the Weld County Transportation Plan Map as a arterial
status road, which requires 100 feet of right-of-way at full build out. There is presently 60 feet
of right-of-way.A total of 50 feet from the centerline of Weld County Road 74 shall be delineated
on the plat as right-of-way reservation for future expansion Weld County Road 74. This road
is maintained by Weld County.
V6. Weld County Road 49 is designated on the Weld County Transportation Plan Map as a local
gravel road,which requires 60 feet of right-of-way at full build out.There is presently 60 feet of
right-of-way. A total of 30 feet from the centerline of Weld County Road 49 shall be delineated
on the plat as right-of-way. This road is maintained by Weld County.
LA. The applicant shall address the requirements of Weld County School District RE-2 as stated in
the referral response received March 14, 2002. Evidence of such shall be submitted in writing
to the Weld County Department of Planning Services.
/G. The West Greeley Soil Conservation District has provided information regarding the soils on the
site.The applicant shall submit written documentation that they have reviewed the information
and will use it to positively manage on site soils.
H. The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
V I. The applicant shall establish one of the houses on Lot B as a non conforming structure. Written
evidence shall be submitted to the Department of Planning Services.
J. The following notes shall be placed on the plat:
✓I1 All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line./ No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
v2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
/ Recorded Exemption number.
I41 Prior to the release of building permits, the applicant shall submit evidence to the
VVV Department of Planning Services that Lot A has an adequate water supply of sufficient
quality, quantity and dependability.
vgi Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
Prior to the release of building permits for any structure exceeding 3,600 square feet,the
applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code.
- Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
inoxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest, and gravel roads;odor from animal confinement,silage, and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
�. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County
V Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days
from the date the Administrative Review was signed. The applicant shall be responsible for paying
the recording fee.
6. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles,Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to maps@co.weld.co.us.
7. The Weld County Department of Planning Staffs approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

property currently owned by Thomas L. Karlberg and Kimberly C. Karlberg, the applicant.
Subject land is located in the SE 1/4 SE 1/4 Section 36, Township 7 North, Range 65 West of
the 6th P.M., Weld County, Colorado, aka Lot A RE1362.
2. Included is the original complete Recorded Exemption Questionnaire(plus nine copies).
3. Attached is an 8 1/2" x 11" map(plus nine copies) drawn to include the following items:

6. North Weld County Water District provides service along WCR 74 and WCR 49 adjacent to
subject property. Attached is a letter showing availability of service. There is a domestic well
used for the yards and the existing houses on this property.
7. There are two existing homes with operating septic systems. A septic system permit will
be required for the new lot in this application at such a time a building permit is requested.
8. The original Certificate of Conveyance form and attachements are included in the
original packet.
9. A copy of the paid tax receipt is attaced for year 2000. Year 2001 is not yet due but
will be paid prior to recording the Plat.
10. A personal check for $990 from applicant is included as payment of the application fee.
11. The$10 recorded exemption plat (mylar) recording fee will be submitted at the time
the mylar is submitted for recording. The mylar will be prepared according to Section
11-7 of the Subdivision Ordinance.

RECORDED EXEMPTION QUESTIONNAIRE
1. a. Domestic Water: The attached North Weld County Water District letter of
Service explains the water supply source (availability) for proposed Lot A. The sufficient quality,
quantity and dependability have long-time experience in this area. Proposed Lot B will continue
to use the historically used existing domestic well.
b. Irrigation Water: None. Neither lot is nor will be irrigated by any means other
than the existing domestic well as in the past.
2. Sewage Disposal: Septic disposal systems approved by the Weld County Health
Department will be required with the building permit for proposed Lot A (smaller lot) when
applicable. Owners of that lot shall meet those requirements at the time of application. The soil
of the respective lots is satisfactory for individual septic disposal systems. A septic permit is not
appropriate at this time for the size of the house, its bedrooms, bathrooms, and the number of
people living therein are unknown. A statement on the recorded plat shall state that an ISDS is
required with any building permit.
Exiting ISDS septic systems are in place and operating for the proposed Lot B (the existing
houses).
3. Present Use of Property: The larger parcel has historically been a rural residence. The
smaller parcel has been used as dry pasture.
4. Reason for Proposed Recorded Exemption: The primary reason for this application is
the applicant needs to reduce his cattle debt. The split and subsequent sale will not materially
effect their existing site but will substantially improve their financial welfare.
5. Description of Lots: The larger portion comprises of 5+/- acres or all of the Lot A RE
1362 which includes the farmstead and the land in proposed Lot B. The smaller lot will be
approximately 3+/- acres comprising of the land southwest of the buildings and in proposed Lot
A.
6. Unique Physical Characteristics: The property lies rather flat with no historic irrigation
water. The property is a rural residence. This property is 6 miles east from the town of Eaton
and 1 mile west from the town of Galeton. It is the applicants primary residence.
7. Structure Compliance: There are numerous existing structures. Structures do comply
with Weld County setback and offset requirements for agriculturally zoned districts and building
codes at the time of their construction. The size and shape of the proposed lots allow for
appropriate structure location.
8. Conservation Easement: The applicant does not believe a formal conservation easement
on either parcel is appropriate for agricultural zoned district rural residences. A change to other
uses will require an application for such change and Weld county has approval/denial control at
that time. Applicant cannot envision at this time why any use other than agriculture rural
residence would occur. Thus agriculture rural residences will continue.

