Approved with Conditions The Weld County Department of Planning Services has determined through an administrative review that the standards of Section 24-8-40.B.1 through 24-8-40.8.6 of the Weld Count/Code have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the poiicies of Weld County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.)regulations. 2. The Applicant has proposed a well as the source of adequate water for Lot B. Property owners are advised that the quantity of water available for usage may be limited to specific uses, i.e.,"Domestic Use Only,"etc. Because each situation is unique, the Department of Planning Services encourages property owners to contact the Office of the State Engineer, Division of Water Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each individual situation. , 00d-33 57 AVE 3331 3. Prior to recording the plat: A. The plat shall designate the building envelope as approved by Recorded Exemption 3337 B. The plat shall be titled:Amended Recorded Exemption No. 0709-09-3 AMRE-3337 C. Lot B shall use the existing agricultural /oil and gas/ditch road access points necessary for agricultural operations as no additional accesses shall be granted. D. All approved accesses shall be clearly shown on the plat.The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP)is Weld County's minimum size. If the applicant chooses to place a larger culvert please contact the Weld County Department of Public Works to adequately size the culvert. E. Weld County Road 41 is designated on the Weld County Transportation Plan Map as a section line access. This road is NOT maintained by Weld County. F. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. 2;) Any future structures or uses on site must obtain the appropriate zo',inc and building permits. 3) All structures requiring building permits shall be located within the designated building envelope. 4) All construction or improvements occurring in the flood plain as delineated on Federal Emergency Management Agency FIRM Community Panel Map 0802660480 C dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article v, Division 3 of the Weld County Code. 5) The installation of any septic system within the 100-year flood plain shall comply with the Weld County I.S.D.S.flood plain policy.In accordance with the State of Colorado I.S.D.S. Regulations, no septic system shall be installed with in the floodway. 6) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Amended Recorded Exemption number. 7) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot B has an adequate water supply of sufficient quality, quantity and dependability. 8) Potential purchasers should be aware that Lot B may not be eligible for a domestic well permit which allows for outside irrigation and/or the watering of stock animals. The State Division of Water Resources issues all well permits. 9) Potential purchasers should be aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically there after. 10) Potential purchasers should be aware that approval of this Recorded Exemption does not guarantee that well permits will be issued for the lots. Any lot may be deemed non- buildable if the lot owner is unable to obtain a well permit.The State Division of Water Resources issues all well permits. 11) Prior to the release of bui!ding permits for any structure exceeding 3,600 square feet,the applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code. 12) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15,Articles I and II of the Weld County Code. 13) Any disturbance of wetlands shall require the applicant to contact the Army Corps of Engineers for permits pursuant to Section 404 of the Clean Water Act. 14) Potential Purchasers are hereby notified that a confined animal feeding operation is located directly east of the intersection of Weld County Roads SH 14 and WCR 43. Off-site impacts that may be encountered include noise from trucks, tractors and equipment; dust from animal pens and odors from animal confinement, silage, and manure. 15) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in• the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens,field work, harvest, and gravel roads;odor from animal confinement,silage, and manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102,C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles In size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement,ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their-children. 4. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with ail other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60)days from the date the Administrative Review was signed. Domestic Water: The proposed Lot B, as amended qualifies for a 35 +Acre Domestic well which is not needed at the present time and therefore a well permit has not been submitted. b. Irrigation Water: Lot B as amended has been historically irrigated. All of the historic irrigation water will remain with the amended Lot B. 2. Sewage Disposal: Septic disposal systems approved by the Weld County Health Department will be required with the building permit for the amended lot B when applicable. Owner of that lot shall meet these requirements at the time of application. The soil is satisfactory for individual septic disposal systems. A septic permit is not appropriate at this time for the size of the house, its bedrooms, bathrooms, and number of people living therein are unknown. A statement on the recorded plat shall state that an ISDS is required with any building permit. 3. Present Use of Property: The existing Lot B has historically been an irrigated farm. The source of irrigation water is the Eaton Ditch and irrigation wells. 