Dear Weld County Planning Board:
I, along with my wife and two young children, am a resident of Weld County. We live in
our new home located just north of the intersection of WCR 11 & WCR 18 in the town of
Frederick. I learned of the board meeting on September 17 that would include the final
hearing for Tri-State Generation's proposed high-voltage transmission line project. The
proposed route of the transmission line would pass overhead just feet away from our back
yard. We feel as though the negative effects in regard to health and property values
would be detrimental to our family and hundreds of other families in the three sub-
divisions that the proposed line would pass directly through.
I am writing to you to respectfully request that the Weld County Planning Board
Meeting/Tri-State Hearing be opened to the public. I feel that it is imperative that this
Board has the opportunity to hear from the residents that will be negatively affected by
the poor proposed route of the high-voltage transmission line. I feel as though the
selection of this route was plagued with unfairness, unlawfulness, and complete
irresponsibility of the Town of Frederick and Tri-State Generation. I sincerely hope that
Weld County will take responsible and reasonable actions to only approve a route that is
in the best interest of its residents. Again, I respectfully ask that this Board open the
meeting/hearing to the public so that the public may voice their concerns. Thank you for
your time and attention.

NOTICE TO MINERAL ESTATE OWNERS
Please be advised, a public hearing before the Weld County Planning
Commission will be held on September 17, 2002, at 1:30 PM. The purpose
of such hearing is to consider a Request for A Site Specific Development
Plan and a Special Review Permit for a Major Facility of a Public Utility.
The hearing will be held in Room 210 at the Weld County Planning
Department which is located at 1555 N. 17th Avenue, Greeley, Colorado.
FURTHER NOTICE, a public hearing will be held in the Chambers of
the Board of County Commissioners of Weld County, Colorado, Weld
County Centennial Center, 915 10th Street, First Floor, Greeley, Colorado on
September 25, 2002 at 10:00 AM. The purpose of such hearing is to
consider a Request for A Site Specific Development Plan and a Special
Review Peiiuit for a Major Facility of a Public Utility.
The proposed project is a 13.2 mile 115 kV transmission line and two
new switching stations. The proposed project is located on various parcels
of land described as parts of Sections 5, 6, 7 & 18, T2N, R67W; parts of
Sections 1, 12, 13, 14, 23, 24, 25, 26, 35 & 36, T2N, R68W; parts of
Sections 1, 2,11, 12,13, 14, 23, 24, 25 & 26, T1N, R68W; parts of Sections
30, 31, 32, T3N, R67W; and parts of Sections 25, 36, T3N, R68W of the 6th
P.M., Weld County, Colorado.
The applicant is Tri-State Generation and Transmission Association,

Planning Commission Hearing Date
The Department of Planning Services has received a facsimile letter from Tri-State Generation
and Transmission, Inc., dated September 16, 2002 requesting an additional period of 30 days
to meet with some of the affected landowners along the preferred route, and to investigate two
alternative routes that were discussed with these property owners.
The first continuance was set to expire on Tuesday October 1, 2002. This continuance will
expire on Friday November 1, 2002.
Given this timetable, the Department of Planning Services requests that the application be
placed on the October 15, 2002 hearing docket for review by the Planning Commission.
The applicant has requested a pre-advertisement date with the Board of County
Commissioners. The amended date for this hearing is October 30, 2002.

Merit Energy Company is an oil and gas producer and it owns oil and gas wells
and undrilled locations in Weld County, Colorado among other Counties in
Colorado. We are checking with the Merit land department to determine if the
Sections in the legal description include Merit drill sites, but, in general,
drill site locations are 1. an 800 foot square in the center of each 160 acre
quarter section and 2. a 400 foot square in the center of each 40 acre
quarter quarter section. See Rule 318 a of the rules and regulations of the
Colorado Oil and Gas Conservation Commission. From the Location description
in the Notice, it looks as though the transmission line and the switching
stations are to be located in WCR rights of way, but the route should be
checked closely by you to ensure that the same does not infringe on possible

Please be advised, a public hearing before the Weld County Planning
Commission will be held on October 15, 2002, at 1:30 PM. The purpose of
such hearing is to consider a Request for A Site Specific Development Plan

The Special Meeting of the Board of Trustees of the Town of Firestone, CO was held on
Thursday, September 5, 2002 at the Firestone Town Hall. Mayor Mike Simone called the
meeting to order at 7:30 p.m.
The Pledge of Allegiance was said.

A Trophy was presented to the Town of Firestone for having the First Place Float at Fiesta Days.
Tri State Generation
Mayor Simone opened the Tri-Sate Public Hearing at 7:40 p.m. Mr. Mark Murray was sworn in
by Mayor Simone. Mr. Murray stated that Tri-State was formed in 1952 and is non-profit
wholesale power supply cooperation. He explained that this hearing is for approval of an
upgrade of electrical service to a 115 KV system that will connect from Longmont to Brighton.
It will be a loop service that will replace the existing service, and is proposed to be
approximately 5 ft. 3 inches underground from the Rinn Valley Sub-station. He stated that an
informational meeting was held on August 15, 2002 and the Planning Commission had seen a
presentation on August 21, 2002.
Mr. Mike Braningham was sworn in by Mayor Simone. Mr. Braningham stated that the goal for
Tri-State was to consider as many possibilities as possible and acceptable to the Tri-Towns. He
discussed several different routes that the line could be taken; I-25 to Del Camino Sub-Station or
Rinn Sub-Station across to the St. Vrain River, the I-25 Industrial Corridor, or Godding Hollow.
He explained the different problems with some of these routes. 1) The I-25 Industrial Corridor