9. Building Envelope: A building envelope is not identified in the proposed lot A because
of the proposed size and shape. The setback will primarily determine the future location. The
proposed Lot B has all the existing buildings.
10. Comprehensive Plan: The Weld County Comprehensive Plan is the applicable
document. This recorded exemption application is the process allowable for exception to the
Weld County Subdivision Ordinance when an approved subdivision is not present. This
application is complete. It satisfies the application criteria.
11. Surrounding Land Use: The proposed uses of this application are compatible with
existing land uses. Land to the south, north, west and east has irrigated farmland and rural
residences. The smaller parcel will be a rural residence the same as numerous farms in the area.
The town of Eaton is 6 miles to the west from subject property. The nearest rural residence is
across WCR 74 south of subject property. Thus no significant additional impact.
12. Agriculture District Intent: The agricultural district is intended to preserve prime
farmland. This application requests that only two acres of waste be removed from the existing lot
to reduce debt. It allows the low capability land with high labor costs to be used for rural housing
(allowable in agriculture zone). The irrigated farmland (adjacent to the application lands) will
continue to be the open space of the neighborhood.
13. Efficient and Orderly Development:
a. This application through the recorded exemption process restricts development. The
location has the least possible impact to the land; therefore, the most orderly and integrated
development.
b. This application promotes the health, safety and general welfare of the applicant and
allows a desiring family to enjoy a rural residence. Safe water, sewer and quality of life is granted
while allowing the owner to remove a headache associated with caring for unnecessary
non-irrigated land and expecially to reduce their cattle debt.
c. This application is 6 miles east of the Town of Eaton, and 1.1 miles west of the Town
of Galeton, the closest towns. By the nature of this recorded exemption application, Weld
County Planning is controlling the impact to productive farmland while allowing for rural
residential demand.
d. This application is not within the Eaton or Galeton planning area. Applicant if
requested, will assist Weld County in coordinating plans with these towns.
e. This application is not a subdivision as such, but is well planned to least impact the
citizens of Weld County and the farming community.
f. The public is safe guarded by potable water, ISDS septic system, quality of life and the
financial stability of the applicant and generally a better cared for property.
g. This application complies in every detail to the very thorough recorded exemption
process of the subdivision regulations of Weld County. It provides a uniform procedure and
standard for rural residences in agriculture-zoned areas.
h. None of the applicant's land is wooded; therefore, fire related to wooded terrain is not
applicable.
i. This application maximizes the preservation of productive agricultural land. At the
present time no irrigated land is take out of production.
j. There has been no irrigation water historically associated with this tract.
k. The historic vegetation patterns will remain for proposed Lot B and future landscaping
will enhance any future rural residence yard. Thus, the original farmstead will be maintained and
the proposed Lot A will be enhanced by a new rural residence being cared for by the future
owner.
1. The relatively flat surface of the existing farmstead will be maintained. Proposed Lot A
is also relatively flat and is adaptable to nearly any landscaping plan.
m. Proposed Lot A and Lot B run-off, if any, is adjacent to WCR 74 and WCR 49 barrow
pits and should not be any different than the historic flow. The historic return flow of irrigation or
rain water will not be changed.
n. Proposed Lot A has a good site and soil type for building construction.
o. The relatively flat terrain is not troubled with landslides or mudflows. There are no
known geologic hazards.
p. Space allocated for school and parks to serve this population is insignificant and not
applicable. The open space nature of this application more the compensates.