4. Reason for Proposed Amended Recorded Exemption: The primary reason for this application is that the applicant desires to locate his residence in the NE corner of Lot B of RE-3319 which is adjacent to the north. A legal access to Colorado Highway 14 is required by Weld County Department of Planning. This amendment excludes the 30 foot access along the east line of the S 1/2 SW'A. Thus Lot B of RE-3337 shall be reduced by 30 feet through this amendment process. 5. Description of Amended Lot: The Lot B, after amended, will be 74.3± acres or all of Lot B of RE-3337 less the 30 foot along the east side of the S '/z SW %4, which became part of amended RE-3319. 6. Unique Physical Characteristics: The property lies rather flat with irrigation water being provided. The property has historically been row irrigated. This property is 4 miles east of the town of Ault. A large portion of Lot B of RE-3337 is in a flood plain and therefore the NW corner of Lot B is ideal for a residence(building envelope). 7. Structure Compliance: There are no existing structures on either Lot B of RE-3319 or Lot B of RE-3337. Future structures must comply with Weld County setback and offset requirements for agriculturally zoned districts and building codes. The size and shape of the lots and the designated building envelopes allow for appropriate structure location. 8. Conservation Easement: The applicant does not believe a formal conservation easement on either parcel is appropriate for the agricultural zoned district. A change to other uses will require an application for such change and Weld County has approval/denial control at that time. Applicant cannot envision at this time why any use other than agricultural would occur. Thus agriculture(irrigated farming in this case)will continue. 9. Building Envelope: A building envelope is identified in NW corner of property. Because of the flood plain over a large portion of Lot B and the access along the west side, the subject location is the only site. 10. Comprehensive Plan: Weld County Comprehensive Plan is the applicable document. This amended recorded exemption application is the process allowable for exception to the Weld County Subdivision Ordinance when an approved subdivision is not present. This application is complete. It satisfies the application criteria. 11. Surrounding Land Use: The proposed uses of this application are compatible with existing land uses. Land to the south, north, west and east is irrigated farmland and rural residences. The amendment will not change any of this. The town of Ault is 4 miles west from subject property. The nearest rural residence, other than Lot A of RE-3319, is over 1/4 mile of subject property. Thus no significant additional impact.. 12. Agriculture District Intent: The agricultural district is intended to preserve prime farmland. This application requests that the existing road be added to Lot B of RE-3319 to provide access to Highway 14. This access removal does not affect the production of amended Lot B of this application. No farm land will be removed. It allows the low capability land(field road)to be used for a building envelope access. The irrigated farmland will continue to be the open space of the neighborhood. 13. Efficient and Orderly Development: a. This application through the amended recorded exemption process restricted development. The location of the building envelope has the least possible impact to the land; therefore,the most orderly and integrated development. b. This application promotes the health, safety and general welfare of the applicant and allows a desiring family to enjoy a rural residence in a safe location and access. Safe water and sewer and quality of life is granted while allowing the owner of Lot B of RE-3319 to remove a headache associated with access. c. This application is 4 miles east of the Town of Ault, the closest town. By the nature of this recorded exemption application, Weld County Planning is controlling the impact to productive farmland while allowing for rural residential demand. The town of Ault approved recorded exemptions RE-3319 and RE-3337. d. This application is not within the Town of Ault planning area. Applicant cooperated with Weld County and the Town of Ault during the approval process for RE-3319 and RD-3337 and has settled with the Eaton School District for their fee requirement as submitted evidence with the final mylars for RE-3319 and RE-3337. e. This application is not a subdivision as such, but is well planned to least impact the citizens of Weld County and the farming community and best protect the owner of Lot B of RE-3319. 1. The public is safe guarded by potable water, ISDS septic system, quality of life and the financial stability of the applicant, long term access and the generally better cared for property. g. This application complies in every detail to the very thorough recorded exemption and amended recorded exemption process of the subdivision regulations of Weld County. It provides a uniform procedure and standard for rural residences in agriculture-zoned areas. h. None of the applicants' land is wooded;therefore, fire related to wooded terrain is not applicable. i. This application maximizes the preservation of productive agricultural land. This Amended Recorded Exemption process has taken NO land out of production. j. The irrigation water historically associated with this farm is allocated to the historically irrigated lands on the amended Lot B. The existing delivery systems will remain intact. k. The historic vegetation patterns will remain for amended Lot B and future landscaping will enhance any future rural residence yard. Thus, the irrigated farmland will be maintained. [. The relatively flat surface will be maintained in normal irrigated farmland cultural practices in compliance with NCR office. The designated building envelope is also relatively flat and is adaptable to nearly any landscaping plan. m. The irrigated farmland tillage practices of crop residue and deep tillage on nearly flat land, maximizes flood control.