area is Sub-Stations that are in fixed locations and overhead T-lines are not permitted along the I-
25 right-of-way. 2) Godding Hollow on either side is in a flood plain and cuts through cross
roads of the PUD of the Shores and Eagle Crest. 3) North out of Rinn Valley Sub-Station the
river meanders and the line would cross the river three times. 4) North along WCR 13 is not
favored by the Firestone Board of Trustees and has insufficient space available between WCR 13
and the existing subdivisions. 5) West out of Rinn Valley Sub-Station to WCR 11 then to WCR
22 or WCR 24 then East to WCR 13 is too close to residences along WCR 22.
Mr. Murray stated that there would be little or no damage to property values due to the
placement of the lines.
Mr. Bob Pearson was sworn in by Mayor Simone. Mr. Pearson talked about EMF health. He
showed a book of National Academy of Sciences and National Industry of Environmental health
Sciences, both being from the federal government. He said that no conclusive evidence has been
shown as a health threat from exposure to power frequency electric and magnetic fields. He
showed a slide of different magnetic fields and stated that the peak of overhead and underground
are about the same except the underground has a narrower profile.
Mr. Murray said that the upgrading of the line is to provide power to the Tri-town area.
Staff Comments
Planner Bruce Nickerson gave a briefing on the history and showed slides of Conditional Use
Permit#1041 and the Firestone Comprehensive Plan.
Attorney Sam Light spoke of the PUC (Public Utility Commission) Rule 18. He stated that each
year the PUC files a three-year plan and the PUC has stated that the transmission line was
needed in the summer of 2000. He explained that the PUC actually needs no formal proceeding
and that the Rule 18 ruling gave the general location but not the final route.
Mr. Nickerson showed slides from the June 1, 2000 meeting (first meeting) with Tri-State. He
gave other dates that Tri-State had come to the Board of Trustees regarding the transmission
lines.
Engineer Dave Lindsay read a letter dated January 1, 2001 that was received from Tri-State.
Mr. Nickerson said that beginning two years ago, there were seven public meetings held
regarding Tri-State. He showed a route analysis of the WCR 11 option and stated that every
citizen within 300 ft. from the line was notified of this meeting. He explained that the Town of
Firestone requires all lines to be underground. The Town financially cannot require Tri-State to
underground, although the Town does have the fiords to underground the lines. He showed the
map of the undergrounding of the line that was shown to the Planning and Zoning Commission.
It will cost approximately 2.18 million to underground and will be done in two phases, with the
portion by the turkey factory, to be above ground until funds are available to underground these
lines.

Attorney Sam Light talked of matters of statewide interest, saying that the towns cannot regulate
this because it is a matter of statewide concern, and being a state law town ruled or governed by
the state. Due to this the town cannot require Tri-State to underground the utility at their
expense. The 1041 is a bill enacted years ago and the law was adopted in 2000 to notify the
affected governments. Mr. Light stated that if the alternative routes were to be used, other steps
would need to be taken, such as more notice to the citizens or the applicant amending the
application. He said that the options for the Board to consider for this application are to approve,
approve with conditions, deny, remand back to the Planning Commission, cancel or close the
public hearing and take final action at a later date. The latter of the two have deadlines from the
State that requires a decision be made within 90 days. He explained that after the Board has
taken action, the utility can appeal any adverse town decision to the PUC with a court proceeding
and the PUC holds its own hearing and enters its own final order.
Mr. Nickerson stated that the Firestone Trail is the only public corridor available for
undergrounding the line and is the least expensive. He said that Engineer Dave Lindsay has met
with Tri-State to discuss the underground option.
Attorney Sam Light handed out a draft of the Resolution.

Mr. Steve Faucet was sworn in by Mayor Simone. Mr. Faucet stated that the bids for
construction are usually close to the estimates.
Mayor Pro-tem Bertron moved and Trustee Meis seconded to take a five-minute recess. Voice
vote was taken. Motion carried. [9:35 p.m.]
The Board reconvened at 9:40 p.m.
Board Comment
Trustee Meis asked how long it would take to complete, how the line is coming into the other
towns, does United Power have a franchise agreement with the town, will a trail be established
along the way, can funds be worked into the agreement for trail improvements, will the town still
have power while the lines are being worked on, and stated that she agrees with the
undergrounding of the lines.

Trustee Spinden asked how long it would take to get a solid bid from Tri-State for the
undergrounding and if it is possible to make an amendment for getting a solid bid, and asked that
if approved to go underground—will the underground cable heat up.
Mayor Pro-tem Bertron asked why I-25 was not considered for the placement of the lines
because lines are already there, if above ground what is the distance between the poles, agrees
that the cost needs to be solid and is not comfortable with an estimate that is not solid, what is
the process if the Board denies, how large are the ducts, and stated for the record that he does not
like the comments from the citizens that have made mention of the Board taking bribes.
Trustee Thomas asked if 5 ft. 3 inches is sufficient for the lines to be undergrounded, if above
ground how many poles, the cost of each pole, would the cost savings be given back to the Town
of Firestone, and how will the maintenance of the ducts be handled.
Trustee Falcone asked how long it will be until upgrades are needed and when, would the lines
have to be dug up to upgrade, would the town have to pay for upgrades, and how often will the
trail have to be used by heavy vehicles for maintenance, if underground will the above lines be
taken down, and if above ground will the lines have buzzing.
Mayor Simone asked if'the lines that are buried in peoples back yards would expose them to
more EMF than the overhead line, if this is a non-profit organization, at what point would new
development have to pay, and asked if Tri-State has followed all alternate use and routes.
Mayor Simone asked for Mr. Scleck to come to the podium. Mayor Simone asked Mr. Scleck if
he was the person who authorized the letter that was published in the Farmer and Miner, if he
was a member of the citizens of the Firestone Trail, and if he sent the letter to the St. Vrain
Ranch homeowners. Mr. Scleck stated that he did not send the letter to St. Vrain Ranch, but
helped put the letter together for the Farmer and Miner and St. Vrain Ranch. Mayor Simone
stated that the Board of Trustees had received threatening telephone calls; he personally did not
receive any, and stated for the record that if anyone wanted to send garbage to please send it to
him and not the Trustees.
Mr. Steve Mundoruff was sworn in by Mayor Simone. Mr. Mundoruff stated that it would take
approximately eight months to underground the line from start to finish, with six months of
planning and two months to install. If above ground it will take four to five months. The
beginning of this line is at the Rinn Valley Sub-Station; more trail access will be established,
funding for trail improvements may be made available, and blading in new trail can be
completed. Mr. Mundoruff explained that Tri-State has no underground transmission lines at
this time and it will take a few months to get a consultant on board, if above ground the distance
between poles would be 450 ft. to 500 ft. The 5ft. 3-inch cable is sufficient and will be encased
in concrete that will meet the safety code. There will be approximately 30 poles that will cost
from $175,000 to $200,000 per mile and the cost savings may be able to be given back to the
town. The Planners estimate the boundaries for upgrades and if undergrounded it may be a
twenty to thirty year period and Tri-State will pay for all upgrades. Once a year there will be
light maintenance ground inspections with bucket trucks, and the lines should last for forty to
fifty years. Any damage done would be paid for by Tri-State. There will be no maintenance in