COMMENTS:
WCR 74 is designated on the Transportation Plan Map as an arterial status road, which requires
a 100-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code,
Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-
way line.
WCR 49 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-
foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained
by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The applicant shall utilize the existing residential access to this parcel. (Lot B)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the applicant/landowner
shall be responsible for controlling the noxious weeds.
No new private residential accesses shall be allowed onto roadways classified as arterial. A parcel
Hshall share the access point already in existence. Access to new parcels may be obtained by a
mutual reciprocal easement across the involved parcels to connect with existing points of access

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system(s)
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
Additionally, please note the following:
1) This application is proposing a well as its source of water. The applicant should
be made aware that groundwater may not meet all drinking water standards as
defined by the Colorado Department of Public Health and Environment. We
strongly encourage the applicant to test their drinking water periodically over
time.
2) Topographic or physical features of the proposed lot, such as ravines, ditches,
streams, etc. may limit the area available for a new or replacement septic
system. Prior to recording the plat the Division recommends that the applicant
review the County Code pertaining to Septic Systems to assure that any installed
septic system will comply with all setback requirements found in the Code. In the
event the proposed lot is not of sufficient size to allow the installation of a septic
system the lot may be need to be enlarged.

a process in place addressing growth within the District.
The School District has adopted a methodology to determine a cash-in-lieu

This letter is in response to your inquiry regarding water service to the following described property,
In a portion of the
SE 1/4 of Section 36,T7N,R65W of the 6th Prime Meridian
1. Water Service is presently being provided to the above mentioned property.
2.North Weld County Water District is able and intends to provide additional water service(s)to the above mentioned
property,provided all requirements of the District are satisfied.Before a water tap may be purchased,the applicant
must provide a copy of a Warranty Deed,a Physical Address and this letter. The applicant must also bring a copy
of a surveyed plat of the property if there is a recorded exemption.
If contracts have not been completed with North Weld County Water District within one year from the date of this
letter,this letter shall become null and void. The Tap Fees quoted below,shall be valid for ten(10)business days from
the date the applicant receives this letter. After ten days,the costs will be subject to the current cost established by the
District.
TAP FEES INSTALLATION COST ESTIMATE
Raw Water for an Acre-Foot Unit(AFU) $10,000 Meter Set/Road Bore
Base Portion of Plant Investment Fee $6,000 Range: $1,500 to $3,500
Distance Portion of Plant Investment Fee $4,750 At Cost TBD

After the water tap has been purchased(Raw Water AFU&Plant Investment Fee)the applicant has one year in which
to have the meter set. The District requires 45 days prior notice to setting a meter. If the meter has not been set within
one year from the purchase of such meter,the District shall refund the applicant 75%of the purchase price that was
paid by the applicant.
Water tap/service shall be placed on the physical property, defined by a legal description. In case of a Recorded
Exemption,the water tap shall only serve the parcel that the water tap is located on. Service shall NOT cross the legal
description of one parcel to serve the other parcel.
The District recommends that anticipated water usage be purchased through the District. The District guarantees
treatment and delivery of water purchased. All rental water and water that is delivered with surcharge is subject to
water availability and will be issued on a first come-first serve basis and is not guaranteed to be available. The
District requires that 1 Acre-Foot Unit(AFU)is purchased. With 1 AFU purchased any usage beyond 228,000 gallons
will be in surcharge.
The Plant Investment Fee shown above pays for the infrastructure required to deliver 1 AFU(228,000 gallons). If
usage exceeds the number of Plant Investments that were purchased,an additional surcharge will be applied to
your account. Plant Investments maybe purchased to increase the amount of water to be delivered and avoid the
surcharge.

COMMENTS: The septic system is inadequate. The tank is undersized by 500 gallons and
the leachfield is undersized by 425 square feet. Recommend obtaining a
repair permit and increasing tank capacity to 1000 gallons and field size
to 650 square feet.