ducts, if the cable fails a cable trailer and equipment will be brought in. The ducts are 3-V2 inch
in size and when being worked on the town will still have power. There will be buzzing with
overhead lines and no noise with undergrounding. He stated that a cable problem takes a lot
longer to repair rather than and overhead since there will be feeds from the north to the south.
Attorney Sam Light said that if the Board denies this application the next step is with Tri-State,
as they can appeal to the PUC by State statute. He said the Resolution could be approved with
conditions, or with Tri-States consent the public hearing can be continued until an exact amount
is given. He stated that Tri-State has complied by submitting the alternate routes information.
Trustee Spinden asked if the town could put in the agreement that if the town does not like the
number given by Tri-State, the town is not obligated. Mr. Light said that there are options
available.
Mr. Faucet said that they could go through a stage process and suggested writing an agreement,
proceed with hiring a consultant, the town will give money and be responsible for that design,
and if the town if not satisfied they can escape the agreement or bid the project and see what kind
of bids are received. Tri-State will need a default permit for a high line if'needed, and they
would require an advance of funds to be held in a trust account to be dispersed against the
project.
Planner Bruce Nickerson stated that if the agreement does not work out, the lines would go away
and relayed that Tri-State has been good to work with. Mayor Pro-tem Dennis Bertron asked
Mr. Mundoruff if Tri-State was opposed to continuing the land use portion. Mr. Nickerson said
that the 90 days expiration date is September 5, 2002. Mr. Mundoruff said that he had a problem
with continuing the land use portion and there is still negotiation for a separate easement; a two
party agreement for the bid process and dispersment of funds and stating there is nothing in the
resolution that binds the town. Trustee Spinden asked if the Board were to vote 'No", would
Tri-State obtain an easement anyway. Mr. Light stated that this would be up to the Board of
Trustees. Mayor Simone asked Tri-State if they were sure of the 2.1 million dollar figure. Mr.
Mundoruff replied that a similar assessment was made in Telluride in late 2001. Mayor Simone
stated that he feels that the lines need to be underground and the town will need an escape clause.
Mr. Mundoruff stated that if Tri-State had more time, they could work with the town and re-
submit, but the deadline is up. Trustee Meis stated that she did not want the town to get caught
up in litigation and asked Mr. Light about the escape clause. Attorney Light stated that an
escape clause could be placed in the easement agreement.
Trustee Meis moved and Trustee Falcone seconded to adopt Resolution No. 02-35, A
RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND A PERMIT TO
UNDERTAKE THE SITE SELECTION AND CONSTRUCTION OF A MAJOR FACILITY
OF A PUBLIC UTILITY AS A MATTER OF STATE INTEREST FOR TM-STATE
GENERATION AND TRANSMISSION ASSOCIATION.

Discussion
Trustee Thomas asked that if the town counts the land use issue, what kind of time frame is the
town looking at. Attorney Light stated that this should be acted on within 90 days, and Tri-State
would still need a land use permit or they could go to the PUC and file.
Voice vote was taken with 3-Yea, 2-Nay. Trustee Spinden and Mayor Pro-tem Bertron voting
Nay. Motion carried.
Trustee Spinden moved and Trustee Meis seconded to allow the records of the Tri-State
Generation to be of Public Record. Voice vote was taken. Motion carried.
Ordinance No. 507—Extension of Food Tax
Trustee Thomas noted that the increase for 2003 was $750,000. Mayor Pro-tern Bertron moved
and Trustee Thomas seconded to adopt Ordinance No. 507, AN ORDINANCE EXTENDING
THE TOWN SALES TAX TO THE SALE OF FOOD AND SUBMITTING THE QUESTION
THEREOF TO THE REGISTERED ELECTORS OF THE TOWN.
Discussion
There was discussion with Planner Bruce Nickerson handing out a map on the food tax.
Attorney Sam Light gave briefing on the structure of the ballot.
Roll call vote was taken. Motion carried.
Aggregate Industries Easement Agreement
Planner Bruce Nickerson briefed the Board showing more flexibility and range, and stating that
there is no out of pocket for the Town of Firestone. Mayor Pro-tern Bertron moved and Trustee
Meis seconded to approve the Aggregate Industries Easement Agreement and Authorized the
Mayor to sign. Voice vote was taken. Motion carried.
Adjournment
There being no further business to come before.the Board of Trustees, Trustee Meis moved to
adjourn. The meeting adjourned at 11:50 p.m.

Mark Murry with Tri State Generation stated the above ground poles would be 60 feet high along
the trail.
Mike Barningham gave an over view of the routes proposed for the lines.
1. I-25 industrial commercial corridor. Substations are fixed locations and this route
would add 2 miles of line to the project. Colorado Department of Transportation does
not permit overhead transmission lines within the interstate right-of-way nor can they
hang over the right-of-way. The distance between edge of the right-of-way and the
frontage mad is insufficient for the proposed transmission line. Routing behind the
commercial property there may be another development planned and approved to be
built.
2. Godding Hollow the ditch has a floodplain that extends 500 feet on either side of the
ditch and the lines can't be in a floodplain.
3. West out of Rinn Valley and up WCR-11 is too close to residents.
4. North out of Rinn Valley the line would have to cross the St Vrain River 3 times
regulatory approval would not be given.
5. East out of Rinn Valley then connect with Colorado Boulevard(WCR-13) up to the
Del Comino switching station. Insufficient space available between Colorado
Boulevard (WCR-13) and the existing subdivisions in the area.
Dr. Robert Pearson from Environmental Engineering Consulting Co. stated that the use of
electricity has no ill effects to health. Sense they can't prove there are no effects they will do
everything they can to reduce the health risks.
Staff Comment
Bruce Nickerson stated that the Town couldn't require Tri-State Generation to pay for the extra
expense of under ground lines. Town would be able to use the impact fees normally used to
improve roads and parks to put the power lines under ground. This may delay some road and

park improvements. He also stated that there would be some additional revenue sources in the
process for the Town.
Kevin Ash had no comments.
Kathleen Harrington bad no comments.
Mike Simone asked how much of an impact putting the power lines under ground would make
on future projects.
Bruce Nickerson stated that it might hold up improvements on Colorado Boulevard(WCR 13)
for a year. This shouldn't hurt any parks projects.
Ginny Buczek asked if Tri-State Generation would put crusher fine along the parts of the trail
that they would be working on.
Steve Faucet Sr. Vice President of Tri-State Generation stated that they would consider using
crusher fine to repair the trail instead of reseeding the traiL
Lynelle Meis asked if by putting the power lines under ground would it insulate the microwaves
more.
Dr. Robert Pearson stated that the microwaves would be slightly higher because the lines would
be closer to people. The microwaves would be much lower the further you get away from the
lines.
Public Comment
Rod Unger, developer St Vrain Ranch Subdivision, suggested that United Power help pay for
putting the lines underground.
Cathy Allen lives at 6526 Sage Ave concerned with putting the line down the trail wanted to
know if there was possibly any other route that could be used.
Lisa Nelson lives at 11375 Daisy Street submitted a petition from Oak Meadows with 81
signatures. Wants the Town of Firestone to consider other measures to meat the growing need
for power.
Megan Marks lives at 10549 Taylor Avenue will be very happy with the under ground lines.
Sabina Lynch lives at 6850 Sage Avenue stated that she supports burial of the power lines so that
the property values would not drop. She also asked why they will build the lines in 3 months
above ground if funding is not found.
Suzanne Graf lives at 6675 Saddleback Avenue submitted a petition and a study from the
Environmental Protection Agency stating children have a higher risk of leukemia living near
high voltage wires. She also submitted a letter from a realtor stating he fells the power lines will
depreciate homes between 10 and 20 percent and will stay on the market longer.

Henry Gneiser lives at 10369 Falcon Court, a board member of Ridgecrest HOA, stated that the
underground power lines need to be spaced far enough so the magnetic field will not effect home
owners and people using the trail. He also stated overhead power lines will decrease property

Eugene Perry lives at 5966 Stagecoach Avenue submitted a petition from Boothfarms
Subdivision stated he wanted the power lines to go along I-25 corridor.
Sam Sears lives at 6598 Saddleback Avenue stated he was not happy with route wanted board to
vote no. He was also worried about health risks to people using the Firestone Trail.
Anon Wallas lives at 6932 Summerset Avenue asked about changing the route up WCR 11 to
Firestone Boulevard(WCR 24)east to Colorado Boulevard(WCR 13).
Brinda Wagner lives at 6781 Quincy Avenue submitted a petition from her area of Ridgecrest
Subdivision. She also asked if there would have to be an increase in the line size for future
power needs.
Anita Knudson lives at 6171 WCR 20 asked about the route that went north out of Rinn Valley
the line would have to cross the St Vrain River 3 times wanted to know if they could go north
then go east before the St Vrain River then hook up with the substation.
Carol Giffin lives at 6700 Owl Lake Drive submitted a study on Natural Amenities.
Tammy Lizinski lives at 11755 WCR 15 would hike to bury line all the way down the trail.
Ralph Syler lives at 6905 Saddleback Avenue asked about the cost comparison for the trail route
and the WCR 11 route. He also asked about the town a tax base or revenue base that would be
returned to the town.
Bruce Nickerson stated that under 1041 permit the town can't regulate the income from the site
location and that the lines will go in if financing hasn't been arranged in 3 months, above
ground. The town has limited control over the power line location and specifications.
Kim Landlord lives at 6631 Echo Circle agreed with other testimony.
Tony Galiarty lives at 6729 Quincy Avenue, a board member of Ridgecrest HOA, asked about
the historical nature of the trail. He also asked which route was planned by the PUC. He asked
about a copy of the environmental report.
Ann Johnson, with Briteside Market, concerned with health risks.
The public hearing was closed by Ginny Buczek at 9:34 pm.
Steve Faucet stated that their company is a nonprofit company. The Town of Firestone will start
seeing brown out conditions by next year if the power lines are not put in. The contract would be
on a cost based contract. Lines would not need to be upgraded this line is a lode serving line
meant to serve the communities along the route. The PUC does not approve the routes. He also
stated what items were needed with in the 3 month time period for the under ground lines to go
through.

Bruce Nickerson stated that due to the house located at WCR 11 and Firestone Boulevard(WCR
24) and the gravel pit that route wouldn't be acceptable and it would cost more to put it there
because we don't own the land. We would also not receive the money to defer the costs if they
don't use the easement along the trail.
Mike Simone asked about the cost of burying the line along WCR 11.
Dave Lindsay stated that the cost would be 6.8 million dollars double the cost along the trail.
Doug L ndhardt stated that this route is the best possible route the town could find with the
lowest impact on residence.
Ginny Buczek stated that she could not see a better alternative the power line should put it
underground along the trail and use the easement money to put it underground.

Re: Review for Permit of Public Utility 115kV Transmission Line
We would like to formally voice our objections to the proposed 115kV transmission line. We
respectfully ask that this matter be reconsidered perhaps leading to the cessation of 115kV
development activities. We base our objections on the following four reasons.
• Potential to decrease the property value of our home
o A 115kV levies potential health risks and detracts from the beauty of the
surrounding neighborhoods. Numerous local real estate agents have conceded
that property values for residences close to County Road 11 will likely suffer
losses.
• Potential health risk to my family
o Although I would guess the health risks due to the power lines are low, there is,
nonetheless, an unnecessary health risk that neither my wife, nor my infant son,
nor myself should be subject to.
• Perception that the local community voting process is meaningless
o The issue of funding a special district to bury the powerlines was voted on in the
local community. This vote passed;the special district funding was approved by
a vote held in November, 2001, at a Frederick local government building. The
results of this vote were subsequently nullified through a petition process,which
is the subject of some amount of controversy.
• Decrease to the local neighborhood aesthetics
o The beauty of the local neighborhoods of Eagle Valley, Fox Run, and Summit
View will be diminished by the presence of large 115kV powerlines. All
residents will clearly see the powerlines simply by driving down County Road 11.
The presence of the powerlines detract from the local beauty provided by the view
of the mountains to the West.

Last October my family and I moved to the Eagle Valley subdivision in Frederick, CO.
Our first home was in Northglenn and that is the home we lived in when our two children
were born. That is also the home that had a power line located 75 feet from our back
door. When we moved into our home in Northglenn we didn't think the power line
would be that big of a deal. Five years later, we moved because of it. The power line let
off sparks into our backyard every time it rained or snowed. The constant hum is not
only extremely annoying, but makes you wonder, "How close is too close to be living
next to these things." I know these issues are up for debate, but with the incessant
humming as a constant reminder, I felt it wasn't worth the risk anymore.
After moving into our new home, we found out that a high voltage power line could be
put up down the west side of WCR 11. This line would be less than 70 feet from my
bedroom window and only a few feet from my backyard fence. Not only is this line
going to be closer to my home than the one I lived near in Northglenn, but it could in fact
hit my home if it were to fall over. I can't imagine how bad the humming noise would be
with this higher voltage line even nearer to my house.
There arc so many homes that are so close to the proposed WCR 11 route. If in fact there
is anyway at all to reroute this power line I feel it should be done. There are just way too
many families living way too close on this route. I appreciate your time and any effort
given to this matter.

We respectfully ask the Board to consider denial of the permit being requested
by Tri-State. The portion of the route we are in opposition to is along Rd.n
between Rd.18 and Rd.20.An above-ground power line in this area poses a
safety threat to adjacent homes,and will negatively affect property values in this
densely populated area.
There are 18 homes in the Eagle Valley subdivision that are adjacent to Rd.u.
(See the attached map.) The proposed u,5KV line would be erected between the
existing sidewalk and the fence that runs along Rd.ii. The distance between the
sidewalk and fence is about 24 ft.Therefore,power poles would be placed about
12 ft.from the Rd.i1 fence.
Progressing from South to North, there are 5 homes on Crane Ct(4820,
4818,4816,4814,and 4812)that average about 48 ft.from the Rd."fence,
placing the homes about 6o ft.from the power poles. The home at 4821 Barn
Owl Dr.is about 36 ft.from the Rd.0 fence,therefore only about 48 ft.from the
proposed poles. This property also has a detached garage within several feet of
the Rd.0 fence. The home at 4824 Thrush Ct.is only 20 ft.from the Rd.1x fence,
therefore only 32 ft.from the proposed poles. The home at 4825 Thrush Ct is 30
ft.from the Rd."fence,so 421t from the proposed poles. Nine homes on Egret
Dr.back up to the Rd.11 fence,varying from about 48-60 ft from the fence. This
places all nine homes within 72ft.of the power poles. Several children's play
structures and sheds exist in these back yards. And the home at 4891 Eagle Blvd.
is about 24 ft.from the Rd.n fence,therefore within about 36 ft.of the proposed
poles. This home also has a detached garage adjacent to the Rd.n fence.
Homeowners are concerned because of the proximity of their homes to the
proposed high voltage line. The line would be run on 75 ft.tall wooden poles.
Seventeen homes in Eagle Valley are within 75 ft.of the proposed line. What if a
power pole was knocked down in a traffic accident? What if a line snaps during
an ice storm? The proposed line poses a safety threat to these 18 homes.
Homeowners are also concerned about property value loss. Local realtors
have indicated significant property value loss for homes along Rd.u.(see the
attached realtor letters) Because home values are based on comparable

properties, the value of 600+homes in the 3 affected neighborhoods could be
adversely affected. Reasons for property value loss include: 1. Proximity of
homes to the high voltage line and the perceived health risk associated with such
lines. 2.Impeded mountain views for homes on the East side of Rd.ii. 3.A
potential for the high voltage line to hum. 4.Safety concerns.
Please note: Homeowners are not opposed to Tri-State's proposed route if the
lines were to be buried. But homeowners feel that the proposed above ground
route poses a safety threat to adjacent homes. Why place high voltage lines next
to 3 existing,large neighborhoods which house i000+people when other routes
exist? What if children climb the poles? Or fly a kite near the line? Why not
place the line in a less densely populated area?
We propose that Tri-State be required to by-pass Rd.ii between Rd.18 and
Rd.2o. No homes exist along Rd.13 between Rd.18 and Rd.2o. We suggest the
line be place there. We feel that the Rd.13 route was not adequately or seriously
considered by the Town of Frederick when choosing a route.
We ask for your serious consideration of this matter, and we thank you for

The proposed project of placing the 115kv Transmission line above ground r
would definitely have a negative effect on surrounding property values. Not
to mention the health concerns of the people;me being one of those,that
currently live in the following subdivisions:
Eagle Valley
Fox Rua
Summit View Estates
And surrounding Homes and Land.
Placing values on Real Estate is greatly effected by what homes are
currently selling for in the immediate area. A home that is located in the
back of one of these subdivisions is affected just as much as a home that is
located much closer to the Transmission line. Pricing and Appraisals done
through a Competitive Market Analysis would reflect the negative effects of
this project.
I think everyone needs to be aware of these adverse effects. Although there
may be an initial cost of burying the line,this cost should more than pay
itself through maintained home values.

It is my professional opinion that overhead power lines will and do decrease the
property value of a home.
This conclusion is based on my actual experience as a Realtor.
In the past eight years, I have never had buyers that have bought a home
located under or.near any overhead power lines. I am quick to point out to my
buyers the low re-sale value and that we would need a study for the health risks
involved.
I have not listed or would consider listing a home under or near any overhead
power lines without o serious reduction in the sales price. I would also be forced
to amend the contract that the buyer would not hold the seller or myself
responsible for g Issues resulting from such power lines.

We ask that you deny Tri-State' s application for permit to
place an above ground, 115KV power line down WCR 11 between
WCR 18 and WCR 20. This route affects 3 large
neighborhoods, housing thousands of residents in more than
600 homes.
This route was chosen simply because it is the most direct
route from the existing 115KV line just off of Highway 52
along WCR 11. Continuing the line directly down WCR 11
saves the power company money. But this route affected more
people than any other proposed route through our area. The
same 1 mile stretch of road just East of us on WCR 13 has NO
homes along it. We feel that NCR 13 is a more responsible
route for this proposed high voltage line.
We're concerned because case studies indicate an increased
risk of cancer in children living next to high voltage power
lines. (see attached) We are raising 4 young children, and
we feel that these studies cannot be ignored.
Our realtor tells us that a high voltage line along WCR 11
would significantly decrease our property value. (see
attached) It would impede our view, and the health risk
associated with such lines (actual or just perceived,
depending on your opinion) would deter possible buyers of
our home. In fact, our realtor states she won't even sell a
home near a high voltage line!
Voters in the Nov. 2001 election approved funds through a
special improvement district for the purpose of burying Tri-
State' s proposed line. But the Town of Frederick has
refused to instate the district. The Town of Firestone is
funding the burial of Tri-State's line through it's
jurisdiction. And the power companies, who do make a profit
from the power they provide, fund the burial of lines when
required.
A better route for this above ground line should be
required, or the line should be buried. Thank you for your
consideration.

This letter will be short,concise and to the point.
It is my professional opinion that overhead power lines will and do decrease the
property value of a home.
This conclusion is based on my actual experience as a Realtor.
In the past eight years,I have never had buyers that have bought a home
located under ar near any overhead power lines. I am quick to point out to my
buyers the low re-sale value and that we would need a study for the health risks
Involved.
I have not listed or would consider listing a home ynder or near any overhead
power lines without a serious reduction in the sales price. I would also be forced
to amend the contract that the buyer would not hold the seller or myself
responsible for pnv issues resulting from such power lines.
Please do not hesitate in contacting me if I can be of further assistance.

Studies link Electromagnetic Fields(EMFs)To Illness

It was sort of a funny story when we first heard about it a few years ago: A dairy farmer living in
Wisconsin near high voltage utility company transmission lines couldn't turn out the lights in his tram.
Even with the switches in the off position,fright after night after he had finished his chores,he'd go
back out to the barn to find the light bulbs still glowing from the electrical charge hovering in the air.
The cows were none too happy about it either,because the constant light prevented them from
sleeping,and they gave less milk.
But the story doesn't seem so funny any more—not after the spate of recent reports of children
developing deadly illnesses or adults dying prematurely of rare diseases—all apparently b.rA,>qp they
had the misfortune of living near high amounts of electrical current.
A growing body of scientific evidence suggests that invisible electromagnetic fields(EMFs)--created
by everything from high-voltage utility company lines to personal computers,microwave ovens,TVs
and even electric blankets—are linked to a frightening array of cancers and other serious health
problems in children and adults.
Though it received scant attention from the mainstream press,a report leaked last October from the
U.S.National Council on Radiation Protection said there is a powerful body of impressive evidence
showing that even very low exposure to electromagnetic radiation has long-term effects on health.
The report cited studies that show EMFs can disturb the production of the hormone melatonin, which
is linked with sleep patterns. It said there was strong evidence that children exposed to EMFs had a
higher risk of leukemia.
This follows on the heels of three epidemiological reports released in 1994. One indicated a tie
between occupational exposure to EMFs and AlSiuw4's disease.Another suggested a link with
Sudden Infant Death Syndrome(SIDS).The third study indicated a tie with Am yotrophic
lateralsclerosis.

Now a surprising new report released in February by physicists at Britain's University of Bristol shows
that power lines attract particles of radon-- a colorless, odorless gas irrefutably linked with cancer.
What's this all about?And why have the media failed to report with the appropriate emphasis the
implications of these significant health risks?
Shortly after her son Kevin was diagnosed with leukemia,Julie Larm of Omaha,NE. began to notice
other children at the local pool who had lost their hair or had surgical scars. As her suspicion rose,she
began talking to other parents. One person she contacted was Dee Hendricks,whose son was also
undergoing cancer treatment. Together they collected the names of eleven children in the area who
had cancer.
When they plotted them on a map they were surprised to see that all lived within one mile of each
other and an electric power substation.
"If there was nothing to worry about,why does our utility have an EMF committee...which was in
effect long before we came and started making noise?"asks Larm, a member of the Omaha Parents
for the Prevention of Cancer. "Why do they need such things if theses nothing to it?"
The group's efforts have been buttressed by Paul Brodeur,a campaigning environmental journalist
who had in his day taken on asbestos and chlorofluorocarbons and is the author of two books on the
subject of EMFs.Brodeur is convinced that EMFs are one of the greatest environmental threats facing
the nation.
"Never before has there been this much epidemiological evidence of the carcinogenicity of any agent"
says Brodeur, "and that agent declared to be benign."
Robert Becker,M.D., author of Cross Currents(Tardier, 1990),who has studied this subject since
the 1960s warns, "EMFs could turn out to be a far worse environmental disaster, affecting far more
people,than toxic waste,radiation or asbestos."
To some,especially the families of people with unexplained cancers,the sheer vohnme of research that
has been carried out on this issue suggests there must be a cancer connection and perhaps a cover-up.
Their suspicion is heightened by the fact that many of the studies are funded by the utility industry,
which would be directly affected by the studies'outcomes.
At the heart of the matter is a relatively simple and well-understood physical phenomenon:When an
electric current passes through a wire,it generates an electromagnetic field that exerts forces on
surrounding objects. Electric fields arise from the strength of an electric charge;magnetic fields,from
the charge's motion.
Unlike ionizing radiations such as x-rays--which pack sufficient wallop to knock electrons out of the
molecules that make up the human body--EMFs do not produce charged particles,so experts always
believed they posed no danger. Therefore,the Federal government has never regulated EMFs, and the
electric industry was allowed to set its own standards.
But other recent experimental studies have shown that even weak magnetic fields can change the
chemistry of the brain,impair the immune une system,and inhibit the synthesis of melatonin, a hormone
known to suppress several types of tumors and to be present in reduced amounts in men as well as
women who develop breast cancer.

Some lab tests have confirmed that EMFs affect living
vmg cells in a variety of ways,most of them
harmful. (Scientists are intrigued, however,by their ability to speed slow-healing fractures,enhancing
bone formation).
What's confusing is that the studies have produced widely divergent and often contradictory results.
On the one hand,many scientists are convinced the study of electromagnetic fields is a massive waste
of time and money--costing an estimated one billion dollars a year.After years of extensive study,
Dr. Garry Boorman says, "We're not sure what part of the field, if any,is toxic or important,or could
be hazardous to your health."
As a PBS "Frontline"documentary reported, scientists have been unable to locate a mechanism by
which electromagnetic fields would trigger a biological reaction.The energy in the fields to which
most of us are exposed is tiny tens of millions of times too small to break the molecules in cells.All
living organisms evolved in the presence of the earths magnetic field,which is two hundred times
larger.
Dozens of animal experiments have been carried out in which rats and mice are exposed to very large
magnetic fields for long periods-- some for their entire lives—but no animal has ever been proven to
contract cancer due to this exposure. Generations of rodents raised in the presence of high magnetic
fields do not show any increased evidence of birth defects or depressed immune systems.
With no animal data to support the claim and no physical mechanism to explain how it might affect the
body,the main support for a connection has come from epidemiology.
As for clusters lure the ones which motivated Julie Latin and her group in Omaha,many scientists are
skeptical about their significance,if any, to the debate about EMFs. Because conditions!fire cancer are
surprisingly common about one-third of the population gets cancer in their lifetimes random clusters of
the disease are not unusual and are found close to and far from power lines.
Still,because of our reliance on electricity and the potential financial consequences for utilities and
other companies,the regulation of EMFs is a politically sensitive issue. There is evidence to establish
that the Bush administration tried to suppress findings of a study by the Environmental Protection
Agency linking electromagnetic fields to certain health problems. The Clinton White House,
meanwhile,has been largely silent on the issue.
Cover-Up?
Lending credence to claims that there is,indeed,a public health risk from EMFs and that the
government knows about it is that an EPA report a few years ago raised suspicions of a causal link
between electromagnetic fields and leukemia, brain tumors,breast and prostrate cancer,even birth
defects.
Less-publicized but still significant are some of the foreign studies. Last July,Canadian researchers
told the Lancet medical journal they had found a high rate of leukemia among children whose mothers
had worked at sewing machines while pregnant.
Checks showed the operators were exposed to more electromagnetic radiation than people who work
on power lines or in power stations.
In another study, Swedish researchers assessed the long-term exposure of people living near high-

voltage transmission lines by taking spot measurements of the field strength in each home,and using
them to confirm the accuracy of a computer model that calculated the strength of the fields emitted by
each of the lines, according to distance from the lines,the wiring configurations,and the current level
the lines were known to be carrying.
Then they programmed a computer with records of past current loads that had been maintained over
the previous 20 years for each of the transmission lines. They were thus able to pinpoint with great
accuracy EMF exposure for each cancer victim. What they found was a clear dose-response
relationship between exposure to even weak power-frequency electromagnetic fields and the
development of cancer,especially acute and chronic myeloid leukemia.
A second Swedish study,which also employed cases and controls,was conducted by epidemiologists.
It confirmed that average magnetic field exposure over time was the critical factor in the development
of disease.Interestingly,these studies were funded in part by the Swedish utility industry.
Maria Feychting of Swedens Karol nska Institute looked at 127,000 children who lived near big power
lines for over 25 years and found twice the risk of leukemia.
"In our study we found about a two-fold increase in the risk if the children were living close, within 50
meters(yards)of a big power line," she told Britain's Channel Four television.
The new study by the University of Bristol showing that power lines can attract cancer-causing gases
like radon has heightened concerns.
Even scientists who have failed to find a reason for the apparent link refine to say it is safe to live near
a high-voltage power line.
Warning to Parents
Of critical importance to all parents is that some studies have suggested that children exposed to
magnetic fields of between two and three mllligauss or above experienced a significantly increased risk
of developing cancer. Since ambient levels of two to three milligauss can routinely be measured in
buildings within 50 to 150 feet of wires carrying strong electric current,these findings are especially
troublesome.
The report leaked last October by the mellitus National Council on Radiation Protection recommended
a safety limit of 0.2 microteslas,a very weak field compared to those generated by household
appliances. A person standing one foot away from a vacuum cleaner or electric drill can be exposed to
anywhere between two and 20 microteslas.
There is no way to block EMFs(they even penetrate lead shielding),and the only protection is
distance from the source.
In our electronic age,its almost impossible to eliminate exposure to the myriad of electrical sources
with which we come in contact on a daily basis.
Thousands of electric company substations arc scattered throughout our cities large and small and
they abut{tomes,apartments and office:buildings--even schools. Since few of the high-voltage limes
that lead into and out of these substations have been buried to prevent harmful emissions, magnetic

fields of potent strength can be found virtually everywhere.
Concerns have also been raised about magnetic fields given off by faulty household wiring,by high-
current conductors concealed in the walls,ceilings and floors of commercial office buildings and other
large structures;and by high-voltage transformers that can be found in almost any large building.
The EPA Raises Questions
Concerns about so-tailed non-ionizing radiation began to mount in 1979,when a study of cancer rates
among Colorado school children determined that those who lived near power lines had two or three
times as much chance to develop cancer.The link seemed so improbable that power companies
eagerly paid to have the study replicated. To their surprise,the subsequent scientific inquiry supported
the original findings,which have since been buttressed by a variety of additional studies and reports of
increased cancer rates among workers employed in the electric industry.
One such study,conducted by the Fred Hutchinson Cancer Research Center in Seattle, WA.
confirmed that telephone linemen,electricians and electric-power workmen arc developing breast
cancer at six times the expected rate.
But it was the Environmental Protection Agency's scientific review that has had an explosive impact,
lending the most credence to those who have been warning of EMF health hazards.
The report--a 367-page document entitled "Evaluation of the Potential Carcinogenicity of
Electromagnetic Fields"—came to light in 1990,when someone in the agency leaked a draft version
of it to Louis Slesin,editor of an influential newsletter called Microwave News.
Chief among the conclusions was one specifying that power line electromagnetic fields should be
classified as a"probable human carcinogen."William Farland,then-director of the EPA's Office of
Health and Environmental Assessment ordered this conclusion deleted from the report.
Then the Associated Press reported that the Bush administration tried to delay release of the EPA's
findings.Robert E. McOaughy,the project marwger and chief author of the report,was quoted as
saying that the White House"was concerned not about the accuracy of the report...(but)about how
people would react to the news and how it would affect the electric power industry."
Ultimately,after two major TV networks and newspapers throughout the country exposed the Bush
administration's efforts at censorship,the report was released. It contained a disclaimer that asserted
"the controversial and uncertain nature of the scientific findings of this report"and declared that it
should not be construed as "representing Agency policy or position."
The Medical Connection
Just how EMFs affect humans is still not entirely known.
In the case of cancer,most specialists theorize that a malignant tumor forms in at least two stages. In
the first,referred to as "initiation,"an outside agent damages the cell's genetic material.Because
EMFs are not strong enough to break molecular and chemical bonds, scientists are concentrating on
the second stage of cancer,a series of steps called "promotion." Researchers are tying to pinpoint
ways in which EMFs might cause cells to grow and multiply abnormally_

�-. Some studies suggest that EMFs may promote cancer by interfering with the transmission of calcium
across the cell membrane,a flow that governs such processes as muscle contraction,egg fertilization,
cell division,and growth. EMFs may also disturb a cell's ability to process hormone,enzyme,and
other biological signals that regulate normal growth.
EMFs are known to affect nerve impulses. Melatonin,a regulatory hormone secreted by the pineal
gland near the brain,ordinarily stimulates immune responses and may suppress tumor growth.
Reduced melatoni n production has been linked to breast and prostate cancer. Melatonin secretion in
turn is controlled by norepinephrine,a neurotransmitter in the brain. Receptors for its relative, the
hormone epinephrine,are disturbed by EMFs.
Some doctors stated that their observations led them to believe that it was possible that magnetic
fields stimulate the rate of cancer cell growth,or act as a cancer promoter.
A San Antonio researcher discovered human cancer cells exposed to 60 Hz fields(the frequency of a
high-voltage line)grew as much as 24 times as fast as unexposed cells and showed greatly increased
resistance to destruction by the cells of the body's defense system.
Female breast cancer has reached epidemic proportions,with one in ten American women developing
it and one in four dying. Alarmingly,of women who develop the disease, 55%have no known risk
factors.Breast cancer mortality rates are five times lower in Asia and Africa than in industrialized
North America and northern Europe regions where EMFs are onmipresent.
Electric Companies On the Spot
A contention of the electric utility industry in the United States had been that the pathologies referred
to in most of the studies might actually have been induced by exposure to pesticides,chemicals or
other toxic agents in the environment.
For a time they contended that if power-line magnetic fields really did cause cancer,the fivefold
increase in electrical usage during the past 30 years would have been expected to have produced an
epidemic of childhood leukemia. The utility industry stopped making this statement in June of 1991,
after the National Cancer institute disclosed that a study it had made showed that in recent years there
had been unexplained increases of nearly 11%in childhood leukemia,and of more than 30%in
childhood brain cancer.
A study in the American Journal of Industrial Medicine reported a steep increase in brain-cancer rates
over the past dozen years among the general population.
People working with computer monitors are developing primary brain tumors at nearly five times the
expected rate.
Still,as Dr. Becker observes, "Companies wont admit that EMPs are risky,lean they will become
liable.And the government wont, because it is the largest user of the electromagnetic spectrum,
especially for military communications. Our whole economy depends on them now."
Not surprisingly,as people begin to focus on the problem of EMFs,property values near power lines
and electric substations have been plummeting,and numerous lawsuits have been filed.
